Hi

Please help i have a suspended possession order on my second mortgage/secured loan of cmp £678.77 + £181.28 to clear the arrears and i have missed two monthly payments because i havent been paid my tax credits!!

I wrote to them (so i had proof) to let them know straight away and i asked if i could pay a lower amount but i never heard anything.

 

I have now received a letter from there solictors saying they are applying to court for an eviction date, i contacted there solicitors yesterday as the mortgage company are not dealing with it now and they said unless i clear the full arrears balance the eviction will go ahead.

 

I can hopefully get some money in the next week to get me back on track with the agreement will this stop any further action? even though they say the require the arrears in full and will i have to go to court again,please help im very worried

Hi there, lets see if we can help - just need a little more information, so if you can answer the following we can go from there:

 

when was the suspended possession order given?

how much are the arrears ?

you say you wrote to the lender advising them of the situation, do you have a copy of the letter and did you send by recorded delivery ?

hi

the original possession order was given in sept 2008, because my ex partner lost his job but they stopped any further action as we agreed to pay extra towards the arrears every month.

 

my ex partner and i split up and he agreed instead of paying maintenance he would pay the secured loan which i only found out in may 2011 he had not being doing because i had no correspondance from them until i received the letter stating the amount of arrears and that they had applied to the court for a warrant of possession, i then applied for to suspend this and i explained my circumstances this had to be appealled.

 

the arrears outstanding are nearly £40,000

 

but i have also got a claim for missold ppi from them for £15,000 which will reduce this by quite alot i didnt realise that the ppi was added to the loan at the start and that i was paying for this every month over the term of 25 years even though it only covered 5 years!! they didnt tell us any of this they just said if we dont make a claim then we will receive £15,000 after 5 years and our account was up to date they did also state we wouldnt get the loan unless we took out the ppi policy but we were both in employment with policies that covered us from work

 

yes i did send the letter recorded delivery and i have a copy of this as well

 

sorry ive wrote a whole book:-) i just wanted to give all the info

From the above its not clear what your current arrears level is? Has the 15k been applied yet? If so then if your arrears are now 25k is this amount something you could realistically clear in the term of your loan? How much is your monthly instalment - I ask this because of the large sums involved.
