Nope dot1....they offered less than half and will only take it off the arrears balance..so options are write again and ask or issue court preceding....it's GE after all...if you get del payments and it's. A month you. Get 2 the 2nd is credited to your arrears balance!!!!!

Halifax - £2281, successfully refunded all charges after LBA letter & telephone call.

Have been offered the difference between the £20 and £12 charges from Capital One -- am sending LBA for remainder.

GE Money - Received settlement of £441, being total charges requested. No interest though.

CCA'd Bank of Scotland / Blair Oliver Scott to produce CCA Agreements on two Credit Cards - well in default, although still chasing payment!!!

EOS Solutions "ceased action on account" on behalf of a friend.

 

All in all, quite busy at the moment and enjoying every minute of it

I hope they will come to their senses and bring the matter to an end soon. I have not come across anything interesting regarding similar claim.

Fingers cross and everything should be over soon. I know the waiting is the most difficult part.

this claim was settled

- to my satisfaction

- several days before the court hearing was scheduled to take place.

 

 

I was getting worried,

thinking I'd have to go to court and they'd not up the offer, but they did.

 

 

All I can say is stay strong and stick to your guns - in my case it paid off.

 

 

I'm chasing them now for new £40 charges they still keep adding to the account ..........

...Here we go again .....

Hi

 

I know when things go wrong and end up in court we have to pay legal fees.

 

 

I've approached GE Money to ask for copies of the legal invoices, which they will not send?

 

Surely if I've been charged them then there should be invoices available.

 

Given that they charge extortionate monthly admin fees, it makes me wonder if the legal charges are over-inflated too???

 

 

Any comments peeps???

I think that the only way to start checking is to send an SAR and see what that produces.

 

If they will not justify the money that they are asking then I would say that this is unfair treatment the newer then looking at a possible small claims action under cobs

Further to all the cases of irresponsible lending for payday loans ......

 

I know it's completely different, but - being subprime and catering for applicants with less than good credit history ... Is it possible that some of these loans could have been loaned irresponsibly?

 

Would a full SAR show the criteria that should have been met for the loan to have been approved?

 

Just a thought. ????

 

Hi, we all know GE MONEY (and others) charge £40 per month in admin fees when accounts are in arrears.

 

I know it's totally different ... But. ........ Following all of the claims for irresponsible lending against payday loan companies .....

 

Is it possible that - whilst catering for the subprime market - and obviously customers with less than good credit history - these companies knowingly loan to people they know will default so they can then add on these excessive charges ??

 

Could / would this be classed as irresponsible ?? Would a full SAR show the lending criteria and the checks carried out when deciding to approve a loan??

 

This is just something I've been mulling over for some time and wondered what others thought .......

Any company that lends to someone with a poor credit history will almost certainly charge horrendously high interest rates and will almost certainly be looking to maximise their profits with the high default charges !

 

 

Those companies that provide secured lending on this basis will almost certainly be lending irresponsibly because they realise they have some security one way or another.

Yes, a Subject Access Request should show the criteria as any borrower would have had to complete some kind of check list with the company.

. Would the time frame for trying to claim irresponsible lending be the standard 6 years from the date when the loan was taken out ...(in which case 11 years ago) or as account Is still being paid, would it still be classed as current ... Hope that makes sense

If you are still making payments to the loan and it is still current then you can make your claim. It is my understanding for the 6 year bar is that it starts from when you cease the relationship with the company.
