Faulty? Default Notice / Termination Letters from Lending stream

Hi All

 

Just a quick question please relating to Default Notices and Termination Letter.

 

I received a default notice which gave me until the 18th of this month to pay. However I received a termination letter stating the agreement had been terminated on the 17th as the default was not rectified.

 

Does not seem right that they give me till the 18th to rectify, but terminate on the 17th?

Oh dear, then they have a bit of a problem I would say.

 

Was the termination letter dated earlier than the actual date of the termination..

 

For example was the letter dated 15/16th and said in the body of the letter that the account was terminated on the 17th ?

 

What type of debt is this for ?

Hi

 

Thanks for the reply, the letter is dated the 18th, sent today via email.

 

It states "we herby give you formal notice of our intention to terminate the agreement on the 17th August 2013"

 

It's from Lending stream, the last of my creditors Ive attempted to set up payment plans with.

Righto. Well I am not quite sure whether the early termination invalidates the Default Notice or screws up the termination. I will try and find out for sure :)

Lending stream are hard work to set up a repayment plan with. I got their bank details from someone on here, and just started paying them. They are gladly taking the payments but I still get letters from Mackenzie Hall on an almost weekly basis saying I owe them money, always minus the amount I paid the previous time! Oh well, only 6 months left and I will have paid them off! The other alternative is to send them postal orders. They can't refuse any legitimate payment and if they do decide to go to court it will prove you are repaying them so they will be laughed away!

It would still have been before the remedy date had expired on the 18th, Brig. They would need to terminate on the 19th and unless someone stayed up until midnight, their letter should have been dated the 19th as well.

Hi All,

 

Still struggling on with Lending Stream, no joy on the payment plan as of yet and as they just ignore my letters i've given up writing them.

Couldn't find the original agreement I had so have sent a CCA request for it, just to check the amounts there claiming I owe are correct.

 

Still the issue of them sending an intention to terminate letter before the expiry of the default notice, I have not mentioned it to them yet so any advice on how to proceed with this issue would be appreciated.

 

There now saying there going to transfer the debt to a debt collector as apparently I am not making an effort to contact them.
