    • Thanks DX, I'm happy that there are no valid reasons for them not to send us documents via royal mail - they were after all perfectly capable of sending these two letters.   The 12+2 days end on 7 December so I will ensure the DD's are cancelled for these and the Hoist one that is also being paid monthly on that very date. 
    • Sorry to hear the news Dave.   As for sums on top of the £100, maybe the judge ruled against the £60 Unicorn Food Tax but allowed £25 claimform fee + £25 legal costs.  Just a guess.

Settle the £1182.89 due to Photo Studio Group.    30 October: The £1182.89 due to Photo Studio Group is overdue we are now instructed to proceed with a formal Letter Before Claim.   We are now considering whether to issue Court proceedings to recover £1182.89 owed to Photo Studio Group.    2 November: We are now preparing to send a Letter Before Claim. Call 01422746202 to resolve this matter.    6 November: We have now have issued a Letter Before Claim which you should receive in the next few days.     • for whatever reason they fail the 12+2 working day time limit you may cease payments.   as for their stupid excuse to gander email details you do NOT.   they know full well there are ZERO Gov't guidelines regarding mail , .

hi well got a letter back from cabot said it would take them 40 days to reply now as there 12 days are up i have sent the second letter to them that was a long one to write its says they should reply within 14 days if i dont here nothing back by then what do i do then

Hi Susanne42. In the same position as you with regards to second Cabot letter about CCA. I am also waiting for reply from the OC about my SAR. Hopefully I will then be able to get a list of any possible charges that have been applied that shouldn't have been. Plus I keep reading the threads on this site to keep my spirits up and to gain both knowledge and, more importantly, confidence to be able to understand what is happening with my debts.

Cabot can take ages to get a SAR to you - 27 months for me!

Support this great site where free invaluable advice is provided.

hi folks well sent my 2nd letter from cabot well basically they have not got the information from citi financial and there saying that failure to provide this information does not affect the ligality of my debt with cabot but it renders the credit agreement unenforceable until such time the agreement can be produced then they say it has been well established in english law mind u i stay in scotland dont know if that helps lol that enforcement constitutes obtaining a judgment at court the reporting of a default entry to the credit reference agencies or cabot requesting repayment of your account does not amount to enforcement NOT SURE WHAT THIS MEANS THOUGHT THERE NOT ALLOWED TO DO THAT. they recommend that i start payments again which i am not. SO WHAT DO I DO NOW the 2nd letter i sent that they had 30 days to get the information to me do i wait until that time is up then what do i do if they cant get me the information i need about my citi financail account thanks once again for the help sue

No CCA means no court action. They can still mark the file for up to 6 years from the original entry date. THats about all they can do. They know this and they are using it as a threat against you, hoping you dont. Just send them the failure to comply letter and ignore them.

 

If you are requesting a SAR, it's much better to go and ask the original creditor. Crapbot rarely have any info at all.

Send them the in dispute letter. Theyve had enough chances. Once dispute letter is enough. If they persist in threats etc, contact the OFT.

ive already sent that letter when they didnt reply to my request in 12 days but what do i send after 21 days as it says that in this letter do i just do nothing or is there another letter i can do aftwer the 21 days has expired for them cheers

DOnt do anything. They are in breach of OFT guidance. COntact the OFT and inform them. If you feel the need to reply to them, simply tell them that they are in default of your legal request and no further correspondence will be entered into until it is fulfilled as per guidelines. Should they continue to email/phone, you will not hesitate to contact the regulators and make a complaint for harassment.

 

Make sure to address the letter to the compliance officer and mark it Private and Confidential.
