    • I received the first signs of life from Shell Energy's "legal counsel" regarding the 1st claim and default judgement awarded against them.   I have attached a redacted copy of the letter where they indicate they look forward to receiveing a letter of confirmation.   I am confident I know why they have sent this request and more importantly how they intend to use any response.   I have prepared two options.   1. Ignore their letter (This is probably the best option).   2. Reply succinctly.     Shell Energy - Warrant of Control Response - Redacted.pdf
    • I found an old defence I used and tweaked a bit. Unfortunately I think I messed up in not asking for a statement in my cpr, while it wasnt referred to in the poc it does have the amount. There were no paragraphs and it looks like it was done on a phone or even an excel import??. I dont know if not requesting the cpr means I cant ask for proof of how they got the amount?   Is that enough about the lack of account details?, I mean my cabot ref is at the top of the page but 100% no aqua account number on here. That would surely come under having to prove    Please feel free to tweak etc. Wasnt sure how to word the s78 stuff as I didnt want to lie with it being not in default till weds.     Photo of poc is shown above to show how lacking it is in format in particular        Defence:   1.     The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made.   2.     It is accepted I have in the past had agreements with New Day LTD RE Aqua. I do not recall the precise details or agreement and have sought verification from the claimant.   3.     No account details are given in the particulars of claim linking the claim to the defendant.   4.     It is denied or I am unaware of any legal assignment or Notice of Assignment allegedly served by either the Claimant or New Day LTD RE Aqua.   5.     It is denied with regards to the Defendant owing any monies to the Claimant. The Claimant has failed to provide any evidence of the Agreement/Assignment/Default notice or Termination requested by CPR 31. 14, and will shortly be in default of my section 78 request, therefore the Claimant is put to strict proof to:   (a) show how the Defendant has entered into an agreement and; (b) show and evidence the breach and service of a Default Notice pursuant to sec 87(1) CCA1974 on which the Termination referred to relies upon. (c) show how the Defendant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim;   5. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed.   6. On the 17th of November I requested to The Claimants Solicitors, Mortimer Clarke by way of a CPR 31.14 copies of the documents referred to within the Claimants particulars to establish what the claim is for. Mortimer Clarke have failed to fulfill my CPR 31:14 request.   7. On the 16th of November I made a section 78 legal request to the claimant for a copy of the Consumer Credit Agreement. The claimant has as of of 06/12/21 failed to comply.   8. By reason of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.  
    • Hi Dixon,   If you don't mind, I'm ignoring the CCJ for the moment.   I'm more interested in what you last said to the police about their failure to investigate the fraud against you commited by FTR Ltd and O'Hara.   If you don't want to post it on-thread, send it to me by PM.
    • ok not to put too finer point on the 'silly' mistake ( as in terms of you are a 'litigant in person' - joe public against the 'system') you made on your claim, there are guides on the same website about raising a claim and how to do it properly, but IMHO there should also be LiP leeway regarding this.   did you seek or read any help, as getting the correct entity to sue is quite important, the example you relate too would not be an issue, but suing a corporate entity is, they have lots of money and clever legal eagles.   i have no doubt that, by whatever way, should you rectify this error , you would be successful mind.   on another issue, have you written to apple uk retail offering to mutually settle this if they pay the price of the device or replace it and call it quits?   i will guess this is all you really wanted at the start and now at the end of the day.?   would you seriously lose out money wise if this were agreed?

It could take them a week or so to apply for the warrant - then it depends on how busy the court is as to when you receive the eviction notice with the eviction date - I've known it be anything from 2 weeks to 6 weeks.

Good afternoon - no eviction date as yet

kennys have sent my quarterly statement and are asking me to call them to try and agree something

I have called them and they state they cant agree anything as want full arrears

 

sick of the hot and cold letters

 

FOS are looking into the complaint as we speak and also asked me to forward any letters concerning further action as soon as they arrive ..

hi Andy , sorry I knew I was clutching at straws , I was just hoping maybe they would set an arrangement and the whole eviction would be sorted .

the panic and sleepless nights is taking its toll

Sadly Andy, it's called 'clutching at straws' when you are facing what Markez is, anything that looks hopeful or a chance is taken. Not ideal by any sense of the imagination, but one has to try.

 

Andy's right of course Markez, but do try and heed his advice and keep off that phone if you can, there'll never be anything but grief with Kenny's and that's just dealing with the facts unfortunately.

 

Try and keep strong and keep your energies for the courtroom where this will inevitably be decided.

Just awaiting the eviction date .. I've just paid full cmi and extra as in line with my proposal .. I paid it yesterday .fos are looking into my complaint as we speak and want a call or email as soon as the eviction date lands..

Cheers for the looking out for me .

We're just about to start a mortgage with Kensington.

 

Easy to sit here and say go somewhere else for your Mortgage, but Spudzulu is dead right, once you get into bed with these people, one step out of line and you are doomed into a world of excess charges, higher interest rates, extremely poor administrative back-up and a Company who has not one ounce (gram!) of compassion for their customers in my opinion.

 

Be fully aware of your rights and what might trigger costs. If you get charged any costs for anything, pay them there and then and don't let interest accrue on them. One day late in paying and you'll get yourself charges added

 

If your Credit score is the reason for running with Kenny's then find out exactly what happens if you decide to transfer your mortgage to someone else in say 6 or 12 months and wait until you've paid them for a good 6 months putting your credit history in order and get the hell out of there as soon as you can and onto a High Street lender of repute otherwise you'll be back here looking for help on how to deal with them.

 

I wish you luck, but work on your credit score and a Kenny's exit plan because you won't want to be with these guys when interest rates go up again or if your finances are stretched.

 

Try and get your Mortgage broker to give you some alternatives and tell him or her that you would only stay with Kenny's short-term and ask what the penalties would be for or when you could pull out. Just don't go in blind- always have an exit plan. You'll probably need it.

 

Sorry to digress on Markez's thread, but the story is laid out for you as to how things can change quite dramatically when even the most innocent of situations can turn nasty.

hI guys and girls

so the dreaded letter has arrived :( see attached I have upto 7 days to file a defence

so please can some one help with the n244 form ?

 

ive emailed the FOS As well as they requested to let them know as soon as it arrived

also the FOS emailed me and Advised they asked kennys to cease any action until the complaint has been looked into but kennys declined to cease the action :(

you should be a master at doing an N244 by now..what this the 5th time?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

It looks like they have been given permission to apply for a warrant - so that isn't an eviction warrant. Until you get the warrant with a date you must leave you don't have to enter your N244. That's how I read it anyway.... Ring the court and check if you have to wait for the eviction notice.

Been given to issue Ell-enn not apply......its already been applied for and suspended...so the above must be stayed or set a side now.

 

The claimant will now use the following to formalise the eviction set date....unless an application is made in the meantime.

you either wait and see they start the Form N325A process [and you've paid the installments to date so I don't think they can..unless they lie on the form?

]

 

or

you pop in an N244 to get the proceedings set a side?

 

are you now up to date, regardless to if installments to date might have been late?

good morning,

im not upto date as I missed july payment - ive paid august payment

I wrote to them to advise I would be catching the july payment up over the next few months - they didn't reply

 

 

im so confused - should I just get an n244 done and take to court asap

I will also phone court aswell today at 12 to see what I can do

im getting scared now
