how does this work?

say you got a sanction from the 13 Feb - 26 Feb so no money received, so go and sign on again 27 Feb, no money received again, ( letter from department stating sanctioned from 13-26 Feb upheld)

specifically told on 27 Feb money will be released, 1 March no money, went to jcp to be told form 4 had to be filled in??

told sanction stands for 4 weeks now is that from 13 Feb or 1 March??

the only letter ever received was for the 13-26 Feb sanction, but still no money as of today ( except a hardship payment paid today)

what were you sanctioned for?

If it was due to failing to attend an appointment or signing then it is a fixed 4 or 13 week sanction and the claim should restart from the day following the end of the sanction.

If it was a disallowance following an availability or actively seeking referral then under the new sanction regime it is a 2 week disallowance followed by an additional 2 weeks sanction, due to hte initial disallowance form JSA4rr is required to reinstate the JSA award.

Not by a Memorandom to JSA sanction regulations 2012.

 

Read below sections 7.7 and 7.8 give examples

 

7.7 The next situation is when a claimant becomes re-entitled to JSA following disentitlement for not being available or actively seeking work. Currently claimants who are disentitled for these reasons can reclaim JSA straightaway and if they meet entitlement conditions then benefit resumes after a small number of waiting days as appropriate. Under the revised regime claimants who re-apply for benefit following disentitlement for not being available for or actively seeking work will be subject to a loss of benefit period of 4 weeks for a first failure and 13 weeks where there has been a further disentitlement within 12 months. The sanction is intended to more effectively deter claimants from failing to comply with requirements to be available for and actively seek work.

 

7.8 The loss of benefit period will deduct any period for which the claimant was not paid benefit or during which he was not claiming benefit. To provide an example Claimant A is disentitled on the same day as his Fortnightly Jobsearch Review and does not receive the previous 2 weeks benefit he was due. He reapplies for JSA after 1 week. His sanction on reclaim would be 1 week, this takes into account the 2 weeks benefit he was not paid at the point of disentitlement and 1 week spent away from benefit (to take him to the 4 week sanction period)

thanks for the reply flumps, I wasn't sanctioned but my brother was, for availability to work, he hasn't had no money for 3 sign ons.

he has filled the form in but jcp are playing games, he's been give alot of run around.
