Have just seen this on the BBC Local news..

 

 

 

Hundreds of drivers convicted for not updating their driver's licence photo ID may have been incorrectly prosecuted, a Lincoln solicitor says.

 

Michael Pace recently won a case by arguing the wrong section of the Road Traffic Act 2010 was used.

 

He said points may have been added to licences and insurance invalidated, as a result of the error.

Motorists are being advised to contact a solicitor immediately if they believe they have been wrongly convicted.

There have been several internet posts about this, failure to renew the photo is an offence contrary to s.99, Road Traffic Act 1988, the penalty is a level 3 fine, no points.

Some people have been incorrectly dealt with for not driving in accordance with a licence ( s.87), which is wrong, an expired photograph does not invalidate a licence.
