      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well i have been repaying every month, from a debt of £380.00 & so far repaid £150.00. Today they emailed stating due to me missing my repayment date by 1 day. They have added fees and my new balance is £625.88. What a bunch if crooks, i have wrote to OFT had nothing back, once i have repaid the loan they can stick their fees. But wud they take court action. Has anyone had dealing with this company

Yep. Ignore their silly fees. They would be very silly to take you to court or mark your credit file based on unlawful charges.

Just getting control of all loans, with Mr lender took out £286.50 and to date I have repaid £143.40, and as soon as I have repaid the loan amount they are not getting a money.

Loan amount, original contracted interest plus one default fee is What i recommend. Let them try and justify the unlawful/unenforceable charges.

YEs. Once it is repaid, you need to state unequivocally in writing, that you have paid all monies owed to the company and you want a statement confirming it. Be warned though, they will try for those charges as that is how they make money. If people stopped paying the silly charges, they would only have interest as a form of profit making left. Once interest amounts shoot sky high, either nobody will take a loan from them, or the government will have no option but to create a law that caps interest rates.

Not sure who they are or why they are make contact, I have got some debts and paying the creditors directly. Should I wait until they send letter or call them to find out

Look in the terms and conditions of any market research company

 

In the small print it will say by using our service you consent in passing your details to selected partners, they sell to the credit agencies, who in turn sell to debt collection agencies

 

You have given your consent without even realizing it

Well just had this email, the debt relating to a payday loan from Mr Lender which is on a repayment plan

We hereby give you formal notice of legal assignment for the above debt.

Your debt has been assigned to MotorMile Finance UK Limited (MMF) from Mr Lender payday loan.

 

MMF is now the legal owner of the account.

 

All default interest and collection charges have been frozen from your account for 7 days. If the account remains unpaid after this time, we will add default interest to the balance which will significantly increase the debt.

The loan from Mr lender was £250.00 of which I have repaid £191.12 , and now this company went more and will increase to debt complete joke

Did mr lender contact you? Also the new owner has an obligation to carry on with the previous repayment plan. They cant add anything else on.

Will mr lender never made contact, I have had repayment plan of £47.78 x 8 of which I have repaid a total of 191.12, Motormile claim that Mr Lender have sent a file stating I have never repaid any money. Also I have sent bank transfer today to Mr lender to the sum of £47.78 should I still repay Mr Lender ???

MMF are well known for lying and conning people. My advice would be to get in touch with MR lender.

 

Even if MMF have bought the debt, they are obligated to continue the repayment plan as they inherit everything about the debt.

Just had 5 texts stating they will action home visit, I have proof of the payments to Mr Lender who should I deal with now, will this company Motorfile accept the plan and payments via bank transfer.

Ignore MMF as youve had nothing off MR lender. Please follow the advice already given.

Many Thanks, I have checked the amounts and the balance is £238.88 so going to clear the amount in full at the end on June when the next payment is due ie 27/06/13. However should I pay direct Mr lender ?
