    • Hi Thankyou for your response    yes it is ! I sent of a SAR and within the comms Log Lloyds advised PRA  no CCA or paperwork available  .  hence account unenforceable.   The default is listed as PRA so does that mean it’s active ?  I can’t see a default for LLoyds on there.  I will follow your advice Thankyou 
    • i will guess this is:   a debt buyer dca cannot register a default notice    if the original creditor registered a default notice then get a copy of that  staple it to a letter to PRA and demand the account is removed from your credit file forthwith or a serious complaint will be registered with the ICO and financial compensation will be sought.   give them 14 days 
    • Good Evening,    Please may I ask for some information re default markers on Credit Report ?    I had a CC with a Bank default around Jan 2014. Nothing was registered on my Credit Report The debt was later sold on a few times. Eventually to PRA in 2017 where it is unenforceable.   On my Clearscore report that I have recently downloaded it says “ In default PRA GRoup 5th April 2017”. when I click onto this it shows no markings on any month from 2014. so my question is can PRA register the default from 2017. I’m unsure if it drops off from The bank in 2014 or after PRA registered in 2017.    thanks for any advice you can give   
    • there you go all done i thought i could see you'ed left your reg number and their PCN number in your pictures.   there are quite a few threads here on this only allowed 30mins on certain esso forecourts total rubbish ofcourse  and none haver gone anywhere so far FWIW.   dx      
    • Highly likely providing you were the first private buyer to purchase the car with HP or conditional sale outstanding the solicitors will conclude that you have good title and act accordingly  As dx says let consumer law deal with this, keep the vehicle well hidden just in case but if you turn up at the sellers work and cause problems and the Police become involved  its highly likely you will be the one with big problems

    • I came across this discussion recently and just wanted to give my experience of A Shade Greener that may help others regarding their boiler finance agreement.
       
      We had a 10yr  finance contract for a boiler fitted July 2015.
       
      After a summer of discontent with ASG I discovered that if you have paid HALF the agreement or more you can legally return the boiler to them at no cost to yourself. I've just returned mine the feeling is liberating.
       
      It all started mid summer during lockdown when they refused to service our boiler because we didn't have a loft ladder or flooring installed despite the fact AS installed the boiler. and had previosuly serviced it without issue for 4yrs. After consulting with an independent installer I was informed that if this was the case then ASG had breached building regulations,  this was duly reported to Gas Safe to investigate and even then ASG refused to accept blame and repeatedly said it was my problem. Anyway Gas Safe found them in breach of building regs and a compromise was reached.
       
      A month later and ASG attended to service our boiler but in the process left the boiler unusuable as it kept losing pressure not to mention they had damaged the filling loop in the process which they said was my responsibilty not theres and would charge me to repair, so generous of them! Soon after reporting the fault I got a letter stating it was time we arranged a powerflush on our heating system which they make you do after 5 years even though there's nothing in the contract that states this. Coincidence?
       
      After a few heated exchanges with ASG (pardon the pun) I decided to pull the plug and cancel our agreement.
       
      The boiler was removed and replaced by a reputable installer,  and the old boiler was returned to ASG thus ending our contract with them. What's mad is I saved in excess of £1000 in the long run and got a new boiler with a brand new 12yr warranty. 
       
      You only have to look at TrustPilot to get an idea of what this company is like.

    • Dazza a few months ago I discovered a good friend of mine who had ten debts with cards and catalogues which he was slavishly paying off at detriment to his own family quality of life, and I mean hardship, not just absence of second holidays or flat screen TV's.
       
      I wrote to all his creditors asking for supporting documents and not one could provide any material that would allow them to enforce the debt.
       
      As a result he stopped paying and they have been unable to do anything, one even admitted it was unenforceable.
       
      If circumstances have got to the point where you are finding it unmanageable you must ask yourself why you feel the need to pay.  I guarantee you that these companies have built bad debt into their business model and no one over there is losing any sleep over your debt to them!  They will see you as a victim and cash cow and they will be reluctant to discuss final offers, only ways to keep you paying with threats of court action or seizing your assets if you have any.
       
      They are not your friends and you owe them no loyalty or moral duty, that must remain only for yourself and your family.
       
      If it was me I would send them all a CCA request.   I would bet that not one will provide the correct response and you can quite legally stop paying them until such time as they do provide a response.   Even when they do you should check back here as they mostly send dodgy photo copies or generic rubbish that has no connection with your supposed debt.
       
      The money you are paying them should, as far as you are able, be put to a savings account for yourself and as a means of paying of one of these fleecers should they ever manage to get to to the point of a successful court judgement.  After six years they will not be able to start court action and that money will then become yours.
       
      They will of course pursue you for the funds and pass your file around various departments of their business and out to third parties.
       
      Your response is that you should treat it as a hobby.  I have numerous files of correspondence each faithfully organised showing the various letters from different DCA;s , solicitors etc with a mix of threats, inducements and offers.   It is like my stamp collection and I show it to anyone who is interested!

Hi guys,

 

I'm looking for a bit of help for myself with regards to a PPI claim against Santander/A&L.

 

I have a feeling I may be too late to deal with this but you never know.

 

I first launched a claim for this last year and received the ''get lost'' letter in August.

 

From the start I told them that the claim was for a card from A&L that was terminated around late 2004.

 

They then sent back the letter stating that I had nothing with them in the previous six years, something that I had already told them.

 

I then spoke to them and was informed that according to their ''C.U.G.'' system (I have no idea what that is), yes, I did have a card with them, and yes it did have PPI. She could also tell me that the card ran from October 1997 until November 2004.

 

The ''get lost'' letter was received August 14 2012.

 

Unfortunately, due to various other things going on at the time, I mislaid the letter and it wasn't dealt with the way I normally would.

 

Is there a next step for me, or should I just forget it, or should I SAR them?

 

I am aware of the six month time limit from the date of their letter.

 

Any advice/help/suggestions will be very gratefully accepted.

 

I do realise that I am probably too late, but you never know :)

The problems you have here are the expiration of the six month period to be able to refer to fos and also if the account was closed and paid off more than six years ago then they may have destroyed any meaning ful data on the account.

 

You say that you had various things going on at the time which prevented you from carrying on with this at the time. If you have exceptional circumstances then you may be able to persuade fos to take it on but you will need to get in touch with them and explain why you couldn't act sooner.

 

You could try a SAR and see what you get back from them in the way of meaningful data.

We were in the same position.

 

We knew that we had both a loan account and a credit card with Alliance & Leicester in the early to mid 90's,

but all we had was account numbers for both.

 

We sent a SAR request, but just got told that they were so old that they no longer held any information.

 

We decided to give up then, but

 

about 3 months later we got a letter from Santander saying

'We haven't heard from you regarding our offer'

 

As I hadn't received any offer I rang them up and they admitted that they had forgotten to send out the offer.

 

When I asked them how much they told me it was just under £1000.

 

I know that at one point we were paying through Baines & Ernst, so I have no idea how much we were paying in PPI.

It was a nice surprise just to get anything back when I was going to give up.

 

They are also now looking into the Credit card again.

We got a letter saying that as they held no information we would need to send them some statements, which we don't have.

 

Again I gave up, but had another letter a few days ago saying that they needed something to prove the account numbers.

That was sent off early this week.

If we get a bit more back it would be great.

 

We've literally had no paperwork at all, just the account numbers.

The thing is, it was them who gave me the details regarding the card. They could tell me when it was taken out, so they had that record back in August.

 

Re FOS, there was nothing major as such, just lots and lots of little things that took up a lot of time. I'm normally pretty much on the ball with stuff like this, but I missed this one :(

I have the card number for this, and supplied it to Santander. But I have no statements. As I said, they could tell me the details, so they must have them.

Hi IMS21,

 

All the other PPI claims I've had are all from around this period. All paid out, even another A&L one, but for some reason, they are not playing ball this time.

 

They know there is PPI on this account. They told me such over the phone. Yet I still receive the ''get lost'' letter :(

The passage of time from the refusal letter is the thing that is likely to make this more difficult that it would have been.

 

You might be lucky and get fos to look at it although you are over the six month referral time.

 

What were the reasons the lender gave for rejecting your claim on this one?

They said that I did not have an account with them in the previous six years. I had already told them that this account was ended around Nov 2004.

Yes that's what I meant earlier when I said that since the account was closed more than six years ago, they may well have destroyed the records of the account i.e. the statements/transaction history. However, their system may still retain data as to the start date and finish date of an account.

 

As I said, you can SAR them to see what comes back, you never know, there might be something useful in there.

 

While there is no time limit as such on PPI claims, it is the data which will enable a calculation to be done which is an issue here as well as being past the six month time limit for a referral to fos (although as I have said, give that a go because you might be lucky).

Ah, that would explain why they could still tell me there was an account.

 

I was under the assumption that if they could supply me with those details, then they could supply the lot.

Well I sent of the SAR letter and cheque two weeks ago, but the cheque still hasn't been cashed.

 

How long does it normally take for the cheque to reach my account??

Will be curious to see what they come up with now Ims, on one hand they were saying no PPI, yet they told me on the phone that, yes, it was there.

 

Will go through the SAR when I get it, then see where I go from there.
