Yesterday we got a letter from Phillips & Cohen with the news that CL Finance Limited has instructed them to deal with this account. Apparently they recieved a notofication that the client has sadly passed away yet she is still here with an actual heartbeat.

 

Furthermore she doesn't know anything about a loan she had with them or whatever name they used before.

 

Is there anything we can do about this because its rather appalling that you get these letters when the person in question did not pass away.

than the bailiff one

so they think she is obv someone else with the same name?

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

They've got previous form for this.

 

Try sending them a reply along these lines:

 

Dear Sirs

 

Thank you for your letter dated xxxx regarding (name of 'deceased')

 

It is, I understand, generally considered good practice amongst professional lawyers to wait until an individual has actually died before making a claim upon their estate. (name of 'deceased') is not only still alive, she has never had any dealings with (creditor) and consequently does not owe your clients any money.

 

I have never seen such incompetent and unprofessional behaviour from a firm of solicitors. Take notice that I will not dignify any further communication from you with a reply.

Not the same Phillips. This lot are bottom-feeding lawyers who specialise in trying to mislead the relatives of people who have died into paying debts that they are responsible for debts. Despicable.
