    • It's a big shame that you didn't wait for us to give you the advice that you asked for yesterday. We responded within two hours and if you had checked back you would have found the proper way to deal with it and also to get your money back. You would have in any case have purchased a new laptop straightaway that you would have obtained your money back as well. By taking this action without make any conditional or proviso to the manager you may have compromised your chances. You may still be able to deal with it by sending them a letter if you want. You will have to act quickly as you have already put things in motion. It's up to you but if you want to deal with this then you better start reacting quickly and waiting for the advice that we give instead of rushing off on your own  
    • No I paid for it in full.   So, in short.    The laptop was bought new 2 months ago to take my Biomed year end exam, on 26th July.   It was also bought to have word for my dissertation.     The month to repair is the issue - I need a working laptop now for revision and exam in 12 days.    I did not think for one moment that it would expire at 2 months old - a terrible situation for a new one. I've been there this morning - they have taken the non working one to send off for 'repair'.  I've informed them that if it doesn't work or goes wrong again I want a full refund.  My only option today given the exam date was to buy another, I do not have the time to sit and wait sadly for a repair taking a month.  That was the issue - I did ask if they would honour £299 as paid before - they wouldn't.    I have paid £359 less 10%  - £323.10 that is all the Manager would do. Absolutely in future - will shop elsewhere.

They want us to accept a type of marble we didn't want in the first place and still don't want now, and they are not saying that they will make good any damage that may be done in the process We don't want this work done, we want them to leave the kitchen as it is and give us some compensation My wife and I are both in our 70's, I am disabled and we are both on heart medication, we don't want the stress and disruption again The ombudsman says we must allow Wickes to try again Advice please, is there any point in going to the small claims court?  Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I'll keep this as short as possible

 

I recently moved into a new house, it's got quite a big garden and part of it is on a slope. I decided it would be best to go for a "better" make and spend a bit more than I would normally have to get a lawnmower that was capable and going to last.

 

I went in to a local specialist supplier and told him the story and they suggested a Honda one at £600, somewhat reluctantly I did buy it.

 

Moving on a couple of months I noticed when cutting on the slope it was leaking fuel, so I called the supplier up and they said after hearing the fault to bring it in. After a week I collected it being told it had been repaired, but the job card was not available to say what had been done.

 

First cut, still leaking... called the next day, spoke to someone else, first question he asked was how steep is the slope, I gave him a guess and he instantly said, thats the problem, too steep. At this point I was fairly annoyed, said I had told them it was for cutting a slope when I bought it, again when I reported the fault and no one had ever asked how steep the slope was. He immediately got defensive and said he was putting the phone down because I was "just trying to blame them"

 

The one thing that I did read again were the instructions, and in very small print on the last english page is a one line that says to the effect do not cut on slopes more than 20Deg. I agree I should have read this before using it, but after being specific with the shop I unfortunately presumed they would know what they were talking about.

 

So the question is, I have spent £600 on a lawnmower that cannot do what I specified it should (verbally) do I have any recourse?

Soga. They must repair replace or regund. Put everything in writing and stay off the phone

Agree, not fit for purpose; get a refund or replacement.

They should of asked you what degree of slope you intended using it on, they are the experts; then you could of told them.

check your lawn slope, so you don't get caught out again.

Just want to confirm as I said it does list the slope in the small print so the machine is fit for that purpose, is it the advice given by the shop that is at fault? Or can I just say it's not fit for purpose

If they sold it you and it doesnt work properly, they are at fault. You say its fit for purpose, yet is broken. Therefore you have a valid claim under SOGA.

You told them of your requirements and they offered you this lawnmower as being suitable. It is clearly not fit for purpose, even though it works fine on the flat.

They should offer you one that does work in your garden and a refund of any excess payment, not a credit note.
