      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good advice from dx, so let's see what happens tomorrow first. Personally in your condition u don't need more stress and upset. If its not resolved in the morning to your complete satisfaction I would let TS take a load off your mind.

Yes I have all my receipts and paperwork,

 

they never sent me statments... Just the hp agreement, insurance agreements and a few scraps of paper that are the reciepts, they never gave me anything

 

you need to reclaim certainly their optional service cover- how do I do this?

 

Hopefully somebody will contact me tomorrow so I'll tell them all of this

Hi guys just letting you all no that I've spoken to Elaine (she was a very big help) and we are pretty much sorted now. After alot of misunderstandings Elaine has sorted it, I am paying the £65 I owe them off and then my tv is being brought back. Thank you all for your help I'm very pleased with the out come :) xx

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Money first then tv back? Im very wary of that.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Yes they want the £65 from this month that's owed as box broke then will bring it back :)

 

Rebecca, this isn't a good result. Maybe it's enough for now, but when you feel stronger just remember how they treated you. They came in your home, accused you of stealing, took your property and damaged your floor. And their manager spoke to you like dirt.

 

They have absolutely screwed you from start to finish. You could buy a smart TV for £3-400 cash on the High Street, and be treated with respect and courtesy. Why pay £800+ to BAYV and be treated like a common thief?

 

Never use them again, and tell all your friends what a nasty bunch of liars and bullies they are. That's a good result... !

I mentioned the insurance and was told it was compulsory as we don't have home insurance.. It was worth a shot though :) x

 

they ARE NOT COMPULSORY

 

there is NO LAW that say ANY HP agreement must have insurance.

you need to get that in writing

then take them to the cleaners via the FOS..

Hi All,

I defiantly will be remembering all of this and I will be telling everybody I know, hopefully I will get my TV back today and try and get it paid of faster so I can cut all ties with the company, don't get me wrong they have done what I asked them and have probably treated customers fairly in the past but it has just been too much to deal with so I want out as fast as possible and the only way of doing that at the minute is letting them keep the TV and loosing £800 which im not prepared to do. Once the TV has been paid off I wont be using any other pay weekly/pay monthly companies as its more trouble than its worth lol.

 

I will ask the company for it in writing defiantly! If I dont have to have insurance on those then I have been misinformed by the company and that will be the last strike I believe.

I really just want to get my TV back and spend the weekend on the sofa being lazy watching it! Thank heavens for my TV in my bedroom whilst I have been on bed rest!

 

Thank You all very much, if it hadn't been for your advice I probably would have just left the TV and not fought for it! :)

They really are paying hardball with you, i would have thought,, no not thought-- EXPECTED, in view of their behaviour to have at least done something like dx said in #44.

I would still go for them when you get your telly back, and of course when your upto it.

Ill do my best I just want the TV back in my house lol.. not sure how they will get it to me though as ive said if the person who took my TV out of the house steps one foot into it, even to put my TV back I will lock him in and ring the police as he shouldn't have come in my house and took it in the first place.. its a bit pathetic of me but i dont want him back in my house :) xx
