    • Absolutely normal.  They do their best to waste your time and also the time of the courts. It doesn't cost them anything.  It costs you and it costs the taxpayer so what do they care?   These are all the reasons why you should not agree to mediation but insist on going to trial.  They will continue to waste your time right off until the trial date and then probably make you an offer.  At least then it won't be in confidence and you can tell them to go and do one if they don't offer you 100% of what you are claiming

    • Just an update, finance company rejected my complaint saying they've found damage but can't tell when it's from even though I've shown them how the front end is misaligned in the advert photos compared to another identical model car they're selling.  Dealership now want to charge me to get the car brought back to me but will only discuss over the phone which seems off. They're also saying no damaged was picked up by JLR main dealership before I purchased it but my local JLR dealerships till this day haven't mentioned the damage to me because they don't go into stuff like that for some reason lol  Ombudsman case is still open, not sure if I should leave the car with them or just pay to have it brought back.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

This Has been mentioned a few times on the forum.

 

The question that is being asked is that when you access your credit file for what ever reason, if the CRA have a marker against your name on behalf of a DCA , do they tip off any debt collection agencies? I have longed believe the credit agencies offer a subscription service to the DCA industry

 

Now i have not had any credit in any form since 2008. I have learned to live without it and all my past transgressions have long since become statute barred.

 

Six months ago i transferred my broadband and phone to sky, three weeks ago i transferred back to BT.

 

BT had to do another credit check on me they said it was to make sure i did not owe BT anything. Passed credit check and phone and broadband up and running yesterday.

 

Today i receive a phishing from our old friends LLOWELL

I can accept that but i have been at my current abode for the last three years, pay council tax and on the electoral register

 

What surprises me is that why are LLowell sending me an email, do they not have my address? that's what the electoral roll is used for

I'm pretty sure data would be shared every time a new application is made - regardless of whether someone has moved or not.

Barclay's updated my old address to my new address with the credit agencies when i informed them i had moved

 

Why are llowell emailing me and not destroying a rain Forrest threatening hang,draw, and quarter for non compliance. "baffled"

Well i had a letter from Lowell today, not the usual threats of hang draw and quarter. I must say , they were quite persistent in trying to get any phone number off me, they gave up in the end.

 

It seems this is all over a bill to three mobile from 2008. We all know about Lowell and three. I have demanded all paperwork etc (I doubt any exists) They tried to palm me off with getting the last statement, not interested, and all correspondents from now on in writing

 

Seems i am going to be having some fun, not done any DCA bashing in three years

 

I have never had a three mobile account:mad2:

Just bumping this up asking if anyone else have had this with a three debt and Lowell recently

 

A few years ago they were chasing quite a few people for fictitious Three debts, watchdog ran one of the stories i believe
