    • In terms of "why didn't I make a claim" - well, that has to be understood in the context of the long-standing legal battle and all its permuations with the shark. In essence there was a repo and probable fire sale of the leasehold property - which would have led to me initiating the complaint/ claim v SPF in summer 19. But there was no quick sale. And battle commenced and it ain't done yet 5y later. A potential sale morphed into trying to do a debt deal and then into a full blown battle heading to trial - based on the shark deliberately racking up costs just so the ceo can keep the property for himself.  Along the way they have launched claims in 4 different counties -v- me - trying to get a backdoor B. (Haven't yet succeeded) Simultaneously I got dragged into a contentious forfeiture claim and then into a lease extension debacle - both of which lasted 3y. (I have an association with the freeholders and handled all that legal stuff too) I had some (friend paid for) legal support to begin with.  But mostly I have handled every thing alone.  The sheer weight of all the different cases has been pretty overwhelming. And tedious.  I'm battling an aggressive financial shark that has investors giving them 00s of millions. They've employed teams of expensive lawyers and barristers. And also got juniors doing the boring menial tasks. And, of course, in text book style they've delayed issues on purpose and then sent 000's of docs to read at the 11th hour. Which I not only boringly did read,  but also simultaneously filed for ease of reference later - which has come in very handy in speeding up collating legal bundles and being able to find evidence quickly.  It's also how I found out the damning stuff I could use -v- them.  Bottom line - I haven't really had a moment to breath for 5y. I've had to write a statement recently. And asked a clinic for advice. One of the volunteers asked how I got into this situation.  Which prompted me to say it all started when I got bad advice from a broker. Which kick-started me in to thinking I really should look into making some kind of formal complaint -v- the broker.  Which is where I am now.  Extenuating circumstances as to why I'm complaining so late.  But hopefully still in time ??

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

These are the emails that are being sent out to people. It is quite disgraceful when the recipients have never had a loan with this or any other PDL company. I trust the OFT are looking into the actions of this particular company.

 

 

 

 

These are the e mails I received.I deleted my name and alleged account ID number.There are no amounts mentioned, just n/a.

Pretty lame apology, the company should be forced to give £50 to each person it emailed incorrectly, would put a stop to this type of 'cold collecting' email, much favoured by another DCA involved in collecting PDL debts who feature on this site.

Not least for the time spent waiting on their automated phone system when people were trying to sort this out ?

 

IMHO, anyone who received on of these emails should have forwarded it to the OFT.

I received ANOTHER call from 24/7 Moneybox and reported them to the OFT, got an acknowledgement back from the OFT so hopefully this lot will have another nail in their coffin.

 

I am getting fed up with the 'you visited our website therefore you must be interested in a loan' when I visited their website to find out their t&Cs for another site member when I was helping on the PDL forum! I certainly do NOT want a PDL and do NOT want these cold calls!

I must admit, I would have thought that cold calling people to take out these loans would have been a nono as far as the OFT were concerned.. and the FCA !

Hi

 

I used a payday loan about 6 months ago and the process for been accepted was easy but I found a lot of companies are just fronts on the internet and make referrals. One referrer seemed to get about 20 people to contact me on the mobile, this lasted for about 3 weeks and I still get texts from them.

 

Has there been any work on stopping these rogue ones that are fronts?

24/7 Moneybox called me just now from 01227250085 - I told them I did not want to hear from them, the person on the phone said they were not aware of my objections on being phoned as I had had an open account with them - seeing as I never took up a loan with them I don't see how they can still have this info, it is now over 5 years since I last had a PDL.

 

I did say that I was not in the least interested and was actively against their product, to which the person replied 'You have an account with us, you must be interested'. Talk about cold calling!! They definately have called the wrong person YET AGAIN.

 

Went to the OFT website to report the call and was met with a 'We are doing essential maintenance, come back later' message.

 

I answered their call as I am expecting a couple of important calls today - this really is taking the proverbial!!!!!

I know of someone who had a loan from a pdl of £400. It now stands around £4000 and counting. I think he did try and set up a payment plan but they wouldnt accept any plan and the pdl increases the amount owing by app. £120 per month on month.

Like wise I think he has a several hundred letters, emails warning him of impending doom if the loan isnt paid in full.

Im sure at some point it has got to come to some sort of finale but when and how much they will claim is owed is anyones guess.

I have heard of someone in my town.The loan went from 100 - to a couple of grand.The credit union helped him.

I will just check my facts.

No i was wrong-

. "One of our customers borrowed £100 one week and was meant to pay back £130 the next. It kept going up, and by the time he came to us he owed £3,500." The credit union – a non-profit-making financial co-operative – has repaid the debt and spread it over two years so he can budget to pay it all off.

And a lad in Scotland who committed suicide.Because of the pressure.

The credit union had to help his friend rapidly also,because he had the same problem.

The article that i read a week ago is still this morning bothering me.I still expect someone to suddenly write,no Tawnyowl the item,article news report was a joke,a spoof, a attention seeker trying to get viewers and readers..And make me after writing about it look a right idiot.Which i would not mind if true.

First British Payday Loan Investment Vehicle to be launched it said.--£100,000 Investment -40% net return probable.

 

So after thinking about who would invest in such a thing,i came to the conclusion just about every investment team and individual out there who had the money.

I will stop here,but as the thread says

If you find out your employer,council,. church investment team whoever makes investments in this vehicle we will try to puncture its wheels before it sets off.

 

Get your own back,how,do not worry at the moment about that.We will work it out This will be the get your own back part.

And directly or indirectly,perhaps in a strange way,you will have been affected by bad practices

Now perhaps it is time to fly,and wait for someone to tell me no the news is not true.Which i will welcome..

 

And i like it when people are brave enough to tell us about their bad experience of payday loans,

There was a sticky from the site team saying that Friday Friday, one of the the smaller PDLs had put itself into administration, it was in Credit Today, link here - I somehow smell a rat when reading how soon after setting up they became a sponsor of a local football club.....

 

A company incorporated in June 2012 and then in January 2013 becoming a major shareholder in a football club - hope the company dealing with the winding up order looks very closely at this lot. I have my own thoughts on the matter but don't want to get the site team into a libel case. (I now know how to tell the difference between libel and slander - L for letters and S for speech!).

When you read it it isn't a payday loan at all, there is no mention of the interest rate and the loan is repaid after a few months - slightly dubious editing here.
