I've been contacted by CSL regarding an outstanding balance on my ex girlfriends phone contract (its in my name), after an escalating number of phone calls to my families home while I'm at university i issued the letter to ensure all contact is in writing which to my knowledge they have followed. I've contacted O2 today to pay the outstanding balance in full but was told that I'd have to contact CSL about it as the debt no longer belongs to them. I've read many of the posts on here about this company and am extremely wary about the way in which I pay them off. Whats the best way for me to approach this?

Any help is much appreciated!

I've checked through what I do have and there's no letter, though I cant say for certain that one was never sent, I've moved around a bit in the past year. I'm aware I need to send a CCA for proof?

There will be no agreement for phone contract.

 

You might want to send them the letter I have attached below asking for Notice of the assignment.

No, dont send a postal order with this one.

 

Just fill in the necessary blanks - Original Creditor, account numbers etc. :)

 

You will not in fact be sending the letter that you would need to send a statutory fee with because there are no "Consumer Agreements" with phone contracts :)

what you are trying to do is to establish who has ownership of the account and to where you have to make payments, which is your right.

Hi all,

I sent that letter off recorded delivery for my own piece of mind and confirmed that it was delivered on the 5th of this month. A letter was sent to me dated the 3rd from power to contact, a notice of pre-legal assessment visit, I just wanted to be sure that they dont actually have any legal power to do this or even approach the house. Thanks for any help.

Hello again,

Sorry its taken so long to post this but this is the letter that Credit Solutions sent back to me after I sent the Notice of the assignment letter to them

 

I cant post the image of the letter but it says this:

 

"I can confirm that there is not a written contract between Credit Solutions Limited and yourself, please be advised that we are simply a third party company who have been instructed by our client to collect the outstanding balance owed on the above account. In response to your comment above, I refer you to section 13.1 of your terms and conditions with Telefonice O2 UK LTD 'Use and Disclosure of Information' which states that Telefonica O2 UK Ltd are able to pass your information to those debt recovery agencies who provide services for them.

 

As this account has not been sold to us we are not the legal owners of this account therefore we are not obliged to provide a copy of the deeds of assignment."

 

They claim that they dont own the debt, yet O2 told me they did, whose fibbing? and don't they have to give me more details than this?

I feel this may come to a close quickly so any help in this matter is appreciated, cheers!

I have yet to see a proper 'deed of assignment' - they wouldn't want any Judge in the land to see this document because it displays bulk debt purchasedt by the DCA and just how much peanuts they have bought it for against the original debt. Meanwhile the creditor claims back a tax write off and claims against the insurance. Nice! Win Win Win
