Assignment of disputed debt

Is it true that a creditor cannot assign to a third party a debt which is in dispute? Can somebody please quote "chapter and verse" about that please?

They shouldn't but the always do and will continue to do so until such time that the OFT starts to grow some teeth.

 

If a debt which is disputed is passed on or even sold on to a third party then it is easily fended off by either ignoring the tin pot third party or informing them that they have been given a lemon to chase as it is already subject to a formal dispute with the OC and therefore should be sent back to them to deal with as no further correspondence is ever going to be entered into with anyone other than the OC.


Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

Ha ha, good old Marlin....well if these clowns have picked it up when you have previously disputed it with the OC, then there is nothing they can do except pass it back to the OC, besides, they are only a tin pot DCA who has no legal powers anyway.

Just as a note on this, M&S assinged a disputed debt to HL Solicitors, whom did issue a court claim for part monies ..... its been defended, but just a heads up that both OCs and assignees can be pretty underhand and will continue to say its not disputed to try and badger you into submission !!
