Are transcrap the owner or acting on behalf of ebay?

 

Can we have more background info on the debt so we can advise further?

 

Regarding repayments, they are to be made according to YOUR financial situation. Not whatever a silly DCA says. However, before you even consider making ANY repayments, is the debt enforceable and legit?

The debt is legit. I think they are acting on behalf of eBay. I told them

I couldn't afford the first payment and they then said they would accept £130 just this once. I could afford that each week and would be willing to do that how do I get them to agree?? I don't want them taking me to court

Can you post some background info? It's rare ebay debts are legit, as ebay love to ignore people, pile on charges and then sell the debt off.

 

You don't have to of course, but with ebays reputation, it is prudent to make sure everythings in order before you make ANY payments.

 

If you want to pay them however, give them a figure that YOU can afford, like £10 a week. If they refuse it, then drop them to £1 for the life of the debt. Especially if you have other debts to pay. Theres absolutely nothing they can do. It is a low priority debt. They can take a running jump by trying to tell you how much to pay.

a dca is not a bailiff

they have no such legal powers to demand anything.

did a deal go bad....?

They have NO CHOICE but to accept lower payments. They are trying to threaten and harass you hoping you don't know the law or rules that they must play by. However, you came here and you can now be educated. TELL them, dont ask, what they will be getting from now on, even if its only a tenner a month. If they shout or refuse, simply tell them you are now dropping them down to £1 a month for the life of the debt, or until they agree with your original proposals. ALso tell them that if they do NOT agree, you will be making a full complaint to the OFT about their blatant breach of OFT guidance.

 

Please do NOT be coerced or fooled into thinking the DCA has any right to tell you what to do. They dont. At all. In any way.

If ebay hasnt put it on your file, then no. Your credit file will be safe. It's worth checking with all 3 agencies to be completely sure though.

 

As already advised, a DCA cannot do ANYTHING. They have no legal rights at all unless specifically stated by the creditor OR they have bought the debt. None of those apply to your situation. Please do as advised in posts #9 and #13.

 

 

Regarding paying the dca, i would prefer to tell them to get lost, ignore them and deal with ebay direct. They have an obligation to talk to you and help you out. Not simply ignore you.

No probs ksmith. First thing tuesday morning, send off the CCA request with the £1 postal order. Give them 12+2 days to send the ORIGINAL agreement and terms and conditions when you opened the account , and what they were when the account was closed.

 

DOnt pay anything more. If they cant come up with the CCA, then tough luck to them. If they send something, post it up here minus personal info and we can advise further.

I have another letter today saying £200 a week starting from next week

There saying it's an agreement. I can't keep to that

I paid£137 I can afford to keep paying that should I just pay that amount again on Friday??

There is no agreement unless you specifically set one up with ebay. Even then you can still change it at any time.

Please start taking the advice you gave already been given. You are starting to believe the lies the dca is feeding you.

THEY ARE NOT BAILIFFS

 

and you tell them to leave your property

 

its all idle threats

to get you paying.

 

IF they could have gotten you in court

 

EBAY would have done that months ago.

 

all hot air.

 

as a side line

 

what cost you +£2k?

 

that you owe this

 

very rare to see a debt at this level with ebay.

 

if it were legit, they'd have been in court within 7days

It is a legit debt.i was on way to post 4 expensive items and I stopped at shop I stupidly didn't lock car and they were stolen.

Sorry to keep going on with this forum just scared that's all. Don't want people knocking round as my girlfriend know nothing
