    • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I've just got home from work to a letter pushed through the door from GPB solicitors regarding a debt that i have had with Toothfairy finance. The client name on the letter is Northern Debt Recovery Ltd and Toothfairy is listed as the creditor.

 

Basically, GPB are saying that they have been instructed to recover the sum of £919.00 from me. The letter is dated 04 April 2013. They have said in the letter failure for me to pay up "could leave us with no alternative other than to take legal action against you"

 

I have had a loan with toothfairy in the past, but it was in the summer (july) of 2011.

 

I have checked through all of my contracts that they emailed me and my reference numbers on those matches the client reference on the letter that i have received. The contract says that i borrowed £400.

 

Slightly confused by this letter as in my mind i had paid this off a long time ago. I have logged into my internet banking and checked my statements.

 

Toothfairy deposited £400 into my account on 14/07/11

They then took out of my account £72 on 02/08/2011

Then a further £315 on 31/08/2011

 

And then nothing after that. This means that i owe them the grand total of £13

 

Just wondering if anyone has any advise on what i should do about this letter?.. clearly there is no way they are getting £919 from me when i owe them £13 from a debt almost 2 years ago.

Ignore GPB.

 

Get straight onto Toothfairy and demand they explain what is going on, if necessary SAR to get all the data they have regarding this account.

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

It wouldn't be an original debt of £13... More like £113. They would have charged you £100 - £120 interest on a £400 loan. Total amount repayable on your payday should have been about £500.

 

Why did they take £72 on 02/08/2011 and then a further £315 on 31/08/2011? These payments don't make any sense in relation to the loan! A rollover/deferral payment would have been at least £100.

 

Can you remember back as to why payments like that were made?

I emailed them back telling them the amount that they are trying to get back from me is crazy and i had this reply

 

Dear ******* *****

 

Re – ******* Toothfairy Finance

 

Thank you for your email dated 9th April 2013, the content s of which have been duly noted. Please see below a breakdown of the balance;

 

Original loan amount - £400.00, Total Interest - £504.00, Total Fees - £400.00 leaving the balance at £1306.00. You have paid in total £385.00 leaving the balance at £919.00.

 

Under the terms and conditions of the agreement you remain liable for the full balance. Failure to pay this amount in full may lead to possible legal action.

 

Please contact us by the 22nd April to avoid this.

They are a solicitor for hire and will write anything TF say to write. As i said, TELL them youa re amking a full complaint to the OFT and SRA. TF always do this kind of thing and hope people pay up.

 

Notice the use of "if, may, could, possible etc etc".

I understand that but what I'm saying is do I just email them back and tell them I have reported them and then do nothing else? Will the usually try and work it out once they know that they have been reported?

I don't know enough about how they charge interest but if Bombaymix is right (and probably is) and the interest on £400 would be £100-£120, then they have put together a total of the original loan - £400 - plus the original loan again with interest added - £504 - and the original loan - £400 - charged again as fees.

 

You must write to OFT about this. The payday loan companies are on notice to clean up their act. This is a perfect example of how they are behaving, and OFT will be very interested.

Hi everyone....I find it funny that I get yet ANOTHER ****ty e.mail from Speed Credit/NDR/Toothfairy Finance/MH Bailiffs telling me to go to their website to "pay in full" I did type their add in and just came accross lots of forums basically slating them...there is NO way to e.mail them as it will come back to you - failure notice! They never ever write to you just phone call after phonecall.I was in hospital last year for a month and STILL received threatening calls/txt messages.My original loan was for £100 in January 2012 (they seem to think it was 3 yrs ago!!) I then had to give up my job due to illness so could not pay them.I then went into a payment plan last February and was late paying in March as I am unemployed and my house/utility bills/food come first.EVERY time I call them it ends up in a slanging match and I am now classed as a "agressive customer"....OH REALLY!!!?? My reason for being agressive which I was is because a week ago they took £24 from my account leaving me with nothing and did exactly the same last Saturday taking £48...a friend kindly put funds into my a/c to help me out as I am struggling - unemployed.I called Speed Credit and went MENTAL at them...I had no food,bugger all and they had cleared my a/c twice now.I have cancelled my debit card and written to my bank saying under NO circumstances were they to take another penny from me....arggggg :evil: They just said we have every right to do this and my debt was now up to £1050...funny that as a few weeks ago it was £350.I have no idea of the exact amount I owe them as it changes - weekly!! Yesterday I posted loads of paperwork to them in Sheffield,hospital notes-benifit letters,doctors letters etc etc I posted it recorded delivery,they would have had to sign for it!! So the txt's start....home visit within 7 days,god knows how many of them I have had.Are they really that confident to send some sucker here from up North thinking I'll let them in??? Now they are telling me they are taking me to court well good luck with that cause I haven't got a pot to p*** in and they know that - I owe a totall of £22,000 and every company except them has been fine and if my payment is late I call them just to let them know and they are fine with me.In the next couple of months I am going bankrupt and it will give me such a buzz to call them and tell them....go f*** yourselves!!! :oops: If any of you guys out there owe less than 15K get a Debt Releif Order....costs £90 and ALL your debts are cleared.Good luck to everyone that has to deal with Speed Credit or whoever the hell they want to call themselves..Just about says it all hey.

Toothfairy will ignore you. Just contact the OFT and file a complaint. Meanwhile, send one email or letter a week to toothfairy asking for their bank details to set up a standing order for a repayment plan on the amount you actually owe. NOT the amount they say you owe. Keep the money safe in your account should they be silly enough to take you to court. If they do ( they wont), you can show the court officer all the letters you sent, the stupid charges they added, and the fact the money is in your account waiting for them.

Larholt will use whatever means necessary to achieve his goals. It is well known that he formed sub companies and pretended he didnt own them purely to mislead debtors. Chances are he has instructed these "solicitors" (theyre really a dca with a "legal" department) to act, and they have no knowledge of what he has done in the past.

more like he has paid them a wedge just to use their letter heads

 

i am surprised though, since GPB kicked out Aktiv kapital and moved into their stratford upon Avon office, they do not deal with this low level debt anymore as a rule since they got burnt by Aktiv kapital

As i said, Larholt has probably either tricked them or mislead them into taking on the debt. Remember, as a DCA they dont know the history. They just get told by larholt " here's a debt, this is what they owe".

I agree with renegadeimp, write to OFT and relate your case. I would also suggest filing a complaint with FSO.

 

These solicitors probably don't know the whole story about your transaction with Tooth Fairy. I got a letter from them myself asking to pay a lower amount...It would have been relief to me except that..HOW IN THE WORLD DID THEY CALCULATE THAT AMOUNT?? I wrote them back and told them that while they were trying to collect this lower amount from me,the triplet companies(Toothfairy, Northern Debt and Marshall Hoares) were at the same time emailing and texting me to pay an amount double than theirs. No way of course, am I going to make arrangements for 2 amounts and with 3 different companies!

 

I've had transactions with some payday loans and have made arrangements with them, but I'm telling you...this is the ultimate dirty bunch..

 

Don't get stressed out. Go to OFT and FSO.
