hi I'm new to this forum, j

ust trying to get a grip on this company etc. as have had all the letters and ignored and

 

now have the county court claim form from Northampton county court Bulk centre has arrived!

 

the costs have changed over the past 6 months of letters from the first,

then going up with the debt recovery and back down to original after

and now up again with court fees and solicitors fees on this court claim form,

 

the registered keeper was out of area with HM servicing forces,

but the incident was in England and keeper resides in Scotland????

 

do we continue to ignore until court summons arrives or do we respond to this letter?

 

any advice greatly appreciated.

 

P.s my letter dated 8th July as CookieRocks has scanned letter it could be mine as the same.?

Date of Issue - 8th July + 5 days for service = 13 July + 14 days for service = 27 July + 14 days to submit a defence = 10 August 2013 smile.png

Thank you citizen B for your link I had missed this one,

 

I have a friend who works for one of these private companies

and they said that they will resort to anything to get you to pay

and by filling in or contacting your giving them reason to pursue,

as its a parking charge not a fine (only council and police can fine) it would not be upheld in court??

 

and I've read your info but as I live in Scotland and laws are different would this make a difference??

 

the form that appears to be the same one everyone gets doesn't have a proper stamp on it

just a printed off the computer version and

 

why would they require information such as date of birth etc??:madgrin:

 

I'm sure you have lots of these and thank you for your patience.

what about defending all

 

that would get it transferred to YOUR local court.

 

I've known of three [but not of recent]

 

that were dropped as soon as that was realised it was Scottish court now as you've defended.

I have a sneaking suspicion that geography is not one of PE's strong points especially as POFA does not apply in Scotland. Might interest Crocdoc though.

I haven't seen this for some time , However you must first of all object to the Jurisdiction of the court and at the same time lodge brief details of defence

I will come back to you in more detail a bit later.

 

CLEARLY A NEW TACTIC FROM PARKING EYE .

 

Can you provide some detail how you obtained this charge and I wil write something up.

 

Can you scan up what you have received as I am reading into this at the moment,

I am also waiting on a call back from Nothampton County Court,

If they are sending out dummies we could complain to the OFT and the Land owners.

 

I have just received a call from NCP stating that if the defender lives in Scotland

the claim will automatically be struck out as the court does not have jurisdiction.

 

For your own peace of mind call 01609 619 402

press option six

an simply ask what will happen to the claim if the defender lives in Scotland.

 

 

Provide the court ref from the paperwork PE have sent

and confirm that it will be struck out,

that way you will know if they have actually lodged or if they are bluffing.

 

They either require Geography lessons or they are using a scare tactic to try and extract money.

 

 

Nevertheless please scan up the documents , this way all correspondence can be compiled and complaints lodged as need be.

I think we should keep an eye on this one as I sincerely hope that that PPc's do not use or abuse the clearing system at Northampton

simpy as a means of frightening Scottish vehicle/owners into paying.

 

 

Particularly as the BPA has issued the following statement to a Scottish Local authority regarding liabilty for payment (If indeed any exists)

 

You are absolutely correct in that contract law makes it unlawful for the private parking operator to pursue the Registered Keeper of the vehicle

– it is a fundamental of contract law that a contract is formed between person A and person B (the operator and the driver)

and with a few exceptions (the law of agency being one),

person C (the keeper) has no part in the formation of that contract and so cannot be held liable.

that's pretty speedy work croc-doc, thank you for advice.:-D

 

I do however have no idea how to scan up docs is there any way to private message

or e-mail the docs as that I might be able to manage?

 

I called the number for CCBC Northampton and had a very rude lady called Jill speak to me

and I told her the defendant lived in Scotland

 

 

she discussed claim with me (no confidentiality as I'm not the registered keeper he is currently away serving HM Forces)

and I'm heavily pregnant and she referred to it at as parking fine

I corrected her saying parking charge notice and she said she didn't see what the fine had to do with being pregnant

, I expressed it's undue stress I could do with out!

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

but leave all monetary figures and dates.

This one is to say the least extremely interesting and please keep us updated, in the interim period

 

 

during the course of the next few weeks arrangements are now in place to target private parking companies

such as Parking Eye who may or not be using online court forms from Northampton County Court as a means of trying to enforce their highly questionable charges.

 

The plan

Over an unspecified period of time 4 Scottish registered vehicles (already arranged ) will enter premises where parking is supposedly controlled by BPA members in England or Wales .

 

1) Vehicle one will leave after a short overstay of X.

2) Vehicle two will overstay for a period of xxx.

3) Vehicle three will enter the premises, leave and return in compliance with the terms and conditions to test the accuracy of ANPR

4) Vehicle four will overstay for as long as they wish as the vehicle is registered in Scotland but driven by a none English Speaker who does not understand the small print as prescribed by the BPA.

 

All parties will ignore the begging letters and wait for the outcome.

Life has once again become interesting, it's not that long ago that I spent my time yawning through Parking Eye's Norwich Pharmacal Order letters. It just goes to show that every day's a learning day, until I read further into it I thought that an NPO was a recipe for homemade viagra.

hi dx I have just scanned and removed in paint the personal info but left car park details is that ok or should they come out too I have removed some of the bar code parts but not in full, just so codes can be compared to see if they are duplicated? is there anything little I may have missed on form??

since when did the registered keeper become liable for any money owed under the freedoms act from a contract entered into by a different driver to a private company
