I have a court case coming up and have a query

 

Is an application notice (from the respondent) valid without a court seal? (i.e.the court rubber stamp which prints the date and time of the court order)

If I was you I would phone the court who made the "order" tomorrow and ask for confirmation.

 

Its hard to judge as it could be a genuine error

My court case is actually tomorrow. However I only just noticed that the respondents application notice fails to have a court seal?

 

As a result, I believe that this makes their documentation invalid.

 

What are your thoughts? Additionally, who would be the best person for me to raise my concern with?

Not eniterly surely on legality.

 

Best advice I can give now without the other experienced caggers would be

 

Get the the court by 9am and ask to see court Clarke.

Most cases aint usually listed till 10am so that give you an hour to sort it.

 

Prepare for both outcomes. Dont belive it is not genuine. I just been through a difficult case and all I can say is take a step back and evaluate everything as an outsider just like the judge will do.

 

If it is a forged document I believe that would give you grounds for adjournment should it be needed.

 

Hope this helps. Hopefully someone else will come along shortly.

 

If not get to the court by 9am and demand to see the Clarke

Application Notice does not require a court seal...but it usually followed by a General Order from the court with reference to it.
