      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi i am with barclays bank, need to know how to freeze interest, stop cpa and setup repayment plan with wonga(have read and researched but still dont understand template letters etc.. or where they are or where to send them), beggining to spiral out of control now, have a letter that benefits stop as i am single dad in 2 days because my boy turns 5 will only have tax credits to live on which gets paid into same account :(

Sign in to your online Wonga account and have a look on there to fill out a repayment plan request form.

 

Secure your finances beforehand. Report your card as lost or stolen and call Barclays and Insist that they cancel any CPAs set up by WFUK (wongas trading name).

 

Wonga will ask you for a basic income and expenditure form. Fill out as much as you feel comfortable with (you don't have to give Wonga these details but I believe it helps to get the desired result)

First thing you MUST do, is secure your bank account. Then ONLY when that is done, contact the lender, in writing, and advise them of your current situation. Wonga are normally good about repayment plans, but you still need to have all your bases covered.

Also, when you take the letter to the bank, refuse to leave until they copy, sign and stamp both copies.

If they try to say that, tell them you want it in writing so you can inform the fca. Remember, don't leave the bank until you get it.

what is the fca?

 

Financial Conduct Authority - they took over from the Financial Services Authority in April.

 

They appear to have a lot more teeth and appear at the moment, to be more user friendly :)

i was suprised how well my bank handled this today i took the templated letter with me, she cancelled all my direct debits straight away and stamped n signed my letter and wrote on it direct debits cancelled, also she said she could not find the wonga cpa but phoned cat and they couldnt see it too, wrote on letter if they attempt to take money out of my account to contact the cat(continuos authorisation transfers?) straight away so they can see where they are trying to take money, i now have no monies being put into my account(using post office card account now) to anyone else who might find it useful when banks are not, it is a premium rate number but from what i can gather they will remove any cpa's you have on your account hassle free! 0870 0104503 option 2 then option 1

 

i also still need help with wonga and making payment plan, i dont know what i can afford i am in severe hardship the only money i have coming in now is £70 a week and that doesnt do alot when i am tryin to pay for food bills and utilities too, might take 6 weeks to hear of anything with new claim :(

wonga'd thanks for updating. This is a positive step forward. Righto.. you can either contact National Debtline and ask them to help you produce a Common Financial Statement (budget statement/Income & Expenditure form) , or you can complete the one below :)

 

We have a stack of letters that you can use as the basis for asking for some forbearance from your creditors if you are in severe financial hardship. I will go and find one that will suit your circumstances.

I attach a Personal Budget sheet which shows my total income from all sources, and my outgoings. As you can see I only have £xx.xx per month left for my creditors. The offers I have made to my creditors have been calculated on a pro-rata basis, and I have written to all my creditors asking them to accept reduced payments.

 

In view of these circumstances, please would you agree to accept a reduced offer of £xx.xx per month. If interest or other charges are being added to the account I would be grateful if you would freeze these so that all payments made will reduce what I owe.

 

Should my circumstances improve I will contact you again. In the meantime, I would appreciate it if you could send me a paying-in book / standing order form to make it easier to pay you.

If you are only able to offer them £1.00 a month, then that is all you should offer.

 

What other type of debt do you have.. loans/credit cards/ hire purchase ?

Dont use the 0870 number. Try 01604 252999 for fraud services, 01604 230230 BARCLAYS LOST OR STOLEN CARD HELP LINE. 024 7684 2099 Telephone banking 01928 584413 This is the same as calling 08700104503 (debit card operations and pressing option #3)

If you reach an operator, get them to transfer you. It should cost the same as a local rate call, as they are forwarding you through their own switchboards.

what am i to do? i only have £70 a week comin in which leaves me looking like this

 

tv license £3.50 a week

water rates £8 a week

fines £5 a week have no control taken straight from benefits

hmrc debt £10 a week have no control taken straight from benefits

electriciy £10 a week

gas £10 a week

 

£46.50 in bills and £23.50 a week to buy food and pay wonga, what do i do in this letter please help? :(

Have you cancelled any CPAs you had with the bank.

You seemed to be having difficulty with this.

And secured your bank account.

wonga sent me a message saying that the bank refused and my balance of account is not in the red plus i sent email asking wonga to stop cpa too! looking at my incoming and going bills what would you ask to repay wonga a month?

I see you are now using a Post Office Card Account,i will just check what they do.

Your bank can not refuse the request to cancel your CPA

Someone is having you on.

In your present circumstances i would be offering a token payment or sending the hardship letter

Maybe even ask them to write it off.

 

Were you in work when you took the loan,

This may change our way of tackling the problem

Try for misselling perhaps.

If you were out of work at the time.

 

23.50 for food and wonga.

I feel even a token payment for you is to much.

Have a look in the CAB link i sent,maybe it would be best to contact them about this.

I could find you a token payment letter for you and a write it off letter.

I suppose your circumstances are not going to change for some time.

I see you are on tax credits.

This is the child tax credit that everyone gets i suppose.

About 50 is it.

And child benefit perhaps 20
