Should I still ask for the CCA or just send them the letters and spreadsheets while trying not to laugh?

I have all the paperwork for this and there is no CCA or PPI agreement in existence. They can create what they want but I know there is nothing signed 🙃

Thanks for your help, it is, as always, much appreciated

Hi

Does this sound okay:

I do not acknowledge any debt that might exist to you or any of your group of companies

Dear XXX

Re: Lowell Reference Number xxxxxxxxxxx

I am in receipt of your letter dated the 4th February 2016 with regard to the above.

The content of which is duly noted.

The above amount balance entirely consists of Unlawful penalty charges, unknown and unwanted PPI and their associated interest.

I enclose relevant spreadsheets for further clarification regarding this.

I will therefore will not be contacting you to arrange any payments.

Should you wish to progress this further, I politely suggest you approach the original creditor

should you progress this toward a court claim, I shall vigorously defend the claim with regard to the above.

Yours sincerely

Thank you for your recent correspondence.

We understand that you dispute the balance and believe that the interest charges applied by JD Williams are unjust.

However, we must advise that upon signing your contract with JD Williams, you consequently agree to the Terms and Conditions of the account wherein it states that customers must maintain regular, minimum payments in order to avoid charges.

In the event that the customer does not pay the minimum amount required by JD Williams, interest is applied. No further interest or charges will be applied to this debt while it remains in our possession, unless the matter escalates to litigation.

We would like to advise you that any claim, dispute or complaint in relation [to] Payment Protection Insurance (PPI) needs to be queried with the original creditor JD Williams.

Should you wish to settle this account in a one-off payment, we are able to offer a 15% discount on the outstanding balance, enabling you to clear this debt with a payment of £836.54. If you do not wish to take advantage of this offer, please provide us with your own offer of settlement for our review.

Alternatively, please contact one of our experienced advisors on xxxx xxx xxxx to organise a weekly, fortnightly or monthly repayment plan on this debt. Please note that the offer of discount will not apply if you establish an instalment arrangement on this account.

We trust this now resolves your query and look forward to hearing from you to discuss repayment.

We will cease any collections activity for a period of 30 days to receive your response and provide time for you to contact JD Williams regarding your PPI claim. Please respond within the timeframe provided to avoid any additional collections activity taking place.

We hope this clarifies the situation and look forward to hearing from you.

offering a discount to get 'something' out of you...

speaks volumes upon how confident they feel a court would uphold any claim they made.

I said that to mum.

Do I need to respond or just ignore them?

Also, if JDW sold the debt to L, why should I go back to them about anything??? 🤔

Hi Dx, thank you. So should I rattle JDW's cage again or just go radio silent completely?

If i am right this is a jdw account then this is how you deal with lowell.

1. Forget what has happenned so far and send lowell am cca request. Trust me this works.

2. Send it to them without paying any postage on the envelope. (if you send recorded delivery they take notice and check your file)

3. Wait for the cheque/po to clear and also await their letter confirming they are dealing with the cca request.

Once you have this back sit back and wait. When you do get a reply back update this thread or message me. I will come back and give you further guidelines. Note this is not away to avoid your debts but if lowell will not budge then this is the route you take.

So whats cooking today ?

They have sent a threatogram today stating that,

as they cannot contact us,

they will be sending the account to their collections department

or one of their approved debt collection agencies

who will be instructed to contact us to discuss the debt

and seek to recover the outstanding balance through the appropriate means.

.. and that they can offer a 30% discount if we contact them...

Just ignore it. Youve already got confirmation that they are extremely unlikely to go to court.
