is this was taken out post apr 2007

so sadly, under the recon rules

they can magic up any old rubbish as such

I have all the paperwork for this and there is no CCA or PPI agreement in existence. They can create what they want but I know there is nothing signed 🙃

PPP is PPI as your list shows

 

 

its post apr 2007 so don't need a signed agreement.

 

 

however safe to ignore or send the stuff as advised

I am in receipt of your letter dated the 4th February 2016 with regard to the above.

The content of which is duly noted.

 

The above amount balance entirely consists of Unlawful penalty charges, unknown and unwanted PPI and their associated interest.

I enclose relevant spreadsheets for further clarification regarding this.

 

 

I will therefore will not be contacting you to arrange any payments.

 

 

Should you wish to progress this further, I politely suggest you approach the original creditor

 

 

should you progress this toward a court claim, I shall vigorously defend the claim with regard to the above.

the charges/PPI are always against the OC not the buyer

 

 

pers i'd ignore lowells

until/unless they are brave enough to issue a claimform now

They started calling again today... they are blocked but for some reason the number does show up on the hall phone even though it doesn't ring 😏

If i am right this is a jdw account then this is how you deal with lowell.

 

1. Forget what has happenned so far and send lowell am cca request. Trust me this works.

2. Send it to them without paying any postage on the envelope. (if you send recorded delivery they take notice and check your file)

3. Wait for the cheque/po to clear and also await their letter confirming they are dealing with the cca request.

 

Once you have this back sit back and wait. When you do get a reply back update this thread or message me. I will come back and give you further guidelines. Note this is not away to avoid your debts but if lowell will not budge then this is the route you take.

So whats cooking today ?

They have sent a threatogram today stating that,

as they cannot contact us,

they will be sending the account to their collections department

or one of their approved debt collection agencies

who will be instructed to contact us to discuss the debt

and seek to recover the outstanding balance through the appropriate means.

 

 

.. and that they can offer a 30% discount if we contact them... ��

Just ignore it. Youve already got confirmation that they are extremely unlikely to go to court.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

We did... today they offered us a discount... we only have to pay £500 odd to make it go away 😂😂😂
