My 'umble apologies, Emma !! As you'll have "been told" - there are worse versions of the term than mine, too !! :o

 

BTW - I like your little dig about their "green" front. I believe that's where the abbreviative word "bumf" comes from (often mis-spelt "Bumph" or even "Gumph"). I expect the Guvnor, BankFodder - BF - will confirm this. I haven't checked Wikipedia - must do.

 

Anyway, what's a laydee doin' up at this time of night ?

Until everyone is in bed there isn't a hope in hell of me getting anywhere near the computer. Add in a touch of insomnia... and the fact taking on the banks is the most fun I've had in years, and there's the reason for my nocturnal habits!

OK my LBA went in the post this morning, how ling do i need to leave it before i hear anything?

Only the recipient can answer those questions, BL. My guess is:-

 

Answer a: until the twelfth of Never

 

Answer b: I doubt it

 

However, you need to give them 14 days (plus a bit) before YOU do anything. You then file the claim, unless, of course, they actually pay up fully !

 

We can dream, though !!

In response to my LBA, i got a letter back during the week and it said

 

"I regret that you did not receive the correspondance that was originally sent to you. I have enclosed a copy of the letter we sent regarding the above account"

 

Should i send another LBA again to Mrs Mazzotta as there seems to be soe confusion going on here, or is it a stalling tactic?

What did it say in this letter? Did they offer you a full settlement? If not, your LBA stands and then you file a claim.

It said exactly what i quoted. this is where i'm getting confused, are they stalling or have they just not seen my original letter of asking for it back

I meant the letter that they enclosed with that one, the one you didn't receive, which they say caused you to send them the LBA!

 

If it's anything other than a full settlement offer, just carry on, they are stalling.

the one that they say i didn't receive, I DID receive. so I should just press on with the next stage.

Big Lad, we need to know what it said in THEIR letter !!

 

If it acknowledges receipt of your prelim, then go ahead as Mum says. Otherwise, if you did not send your prelim by recorded delivery, you might do better to send another LBA (by recorded). This first LBA will then act as your prelim.

I then sent my LBA with spreadsheet again and from this i got a letter back (post #31) saying they never received my initial correspondance - my LBA i presume - along with a second copy of the letter i typed up in post #22.

 

My LBA was sent recorded delivery...

 

Hopefully that clears things up :D:confused:

Almost. I take it you mean your prelim in red above, not your LBA.

 

But, yes, as Mum says. Ignore it and carry on regardless.

You probably will have to file with Moneyclaim. That is the next stage to make them realise you are seriuos about your claim. They usually acknowledge the claim, then maybe file a defence before they pay out.

Frustrating i know. Most banks are going down this route.

Can i address any future correspondance to the point of contact on the bottom of my Nationwide letters, or is it better to address it to the section they work for?

 

I'm assuming that Miss X in this case would be the best person to reply to directly as they are dealing with my account.

Ok i sent a second LBA letter two weeks ago as i think there might have been some confusion between myself and Nationwide and it was just to satisfy my mind

 

anyway, i'm going to start a small claims procedure against them as its been over two weeks again.

 

I take www.moneyclaim.gov.uk is the best option to take?

Can anyone explain to me briefly what the process is for the MCOL?

 

What i'm getting confused about is the process. after i've filled in the details fo the claim, does the MCOL site send the letter on my behalf to Nationwide in which case how do i send my spreadsheet or do i print it off and send my spreadsheet myself.

 

If it is me that sends it, i take it i'll be sending it to the address below

This response is only what I have read and understand. As yet I have yet to start my claim so wait for someone to confirm please.

 

As I am aware the courts issue claim to bank for them to acknolwedge. If they decide to defend then you then complete an allocation questionaire sent by the courts. You will then include your spreadsheet which you send to bank and court and keep copy for yourself.

I'm afraid I do not use MCOL, so I cannot speak from experience, but provided you have sent in your prelim and LBA letters first, then you claim through MCOL. There is no need to do any more until you hear from them, in the same way that you would no longer deal with the bank directly after you had submitted a claim to the County Court. There is, I believe, online help from MCOL, so I'd suggest having a look in there.

Ok i've submitted a claim through MCOL and waiting for my 'claim pack' to come through the post.

 

In the meantime i take it i need to prepare a letter and a copy of my charges ready to submit to Nationwide? Is this the case?
