    • While I am waiting for the original solicitor to ring back about the will can I ask. After my dad passed they were informed about this an released a copy of the will to me and my brother, should they have set the trust up then as they were informed of his passing?   Thanks again

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello to my family of Caggers,

 

I have been off forum for awhile due to 'other' personal matters but I am looking to do battle with an old enemy of mine Capital One.

 

The account was started approx 2002 and expired in 2004 due to Bankruptcy.They were advised of severe financial difficulties but they continued to take PPI and apply charges.......

 

They were SAR'd in 2011 and they failed to comply. The usual letters were sent by r/d but I was unable to follow up due to circumstances.

 

So, I have recently SAR'd them again and have received much the same information but I do have PPI/charges info which had been missing from the previous request so I have achieved that thus far.

 

However, there is no copy of agreement and they have stated that as the account is no longer active they do not have to provide this information as it falls outside the DPA.

 

The PPI was charged monthly as you would expect but there was also charges of £29 for membership. Has anyone expereince of claiming this from them and winning?

 

As I was in a good paid job at commencement of the account before going self employed I would not have required the plan. The screen dumps provided show 'YES' for PPI but that proves nothing without having sight of the original agreement.

 

Having researched through the forum I see that Cap One are getting very creative with their delayed evidence and I would like to reduce the time spent playing electronic ping-pong or posting/receiving snail mail to get funds that I am entititled to.

 

I also intend claiming unfair charges applied to the account but as these will be over the 6 years, does anyone have any experience of how claims are going currently with Cap One?

 

Would appreciate guidance or suggestions please.

Welcome back.

 

I too am trying to get various fees back from Cap1 that are over 6 years old. Cap1 are being obstructive and I may end up forcing the issue via court but have to wait until after July/August so they can complete the complaint process.....

Hi Shelley, I have recently reclaimed PPI and charges fom Cap One. Being self employed the PPI was no problem and took 4 weeks start to finish, the charges were another story and took 7 letters and 6 months , but eventually got last six years plus int. They wouldnt budge on the older charges and they kept claiming not to having received my letters

PLEASE HELP US TO KEEP THIS SITE RUNNING

I have had personal experience with taking Cap One to court and without saying too much on the forum, it wasn't a good experience :( I will watch your thread with interest.

 

When you claimed your PPI did you claim it with interest in restitution or standard 8% interest and did you complete the FOS form in order to get Cap One to pay up?

 

If correspondence is sent by recorded delivery and signed for, they have no excuse for saying they haven't received them. However, I wouldn't expect anything less of Cap One. They will say anything to delay proceedings and get you to give up with frustration. Ha! not this wench.
