I have a card with hsbc

 

i am in arrears but not by much.

 

I received a default notice asking me to make an offer of payment.

 

I did and set up a standing order to pay it.

 

2 months later i have kept the payments and i receive a final demand letter saying they are going to default the account and pass to a debt agency

 

When i rang to ask why they said procedures have to be followed and there is nothing i can do yet i had agreed a payment plan and kept up payments

 

What can i do the man on the phone said there was nothing i could do

wouldn't worry really

I bet if you look

 

they already defaulted you before then anyhow

 

DCA have no powers to do stuff all

unless they OWN the debt

 

nothing to be worried about

 

THEY ARE NOT BAILIFFS

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Sorry, a Default Notice cannot ask for "an offer", it must ask for genuine arrears, are you sure it was a default notice issued under s87(1) of the Consumer Credit Act ?

 

Can you please remove any personal information and bar codes and post the document up for us to have a look at ?

 

Follow the instructions below ..

 

 

Dx100 – Instructions on uploading pdfs

scan the required letters/agreements/sheets

as a picture file

remove all personal info inc barcodes etc using paint

but leave all figures and dates.

go to one of the many free online pdf converter websites

convert the image to pdf format.

or if you have PDF as an installed printer drive use that

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

Yes it was a default notice asking for me to clear the £520 arrears the payment i set up was for the minimum payment plus £40 rising to £90 overpayment this month. But i have now received a final demand letter. The arrears is currently £440

Righto, so it was only arrears they asked for. I would think you need to write a letter to their HEAD OFFICE - mark it OFFICIAL COMPLAINT.

 

Confirm that after receiving the Default Notice, you entered into a payment arrangement and have maintained that. You think that they are not treating you fairly by now issuing a Formal Demand.

 

With any luck this is a genuine admin error on their part. However, if it is not, then do not worry. If there were to issue a claim against you, they would look pretty silly as you are maintaining the reduced payment agreement.

Can you post up the info as CB asked? Something doesnt smell right here ( and it isnt my feet!)

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

They send Final Demands even is you have been paying some monies into account usually you missed a couple of mothe previous, they are idiots, have been told even set up agreement and the figure is the one you are already paying in, that is the way that Shower Operate.
