in brief,

cancelled insurance policy with one call at end of cover,

re-insured with another company but one call took another payment,c

complained and they refunded it back to me.

 

I also asked them to send me a letter saying that no monies is owed to them, which they did.

 

now getting letters from judgement order listings saying I have an outstanding balance for the same amount they refunded to me.

 

now do I ask judgement order to take me to court for this amount ! then pull the letter out of the hat.

 

then bang in the costs/exspences for my day out,

 

also they say they have put on my credit file that they are chasing this alleged debt from me,

as this is incorrect can I sue them for the deformation of my credit file.

 

this was over a year ago that this acc was terminated.

I would suggest a formal written complaint to One Call Insurance about this, asking for compensation for their error. Tell them that you will ask the FOS to look into this, if they do not provide an adequate response.

 

Is this debt actually on your credit record ? If it is showing then ask for more compensation and that you will also make a complaint to the ICO in addition to the FOS.

 

Just my personal opinion, but I would think £50 comp if no entry on credit record and £100 compo if on credit record. Then more if the credit record entry has actually affected you in any way.

I doubt they have put nor can put

anything on your CRA file.

 

its just willy waving.

 

get the cra file

 

I bet its clean.

 

unless you took out 'finance' to spread the cost of the call one insurance over XX mts

and signed an agreement

 

it wont show on your CRa file anyway.

I'm sure they think they are clever, but they actually aaren't clever at all; the OFT says that a licenced DCA shouldn't use a name that implies any sort of official status. Worth a complaint, I'd say.

just received this!

 

this is your third and final communication to you before serious action is taken.

 

then they say!

 

we have now requested your employment details from your insurance broker to determine whether you are in full employment.

 

we are preparing legal documents and need this information to ascertain whether we can use this channel as a method to clear your outstanding debts.

 

if not paid in full we will issue a county court summons against you for the full outstanding balance with additional interest and solicitors fees.

 

not really concerned about this its quite amusing really,

wanted to share it with all other caggers as to all the huffs and puffs from these leaches

 

aint they gonna be in for a shock when the judge sees the letter from one call confirming that I owe nowt at all.

Are you able to scan in and post up that letter for us to see - minus any personal details of course. Follow the instructions below for converting to pdf..

 

 

 

Dx100 – Instructions on uploading pdfs

 

Scan the required letters/agreements/sheets

as a picture file

remove all personal info including barcodes etc. using paint

but leave all figures and dates.

Go to one of the many free online pdf converter websites

convert the image to pdf format.

or if you have PDF as an installed printer drive use that

open a new message box here

hit go advanced below the message box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

NB: you can set where it goes in the post by hitting insert inline.

Then hit reply button

They cannot use your occupation details from your Insurance proposal as this relates to risk calculations only. They are using this as a form of intimidation and might as well say we know where you live and have your car registration to hunt you down to make you pay. It is silly and is against OFT rules, plus against Data Protection in my opinion, as it is a misuse of data.

You really need to copy the letter and make complaints to Information Commissioner, OFT and the Financial Ombudsman. If as that other website claims that there is no registered office address on either their Letter heading or their website then you need to copy the letter to Companies House.

You really need to copy the letter and make complaints to Information Commissioner, OFT and the Financial Ombudsman. If as that other website claims that there is no registered office address on either their Letter heading or their website then you need to copy the letter to Companies House.
any one got the addresses for the relevant governing bodies as in post and I can get them off today,cheers.

I have these cretins on my back about a cancellation fee.

 

One call treated me appallingly and I feel are now trying to fleece me.

 

I took out the policy and they knew I just moved, my partners driving licence and mine were at the DVLA having the address changed.

 

They cancelled our policy because we couldn't get photo copies of our licences to them in 14 days (over xmas period).

 

We agreed a £30 admin fee as it was in the 14 days cooling off.

 

They upped it to £56 and now it is £126.

 

I paid the agreed £30 and send the rest return to sender.

 

I had all that employment rubbish in a letter,

I filled that one in the round chrome cylinder file in the kitchen.

the original alleged debt is £56 and some pennies NOW the debt is quoted as over £100 with their add on charges.

 

well well well,they don't give up do they!

just got another letter today stating that this a court action notification,and the outstanding balance is over £200 now.

and court action will add additional cost's! I wonder how much??.

please return this standing order form to them within the next ten days,but the letter shows that the first payment due on standing order is on a date in December 2013 ???. L.O.L

at least if I pay them on standing order" NOT" there is no interest on the monthly payments.

WONGA eat your heart out, NOW that's free credit!.

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

BUT......

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

Why have you not started a complaint with the FOS. You do this tomorrow and this should put a stop to this nonsense.

That's the most unprofessional letter I've ever seen. And, it looks as if they are not complying with UK law in many regards.

 

I'm fairly sure under both the Companies Act 2006 and the Business Names Act 1985 and under the requirements set out by companies house that their letters must include their place of registration, company registered number and their registered office address. I also note how they say that they will take "Legal Action", but how does this letter comply with the Practice Direction on Pre Action Conduct and the Civil Procedure Rules 1998? Are they the actual owners of the alleged debt (Otherwise they can not take legal action)? They do not have a website, and also a quick search on the OFT register brings up nothing for this company. Contact the Office of Fair Trading to ensure they are acting in accordance to the rules and regulations surrounding debt collection.

 

They look extremely unprofessional, I wouldn't pay them a penny personally.
