Hi, this thread is to deal with the Abbey Credit Card which is part of my bigger debt problem found here, it explains how I got in this position and the overall debt mountain involved:

I sent a CCA request to Arden on the 16th June and have heard nothing from them. Then I have received the other letter from Earlswood. I did send it recorded delivery but cannot find the slip with the tracking number, I have a stack of others! Any suggestions? Do I send the CCA again?

Might be better to PDF the files next time

 

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

if you have multiple scans/pics

put them in a word doc FIRST and convert that to PDF

or use www.pdfmerge.com

 

convert existing PC files to PDF [office has an installable print to PDF option]

..

 

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice dd-mm-yyyy TSB

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

.

they are both using the word 'instructed.

which means little.

 

what is the debt all about

is it on your CRA file?

The card is pre 2007 and I stopped paying about 3 years ago, then went onto a DMP. Stopped the DMP in December last year and they have been obviously hassling me since. I have CCA'ed them but herd nothing. It is on my CRA file but when I last checked it was listed with Moorgate.

god not heard of them for a while.

 

ruddy fleecers they were.

my neighbour had used them

 

most DMC's never ever check the legality of debts

 

many are 'in bed' or owned by ex employees of DCA's anyhow.

 

if they've exceeded the 12+2 working days CCA time limit

I haven't paid them anything since December. If I don't hear anything next week I will send it thanks.

 

Thats the trouble with the DMP people, no help at all apart from they keep the wolves at bay!

Been away and come back to a money claim form from Northampton County Court with Earlswood as the claimant on behalf of Britannica. They never responded to the CCA request on the 16th June. Shall I upload the court papers for someone to look at? It was issued n the 23rd July so I need to respond shortly.

I think you have 5 days for service and 14days. So I make that 10th August.

Hopefully someone will confirm if I'm right.

 

Anyway, do it online now, only take you 5 mins including registering.

 

Get it done, don't put it off.

The date of issue of the claim was 23rd July so your timeline is..

 

Date of issue 23 July = 5 days for service = 28 July + 14 days to acknowledge = 11 August + 14 days to submit defence = 25 August :)

Did you ever receive a default notice from MBNA (the original creditor) - although if I understand correctly, you had been making payments via a DMP to the new owner of the account.

 

Do you know if there were any default/penalty charges added to the account ?
