      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am looking for some advice in relation to an overdraft on my current account with COOP.

 

I lost my job in 2010 and was unable to meet any of my credit repayments and my overdraft was one of these.

 

The CC and OD was brought by lowlife( Lovell) few months ago.

 

I CCA on both accounts but lowlife (Lovell) returned CCA on OD claiming it not cover under CCA

 

however after several weeks they came back to dropping the credit card debt as COOP cannot produce the OA given time factor as acct was opened 2000.

 

Lowlife are now chasing for the OD abt £1000.

 

They sent statement on the acct covering last 2 years. Acct was opened around 2004.

 

They're now threatening as I have my own house.

 

What are my options.

 

Pls guys can I fight this as well?

Treat it as just a threat i expect you have been talking to them on the phone?

 

stop all communication by phone

the overdraft is not covered by CCA request

 

if there is lots of charges it may be wise to send a subject access request to coop and look at get them reclaimed

just get the info on how much of the OD is PENALTY charges

 

then we can look at using BCOBS

So what should i do next. Is there anything similar to CCA for OD or should I just make arrangement to pay lowlife whilst Im sorting out PENALTY charges claim

Ignore Lowlifes.

 

Have they actually bought the debt, or are they simply the gophers doing the dirty work and collecting it on behalf of Coop?

 

Deal direct with Coop.

Send them a SAR and enclose the £10 fee, they have 40 days in which to send you all the info they have regarding your account, then you can see what fees/charges they have added to it and reclaim them.

 

Overdrafts have part V exemptions from the CCA.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

I've read some nasty things they do on the forum.. Wouldn't they try the bankruptcy trick on me if I just ignore them. Sorry for being worried. Is there any legal request similar to CCA for overdraft?

they wont do anything on an OD debt

that the OC has sold

that obv contains penalty charges

 

that's why the OC sold it, lemon debt.

can never goto court for fear of a counter claim.

The letters they send out are ALL computer generated, and the telephone jockeys have no idea where in the cycle of threat letters you are until you contact them.

Ignore, Ignore, Ignore.

Guys - Update on this I now

 

received a letter from Red which I believe is part of lowlife saying that they've access my credit record

and about to pass my debt to Hampton legal for court action

 

however they're now offering either 30% discount on F&F or alternatively make a monthly payment of certain amount until bal is cleared.

 

They gave 10 days to respond.

 

I've already sent for SAR as previously discussed.

 

What should do now?

 

Should i make a lower counter offer without admission and if yes at what %,

or should I just let them know that the account is in dispute given that I have requested for SAR to identify unfair charges. Pls advice

Guys I now received another letter last week from their legaldept stating that they will go to court and

 

at the same time my SAR request came with bundles of papers from Coop.

 

Part of it are four pages of fees, interest and charges analysis for ten years(2000 -2010) when I had the acct with them.

 

I did a quick calc on charges of rtn DD,CHQ and comes to about £400+( about £30 per transaction).

 

What should I do next?

This second spreadsheet is a compound interest calculator and can be used both for PPI claims and Charges Reclaims on Revolving Credit Accounts such as credit cards. Compound interest is not an award that foslink3.gif will give in respect of PPI claims but it can be used in PPI cases that are pursued through the courts. Thanks dx. You are a star. Will start populating the sheet. You're right the letter didn't say will but given so many nasty thread I read about thiese people they always trying to go for CCJ/Bankruptcy..... Just to be clear should I print out every calculated charge sheet individually and then have a separate summary total sheet for them.
