First of all I'd like to say sorry if I've posted this in the wrong place. :|

I'm a little simple and really need some help.

I have today received a CCJ (one sheet letter from Northhampt county court)

Apparently I was supposed to have recieved a form to send back to them

Which I don't at all remember getting apparantly is a blue? Form?

I don't remember receiving any blue mail...

So the court has ordered that I pay my creditor £650 "forthwith"

Which from what I can gather means..like now.

Or well that I have 30 days to pay the lump sum.

I really want to pay this debt but I don't have that sort of cash.

Who would I contact about making an arrangement to pay in installments?

There are 3 people stated on my CCJ

The County Court (obviously)

Homebase card services ( original creditors)

Aplins solicitors (these are in the "make payments to" box on CCJ)

I just really need some advice you guys, if they try and take all my pennies or send bailiffs round,

I'll freak out and not in a fun, disco dancin' way but a severe mental health issues way. :(

Thank you in advance to anyone who helps

You are now in the right place, I have relocated you :) You do not have to do anything it is purely administrative.

So, did you not receive any paperwork from the court originally and this Judgment has been given by default (that you haven't offered a defence)

I would think that you could apply to have it set aside if you were unawares this was happening, you are entitled to offer up a defence.

Did your creditors not contact you previously to advise they wanted money from you ? Send you a default notice - a statutory requirement, or a Letter before action ?

If you wish to accept this CCJ without fighting forward, but don't have the funds to make the payment in full then you can make an application to vary the order (ask for an instalment plan)

I think it is form N245 that you need to complete and it needs to go to the court named on the Judgment / General Order.

There is some information in the link above, but I will flag your thread for others to comment as well.

Do you know if there were any default/penalty charges added to this account ? If so, you will be able to reclaim those and we would almost certainly have advised you of this had you been aware of the claim in the making and sought advice earlier.

Thank you citizenb for your ultra fast response!

I do not wish to fight the CCJ as the debt is deffinately mine.

They had sent me the correct warning letters and defaulted my account.

I had just spent number of months burying my head in the sand,

As some folks do (but really shouldn't)

It wouldn't appear to me that any unfair charges have been added on

Although I can't be sure it just appears to be a few court costs.

So my new plan of action shall be printing a copy of a N245 form

and mailing this to Northhampt.. County court stating my proposed

payment plan.

Do you know, if these are generally accepted? Especially if I have missed the

first set of important blue forms they sent me?

I shall keep this thread updated to what happens.

Thanks MissI

I have alerted others on the site team who will have a better understanding of this than me. But yes, the N245 will need to be completed along with a personal budget sheet which shows your income and expenditure. You can complete the one I have attached below or you could telephone National Debtline on their free number and ask if they will help you complete a Common Financial Statement.

I guess you could mention on the N245 that whilst you were unaware of this claim, you accept the outcome, but as they can see from your attached Personal Budget statement, you simply cannot afford to pay the full amount in one go.

National Debtline are open Monday - Friday 9am to 9pm : Saturday 9.30am to 1pm and their number is a free service.
