    • Different statements. One has “at 59 mph overtaking on the approach” and the other “it was overtaking on the approach and in ....... at 49 mph”. So not the same statement (same ethos, different sentence structure).   perhaps they chose that site for the officer because it is an accident hotspot, and they know people do dodgy overtakes (while speeding) there .....??

    • So a little update;   Of the 6 letters I sent 3 were acknowledged. One accepting £1/month for now and two from the same creditor trading under different names asking for full I&E which I haven't done.   In a moment of madness I managed to depsoit 5k to a gambling site I didn't have due to paypal's crazy policy of allowing payments which are to be collected by direct debit after a couple of days to gambling sites! Mad they allow this but this will show as a negative paypal balance (in a different account to the original "debt"). The first paypal -£5k account has been closed and passed to a DCA now. I have ignored them.   My council has appeared to have stepped up their collection efforts for £2.5k in alleged housing benefit overpayment from 2015/16. I have acknowledged their letters over the past 3 years each time by email but they rarely respond to my pleas. I truly think if there was overpayment then it was for less than half the amount they claim. At the time I didn't think I was being overpaid because I wasn't really working but I had stopped claiming JSA/ESA (and told them as much) but earned a couple of hundred pounds a month from sporadic work.   Also what I thought was a dormant debt from 2016 to Halifax has been actually sold ( to caboot? I think. Hard to keep track of everyone)   I've been getting phone calls daily but ignoring them for the most part. I did request all communication in writing in my original letters.   I feel incapable of dealing with these creditors and whilst initially I was feeling that I would be happy to just ignore all the letters (arreas, defaults and the like) and phone calls for an indefinite amount of time and  hope to make it 6 years to statute barred-ness and accept or defend any CCJ attempts that did arrive. I figured that avoiding these creditors for 3 months so far is 5% of the way there to statute barred! But I figre for these fairly sizeable amounts they probably won't all let it go and I will get some CCJ docs (never had to deal with that) However now my mood and thinking has changed.    I am looking again at insolvency. I'm over the DRO limit now so its BR or nothing. I was wondering why you said to not consider this and it would be stupid @dx100uk? Although shirking my debts/responsibilities it does seem like an "easy" way out at the moment. It would be so nice to know that what's done is done and to be able to draw a line in the sand and start again in a year or so and not have to avoid creditors or worry about what's coming next...   It certainly would help the environment what with the amount of letters that are arriving already(!) considering the first payment I missed was october/november (excluding the old halifax and council debts). I am exordinately stressed about it now even though I thought I would be already . Any advice would be great if it was to get my head out of the sand and contact people/do the ignoring thing and seeing what happens/reasons  to do or not to do bankruptcy for these unsecured debts?   Thanks      
    • Hi everybody   Had a knock on my door and was confronted by either a Bailiff or enforcement agent (not sure about the specific job title). When I opened the door he stuck his foot in so I couldn't close the door. I was video taping him so I took a few steps backward (to get him in shot) and he just fully entered the property despite me saying that I was denying him entry and he refused to leave thereafter.   Turns out that he was there to collect a court issued fine. I think from a Magistrates Court. He worked for this outfit:   www.marstonholdings.co.uk   The reason for the fine was something to do with "driving without car insurance". Now I had a cheap car a few years ago but it broke down and would cost more to fix than it was actually worth. So I sold the car for scrap and cancelled the insurance. Turns out you have to inform the DVLA when you scrap a car and them that it is no longer on the road (I was unaware). So this was the circumstances of the visit.   My question is did he have the lawful right to enter the property? I always thought these people were like vampires i.e. they can only come in if you invite them in.   tia Bear

The original debt was with sky credit card which from the information on cca was supplyed by mounument

and in small print it says supplyed by barclaycard.

 

I dont know if they put chsrges on but capquest deffo have.

 

I wss originally paying them through payplan.

 

Then lost job so paid them pound a month and for bout last year a fiver a month

but balance has gone up by bout £500 ,

but cant be sure as paper work got damaged.

 

Will have look though tom see if any else where in house.

crapest will always inflate a credit card debt with interest

they claim they can

because it was on the org agreement.

 

pers i'd sar monument or even bc themselves

 

I bet these payments you were making never went off the debt to them

just directly to the dca profit pocket

to enable them to send another 1000'000 fleecing letters

to others that have no idea if they actually LEGALLY owe them any money at all.

 

per i'd stop paying them and force their hand

it cant harm you.

 

they'll know your new address from the cca request

how do i find out who actually legally owns the debt?

 

would this not be easier than having to send several sars.

 

was that stuff wrote earlier about no court action within 6 years not true?

Been over week since sent SARS and 20 days since payment was due to capquest and been inundated with mobile phone calls and home number. would like to know how they got land line as ex-directory. Have just ignored there calls so far. Strange had not letters usually daily when I was later before. will post update when I receive SARS back .

SAR time scale is 40 calendar days.

 

All ex directory means is that it is not shown in the BT phone book, any time you have given the number to any sort of business, it's likely to be passed on to other companies and organisations.

Hi finally received SARS back from Barclays.

 

just a big pile of computer print outs

 

. Didn't see anything on there about bank charges only thing I could make head or tails of was.

 

sold via Kirkby debt sale

a dmi was placed

it was too old- unenforceable

unenforceable - no historics orc/offs- sold

the currant balance obtained from capquest

letter 67 + docs sent to ch via capquest

 

all the other information in over 300 pages is some sort code regarding the account I can't fathom it.

 

Any Ideas?

 

do I now SAR capquest they keep phoning but still not one letter,

use to be loads of letters when I missed payment previously.

 

Still not paid anything more.

 

Whats my next move?

like I said it just one big long computer print out with lots of abbreviations and number codes relating to account status and updates no statement or anything I cannot make head nor tall of it apart from the extract listed. there is no key code or anything to explain what numbers or abbreviations mean.

Trouble is that the SAR is a request for your DATA but there is no requirement that the bank supplies the data in any specific form.

 

Having said that, if they use codes, they should supply you with a Key for you to work with. Perhaps a visit to the branch so the staff there could enlighten you.

 

Also, go through the data carefully and see if you can find any recurring charges of £20 or £12 when you recall the a/c was Out of Order but before it was Defaulted or sold.

Will gi through again tom. Might also sar capquest as i think they have added loads of charges on. Still think it strange not had any threatining letters from them.

Ooh Yess !!

 

If Capquest have added any of their own penalty charges, make sure you reclaim them in full, maybe also compound interest on top.

 

That's what you can do with all BC's penalty charges.

Sorry not updated in a while had a terrible time recently.

 

I went through all of the print out and cant find any charges on there to reclaim. only useful thing was about the debt being sold to cap quest.

 

Was going to SAR them to see what charges they have added, the phone calls stopped then out of the blue I received a letter from capquest saying they were passing debt on to Debt managers (services) LTD as they had failed to contact me despite loads of attemps.

 

I then got a letter yesterday from said company stating the account has been refereed to themselves for immediate collection, with a new balance of £4369.07 over a grand more than capquest were wanting.

I have not paid capquest since I sent the sars.

 

My questions are

1. who do I sar now or do I force new company to prove they are legally entitled to the debt?

 

2. Should I just accept they want all the money and I am just going to have to pay them over a long period of time or should I negotiate a final figure over a set number of years?

 

3. If I do sar one of them how do I go about having the charges removed?

 

Sorry again for the delay in updating I recently lost my job and had to start working for an agency been a bit hectic.:roll:

Hi Toonlee,

 

If you think Capquest added any charges to the a/c, you should send them a SAR with the £10 fee.

 

You need to try and reconcile the debt amount with the payments that you know you've made, to ensure all the pay'ts have been credited to reduce the balance.

 

On the last page, you said a copy of the credit agreement has already been supplied to you, so asking the new debt owner for it is probably a waste of the £1 CCA Request fee.
