Well got mcol through and they have till 30th dec to reply to it. Just a question, the charges are still piling on to my account like i was the last banker on earth, just trying to keep my head above water is tough enough, i feel like ducking the branch managers head under water see how he likes it! once my original claim has been sorted can i claim for this last load i have or once my claim is sorted is that it? i would like every single penny back.

Got a letter from the bank saying

 

I refer to your letter of 9th november 2006 regarding your claim for the reimbursement of the fees applied to you accounts over the last six years which you consider unlawful.

 

The banks position remains as outlined in our letter of 3rd nov 2006.

 

i am also aware that you have already lodged particulars of claim with your local county court which takes precedence over the banks complaint process. Any further correspondence will originate from the banks legal department.

 

If you are unhappy with the way in whitch your complaint has been handled or the outcome you may now refer the complaint to the financial ombudsman within six months from the date of our final responce letter to you.

 

I also got my letter from the mcol northampton county court saying the defendant has now 28 days to form a defence, and i have Acknowledgment of service attached, they are defending all of the claim.

 

just a few things i need to ask, can i change from northampton to my home address? and what happens now, will i need to fill anything else in or do i just wait now? thanks nick.

Hiya Nick

 

Before it gets to court it will automaticaly be moved to the court closest to you, you will get a letter through the post to inform you, I did nothing while waiting for the 28 days were up....wasnt long after I got paid out :)

Recived a letter from the banks legal services today, they have put a defence in which as been sent to the norhampton county court, its just a run down of how fair it is to charge me and so forth, i take it that it is a standard letter they send out. What should i expect now from them? i would put it all down but it is pages long of dribble.

Do nothing right now, you should recieve an offer soon.

:) Result! Recived a letter today offering full amount as full and final settlement,

 

in all the circumstances the bank belives this to be a fair offer, if you wish to accept please sign and return the enclosed duplicate of this letter, and notice of discontinuance which the bank will hold as undelivered until payment of the settlement sum has been made to you. Thereafter the bank will lodge the notice with the court.

 

Just a bit in there for u to read, now i have followed every step and i cant belive just how fast they have responded, is there some kind of snag they are ready to throw at me? or do i sign the forms they have sent me and just wait? do i have to send anything to my local court as i did the AQ only last week. It all looks to good to be true.

Well done mate. Have they offered claim + int + costs?

Prelim letter sent - 29/12/06

'Go away' letter recieved 05/01/07

LBA (7 day to sort it) letter sent - 05/01/07

'Will look in to' received - 10/01/07

Claim submitted - 16/01/07

Date of hearing set for 21/05/07

Offer of charges plus costs rejected - 17/04/07

Offer of charges,interest,costs accepted - 25/04/07

Thats a standard full charges offer, without costs and interest I assume?

 

Nick, don't send the notice of discontinuation to YB - they are not to be trusted!. Everybodys financial situation is different, but I would say only accept it if you have to, as you will get the rest if you hang on a while:)

 

If you choose to continue with the claim - you will need to send a rejection (Moss posted one in my thread) and you don't need to tell the court anything.

 

Only let the court know its settled when you have the money in your account, and just so your aware - if you do accept there's no telling when YB actually release the money to your account - i.e it could still be the day before your court date. HTH:-)

Hi thanks for your reply so fast, its my second offer, and its the full amount i was goin for didnt go for intrest as it would have gone over the 5 thousand mark so they are giving me just what i did ask for and im happy with that, they have offerd £4850 i was going for + £120 costs + £100 i payed for AQ. so i just send and sign the letter and keep hold of the other part till they pay me? once moneys recived send that part to them, il let them know in a letter. thanks for your help.

Ok cool Nick. In your letter tell them there is no possible way you can send your discontinuance notice until the funds are cleared into account.

YB can take a few weeks sometimes, unlike most other banks.
