    • Well, it's isn't a premium car, it's a Golf TDI in pretty good condition with 100k on the clock. I just thought I'd ask the question, but I accept that there's probably nothing that can be done in this case. 
    • Change the rules now, and set a precedent for ever.
    • I think it is too difficult for any party leader to negotiate withdrawal from the EU on their own. It will always be a cross party task, unless there is a General Election and the country gave the the Tories a big majority. But at the moment that is very unlikely.
    • Can anyone help me. I am stuffed.    PayPal allowed me to deposit £4.4k into a gambling website when I had no cash in my bank.    It was the final straw and so I came clean with the wife and joined GA.    I didn't even think to search on the internet, despite how wrong Paypal's actions seemed to me.   This was a few weeks ago and I suffer with depression and anxiety, so all of this just crushed me.   I wake up every day and literally beat myself up.   After a lot of intervention and love I am able to lift my head out of the sand and address what has happened.    Here's the issue:  My wife was getting texts from Nationwide daily saying '£1,700 is due out of your account tomorrow' and so she found the money, and transferred it in.    We took on debt of £3k and Paypal have managed to get their hands on c£4k.    My Paypal balance is now -£420.   I initially posted this in the wrong place and dx kindly offered some advice.    yes I would get all the payments back from NW under chargeback and remove that account as a payment method to PP as well as you say via CPA..   I am not embarrassed to say that I don't understand how this works and the call to the bank is filling me with dread.    What do I need to say to the bank when requesting a charge back? Does this fall under unauthorised transactions?   PayPal aren't letting me remove the bank as a payment method atm.   Trying to not get my hopes up as this would be so huge for me and my family.    Truly grateful for any help.    Pierre

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.
      so far so good....

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.
      Please see the links below for summaries and full details from the FSA website.
      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.

Continuous Rollovers - Complaint to CCTA and FOS

I took out a small loan of £75 towards the end of December due at the end of the month. I rolled over that month paying £22.50. Every month since then it has rolled over without me asking and without them telling me.

 

In March I made a complaint via their online complaints page. A month later no reply. I called them and asked why it had rolled over so many times to be told "its in the T&C" and "we only take the full payment if you ask us"

 

OK........

 

So, waiting for the 8 weeks to be up from my initial complaint, I submitted my file to the CCTA and the Ombudsman.

 

I got an email from the CCTA yesterday asking me to call Paul at Cash Genie as he had been trying to contact me. Phoned them, Paul was on the phone, told I would get a call back. Nothing yet.

 

Checked my bank this morning and Cash Genie took the rollover payment again and the capital payment of £75.

 

Should I just wait for the Ombudsman?

Why havent you told your bank to cancel the payments and start chargebacks for unauthorised transactions?


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Why havent you told your bank to cancel the payments and start chargebacks for unauthorised transactions?

 

I'm concerned about telephone calls to work and home - it would be highly embarrassing.

 

I mean, if I asked for a one month rollover, do I add up the subsequent interest payments and if they total the initial capital + interest, reclaim the rest?

 

I do want the ombudsman's complaint to carry on

You deal with calls separately by way of a formal complaint. THe bank is the one to cancel the CPA not the lender. It is very rare youll get a PDL to cancel a pretty much guaranteed method of payment.


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Had a call today from Paul Geary at Cash Genie. £90 overpayment being refunded. Advised still proceeding with Ombudsman complaint and, as calls are recorded, asked him to listen to my previous call when I was lied to about what were in the t&c

They have tried this with myself and a couple of others. I got a refund. It no good them saying they roll it over unless told otherwise. From their terms and conditions it states that they will collect on the payment day the full amount ( in 2 parts, one being the calital and 1 being the interest) unless you ask for a roll over. As you did, once, then my understanding is that you are then provided with a new agreement (am I correct?). This new agreement should then start as before where it collects the 2 payments as before.
