    • They have defended the claim by saying that the job was of unsatisfactory standard and they had to call another carpenter to remedy. My husband has text messages about them losing the keys a second time and also an email. What do they hope to achieve??? Most importantly,  as far as I have seen online, now I need to wait for paperwork from the court, correct?
    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.  
    • They did reply to my defence stating it would fail and enclosed copies of NOA, DN Term letter and account statements. All copies of T&C's that could be reconstructions and the IP address on there resolves to the town where MBNA offices are, not my location

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

my point is why is the tax payer picking up the tab for her funeral when she can afford to stay for a month at the RITZ

 

All that the government has stated is that she will make a donation from her estate as to the cost, yet again, the government has declined to answer what that percentage will be, i wonder why??

I was no more a fan of Scargill than Thatcher but I think you underestimate the miners strength of feeling and ability to think for themselves.

 

I work with a man from the north east and asked how he felt about maggie's death. His reply - I'm from Tyneside. Do you really need to ask?

 

I am utterly appalled that in these austere times, we are expected to foot the bill for her funeral.

 

Certainly many of the miners wanted to strike and made that decision for themselves, but I would think that many were swept along even if they didn't want to strike. And those who said they didn't want to strike were intimidated and called scabs so you can't blame anyone who went along with it against their better judgment so that they and their families weren't treated as outcasts.

She was the widow of a very rich man. The Union were paying for Scargill's flat for 30 years. You surely aren't suggesting the taxpayer was paying for her stay at the Ritz.

 

Yeah, they were all in it together during the Miners' strike weren't they?

I'm not sure of the protocol for ex Prime Ministers. One dying is not an everyday occurrence. I suspect that there would be some kind of state involvement, even for the likes of the useless Brown, who never actually won an election. As for Miliband, If we are ever mad enough as a nation to elect that boy as Prime Minister, when he croaks we can make a rocket and fire him to the moon alongside gromit.

i myself do not care for any political party, i treat all of them with the contempt they deserve

 

what i will not tolerate are facts being twisted for a persons own gratification, and stealing the laurel's of another person who has earned them

What I do remember when she got in power was the pay rise she gave us. How young and innocent then, but could still see what was coming when all the manufacturing industries started going. That was even before the miners strike. If she was the greatest ever prime minister then I am glad that, so far, I haven't lived through the worst. Saying that Blair and Brown were close.

I remember freezing my bolleaux off on many occasions, though - attached to an Army unit on exercise in Hameln, and doing UK/US liaison on Ex REFORGER (that was actually quite good fun, as I spent most of my time buzzing about in a Huey), Ex CRUSADER and all the others.

I too remember the pay rise, and the way morale improved because we were appreciated. The problem with the manufacturing industries was that they were making things, often badly, that no-one wanted and at prices that were too high - see British Leyland, for example. They were complacent and resistant to change, and it killed them. Labour subsidised them and tried to keep them going because it's what the unions told them to do. As Margaret Thatcher said: 'The trouble with Socialism is that you eventually run out of other people's money'.

 

I was listening to a programme on the radio a few weeks ago, about how a former mining area had been regenerated. A man was interviewed, who had not worked since the pit closed, despite there being lots of new jobs. The reason he gave was that he had been a miner, and wasn't prepared to do anything else. The NUM were the miner's worst enemy; even Neil Kinnock says so.

 

Having also been through several sandy adventures courtesy of Bliar and Broon, I am quite clear that they were very much worse than Mrs Thatcher. Bliar sent us into Iraq on a false premise, under-equipped (courtesy of Broon as Chancellor) and with no exit strategy. He then sent us to Afghanistan - again poorly equipped (same serial for reason) and again with no exit strategy. The blood of many of our dead and wounded soldiers is on their hands. Broon, both as Chancelor and PM, did more damage to the armed forces than any enemy. I had the great misfortune of having to meet Broon on his last visit to Afghanistan. Insincere doesn't begin to describe him; limp handshake, no eye contact and no interest whatever in the people he was talking to. Wretched creature.

I suppose we ought to be grateful that neither of them have any respect for Royalty (Blair and the wimp Cherie) else they would have been Lord n Lady by now !!

 

I guess the Queen's sword could have been sharpened for the occasion and she could have had a slight accident and tapped the sword side to side rather than up and down :)

Hi Scarletpimpernel.

When I joined the Army I gave up a job working at Hawker Sideley Aviation and was studying Aeronautical Engineering. I applied for the Brylcrem Boys but was told I didn't have enough "O" Levels. At least I got to play with tanks for a while, plus lots of other things. I remember Crusader as I had just been posted to Germany attached to an infantry Regiment. What's that old saying about boys and toys?

£10,000,000 for a funeral!!! SAS guard, c'mon you're having a laugh. The crematorium near where I live would do it for under a grand!!! In fact, I'd do it for £500.

 

I suppose a few more benefit cuts must be on the way to cover this unexpected cost to the taxpayer.

How about the flying pig used in N.I.. with the swing out mesh barriers to act as barricades. Do you think they might need them next Wed in London? As much as I didn't like Maggie I wouldn't what the funeral to be hi-jacked by any anti this that or other brigade.I really don't know why the family don't just have a private service as they must know the deep feelings against their mother, as sad as that might be. Have their wishes been overlooked or do they think that the majority of people either liked her or have no point of view. I remember a T.V. programme a few years ago where Carole Thatcher visited Argentina and met the families of their dead from 1982, plus surviving veterans. If she could do that then why can't she see what a divided country her mother left behind.

I can't stand Mark Thatcher, and I don't in any way condone Carol Thatcher using the term golliwog to describe a tennis player but what Jonathan Ross and Russell Brand and Frankie Boyle have done is far, far worse than that. But we know the BBC will always be biased against anything to do with the Conservative Party.
