      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Template DPA letter sent to Alex Lyons in Edinburgh recorded delivery today 11/04/06, have included cheque for £10.

 

Have picked up application form for a parachute account, considering switching everything to this account once created anyway as I have to large overdrafts with Natwest and don't want to risk my wages being swallowed up if they close my accounts.

 

Have Natwest been making many threats to close accounts?

Welcome and well done, you obviously have been reading the info before starting.

 

Threats of closing? Not any more than others, but I couldn't be specific. Don't let it worry you too much, even if you have to move, it's no big deal these days.

DPA Letter was delivered to Alex Lyons today so payment has been received,

 

"Your item with reference ************ was delivered from our WEST EDINBURGH Delivery Office. "

 

40 days and counting 'tick tock tick tock' - They have got until Sunday 21st May

 

I don't have copies of my Overdraft Agreements, does this matter?

2 weeks since my letter was received and I haven't had any acknowledgement or response. I assume they are now getting very busy from all the extra work we are creating. Should I send a reminder letter before the 40 days are up?

I have been trying to add up the charges that I have on the 2 years worth of statements that I keep. I am an advantage Gold customer on both accounts and it looks like the monthly charge for Advantage Gold and going over my overdraft have been taken out in one go. This is going to make it difficult for me to work out what is a legitimate charge and what is for going over my overdraft. Is anyone able to tell me the dates when A.Gold was £6, £7.50, £9? Also can anyone tell me what a 'Referal Charge' is as I have several of those on my account?

I found out what Referal Cahrge is from another post

 

Paid Referral - Any items that we choose to pay which results in an unarranged overdraft, will have a reffal fee. We will charge you £35 for the day that transaction was debited

 

Still need to know how to split Advantage Gold charge from other charges and what dates the various prices £6, £9, £10 were. Can anyone help?

I have not heard anything yet with regard to my DPA request, so phoned customer services to ask why. Customer Services say Mr Lyons did not receive my letter. The have passed on my phone number and name to him and he is supposedly going to contact me. Has been since last Friday so not holding my breath. I wrote to Alex Lyons at the following address.

Can anyone confirm this is the correct address. I sent the letter recorded delivery with a cheque for £10 which has not been cashed yet. I know the letter arrived on the 13th April as I have the proof of delivery.

Have drafted another letter, attaching a copy of my original letter and a copy of the Proof of Delivery. Told them that the 40 days is still running as of the 13th April. Again being sent recorded delivery. I also confirmed the address for Alex Lyons with Natwest Customer Services.

Well my letter which I sent to My Lyons has passed the 40 days. I went in to a local branch as once again I got a charge on my account for £38 for going over my overdraft by £15 to complain. The bank doesnt even write to me any more about the charges. Maybe they are hoping I dont notice. Oh how wrong they are.. Im going to draft up another letter today and deliver it to a local brance who said they will send it up to the regional Head office via the internal post. I get a feeling this report has to be run from a regional office or head office. Either way both myself and "dgif1973" have had no joy with getting the information we need out of My Lyons

Have been phoning a number given to me for Alex Lyons from customer serivces since last thursday. Left several messages and was assured I would be phoned back by customer services. Finally someone answered the phone numer I was dialling. I was told my request had not been received and asked if I could fax it over. I have also been asked to send in a further payment of £5 for the DPA. Don't care as long as I get my information. Hopefully things will start moving and I can finally send off a LBA. Interestingly enough customer services said I could go into any Natwest Branch and they would be able to produce a list of just my historical charges without the need for statements. Didn't want to try this as don't want to be face to face with anyone.

Interestingly enough customer services said I could go into any Natwest Branch and they would be able to produce a list of just my historical charges without the need for statements.

Very interesting. I might just do that and see how far back they can go before I move any further.

I have successfully contacted Alex Lyons office by phone again today, my second letter has been received today but not my first. So I sent off my cheque for £5 today. I was told my statements have been ordered today. They were not sure how long they will be but a least they are on their way.

First letter received from Natwest, statements have been ordered but the following information was given.

 

"I do need to inform you that we have received an inordinate amount of these requests due to recent publicity. In light of this and the volume of information required to reproduce this account information, this is resulting in delays in sending statements to customers.

 

The information Commisioner has been made aware of the problem associated with the large number of these requests and has accepted our position."

 

There was no mention of Manual Intervention in the letter, do I need to write to them again to confirm this?

Wait, so they're saying the Information Commissioner's given them leave to go over their deadlines for sending stuff out to us? In spite of the fact that they're obviously only sending them out at the last minute in order to delay any claims against them?

Yep thats what they are saying. I will still be putting a complaint in after 40 days just incase they are lying. I think the first letter requesting your charges back states that as they've not indicated any manual interventions, you're assuming there are none. Presumably if that is not the case, they'll contest it.

 

I'd put in a complaint to the IC regardless. If they're not meeting the deadline, then they should actually try dealing with the requests when they arrive, not at the 35-day mark.

I have just spoken with Joyce Tudor at Natwest to chase up my DPA request which by my calculations is due by monday otherwise the 40 days are up. I have a copy of the signed Royal Mail Proof of delivery that my letter and payment was received on 12/04/06. They deny receiving this letter but acknowledge my second letter and payment recived on 05/05/06. She has said they have 40 days from this date 05/05/06? Which date should I go with 12/04/06 or 05/05/06 to count the 40 days from before giving them 7 days notice before court action for failure to comply with DPA request? My gut feeling is to use 12/04/06.

My first lot of statements arrived yesterday, only for 1 account and only back to 2002. They came in a standard Natwest white envelope. Charges and interest so far are £658.35. Hopefully the rest of the statements won't be to far behind.

What condition was the white envelope in? We've all had torn tatty brown ones and I've raised a lot of complaints. I'd like to know if they have changed their methods or just run out of brown envelopes.

It was a standard white statement envelope in good conditon. Was only 60 pages so maybe that is why, I imagine the brown envelopes were used for larger numbers than mine.

The following section if from the DPA Non-Compliance - Particulars of claim template.

 

"6. The damage (and distress) caused is:

 

Extra costs incurred in addition to court costs, due to the Defendants failure to comply - this includes the cost of additional correspondence and time spent preparing documents and seeking legal advice, I estimate this cost to be £..........."

 

What I am looking for is information as to what is a reasonable amount to claim for damage on my claim for their failure to comply with my DPA request. The costs I have incurred amount to pence really so what amount should I put for damages? I have not sought any legal advice so can't claim for this, will the courts laugh if I ask for £10 in damages?
