    • moved to the debt self help forum. plenty of like threads here to read along with the ones you've done so far..good work. last thing you ever want to do is look at any kind of IVO/BK or anything alike concerning consumer debt, never do that, turns unsecured debts into secured ones in many instances. your best bet for now is p'haps looks at  Options for dealing with your debts: Breathing Space (Debt Respite Scheme) - GOV.UK (www.gov.uk) sadly you have to go thru one of the free debt charities to invoke that but DON'T be tempted to also open up a DMP with them, just get the Breathing Space done. get that in place that gives you at leasy 60 days buffer you've also goto to realise you'll probably get a default once breathing space is in place, bit if not it might pay you to withhold payments even after BS then p'haps re start payments once a DN for each debt is issued and registered. at least that way, whatever happens in 6yrs the debt will drop off dx  
    • Hello, I am a private seller and recently sold a pair of trainers on eBay.  Everything seemed fine until just after the eBay 30 day mbg had expired.  The buyer contacted me with photos showing me that both shoes had ripped.  He wanted his money back, and after refusing to refund him, he then left me retaliatory and defamatory feedback on my profile to the effect that I had sold him fake trainers (this was removed by eBay).  He then initiated a chargeback via Paypal.  Invariably, the outcome was in his favour, and I have now been charged for the cost of the trainers.  I would have also been stung for the chargeback fee, but eBay refunded this.  Incidentally, I do have the email receipt of the trainers from when I bought them from a well-established and bona fide online retailer.  The susbequent conversation with eBay followed its predictable course, i.e. the chargeback is out of their hands etc. I have been in contact with citizens advice, and my bank.  Citizens advice told me that as a private seller I'm responsible for the "Title and description" of the goods, but not the performance, or the fitness for purpose.  To me it is clear; if you receive something that's not as described, you don't then use the goods, and more than 30 days later claim 'not as described'.  In my mind, this makes the claim fraudulent.  He's used the 'they're fake' card to give credence to a 'not as described' claim here, obviously, without any evidence.  My understanding is that the chargeback is unlawful, because the trainers were shipped as described.  However, I read something on an eBay forum regarding sellers having no statutory rights, i.e. no right to appeal against a chargeback decision, or to complain to the financial ombudsman.  Does this mean that if my bank disputes the charge on my behalf, it will be to no avail, even if it's recognisably a fraudulent chargeback?  I have reported it via the Actionfraud website. Any advice, anyone?  Would be most grateful!
    • Thank you, I have drafted my letters and started to complete the reply form, printed from this site and not using the one they provided.    2 questions, on the forum link it says to tick box D & I, the reason for box D will be given on my thread, what would my answer be to "I dispute the debt"?  Do I send anything for the Vodafone debt they have included?  I've only done 118 loan s. 77 & capital one credit cards so. 78    Thank you

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Claimant is Hillesden Securities and the solicitors Alpins.

 

POC

The claimants claim is in respect of a credit facility 66*******,provided by Black Horse Ltd at the defendants request on **2003. The agreement was subsequently defaulted. Failure to meet requests for payment resulted in the account being terminated. On ***2010 all legal and beneficial interest in the monies was assigned to Hillesden Securities Ltd. The defendant was duly notified in writing of the assignment and that a balance of £3***.** was due. The balance of £3***.** remains owing from the defendant.

 

I have sent a CPR 34.1 and they have responded with a copy of the agreement and a statement showing interest collection fees etc.

 

I want to defend it on the basis of the PPI if that is possible

What is the date of issue on the claim form, please? Top right hand corner of the claim form.

 

Your timeline is..

 

Date of Issue + 5 days for service + 14 days to acknowledge + 14 days to submit your defence.

 

Yes, you can counterclaim for the PPI and charges - however, you will need to produce a spreadsheet of the amounts you believe are owing to you.

Hi Citizen

 

The issue date is 27 Feb 2013. I acknowledged service on the 5th March with an intention to defend in full - sounds as though I have more time now though ?

 

Any advice on counter claim would be much appreciated - pretty sure now I can not defend the rest of the claim.

Date of issue - 27 February 2013 + 5 = 4 March 2013 + 14 = 18 March 2013 + 14 = 01 April 2013 (33 days from date of issue)

 

You would structure your defence along the lines of..

 

 

 

The defendant denies the amount claimed for the following reasons:

 

1. It is admitted that the Defendant entered in to an Agreement referred to in the Particulars ofClaim ('the Agreement') with the Claimant.

 

2. It is denied that the Defendant owes any monies to the Claimant and the Claimant is put to strict proof to:

 

(i) show how the Defendant has reached the amount claimed for.

 

3) The amount claimed includes unlawful penalty charges andthe interest thereon which have been applied to the account by the claimant.

 

4) The aforementioned penalties are unlawful because they do not represent a true pre-estimate of the actual cost incurred by the claimant for each charge applied to the account and are thus unlawful under common law.

 

5) Notwithstanding the above, at the time of entering into the agreement, the Defendant was required to purchase Payment Protection Insurance as a condition of the creditor offering the loan. As this it is not permitted to make the purchase of Payment Protection Insurance a condition of lending, the Defendant will counterclaim for the refund of this.

 

6) The amount shown on the default notice and the claim form includes penalty charges. Since the charges are a penalty, the default notice is invalid as are any related entries or markers on any and all files held bythe Credit Reference Agencies and such entries and/or markers should be removed forthwith and appropriate compensation made available to the defendant.

 

 

Can you please post up a suitably edited copy of the Default notice so we can see if that is valid. Blackhorse DNs usually had defects in them.

Your counterclaim - Part 20 claim would pretty much be a claim against them for the actual amounts that you believe are owed.

 

However, as I get a bit confused as to whether you are still the defendant or a counter claimant, I will be unable to help you draft that.

If the defence is suitable for your circumstances, then yes, you can use that one. If you feel you need to add/subtract anything, then you should do that. I have only drafted the defence based on what information you have provided. It might be best that you do nothing until you pop up the default notice so we can see if there are any errors in it.

Is the £amount on the Default Notice and the £amount on the Claim the same figure ?

 

That looks to be an awful lot of arrears, or is that the whole balance that was outstanding on the loan?

The default is for nearly all of the amount. I lost my job 4 months after opening and then went into. DMP but they refused to cut interest - was paying £25 - £30 every month but they kept adding interest of double that so went the CCA route and this is the first time its been supplied when I made the CPR request. i have letters going back to 2006 asking for it. The claim is for more as they kept adding interest.

They can only ask for genuine arrears on a Default notice so if there were charges and ppi included (which there appears to be) the Default Notice is invalid.

THE FOLLOWING IS AN EXAMPLE ONLY AND NOT TO BE SIMPLY COPIED - each CC is unique and should be produced to suit the individual circumstances.

 

 

This is a typical/basic CC PT20

 

CASE NUMBER xxxxxxxxx PART 20 COUNTERCLAIM

 

 

The Defendant/Part 20 claimant claims sums paid to the claimant/part 20 defendant and HFC Bank Limited in relation to penalty charges Incorporated within the sum demanded by the Claimant which are sums claimed for their administration fees, late payment charges and like provisions.

 

 

The Defendant/Part 20 claimant claims sums paid to HFC Bank Limited for loan agreement xxxxxx in relation to mis-sold PPI within the sum demanded by the Claimant. The defendant did not want PPI But the salesperson insisted the loan would be declined without it.

 

 

Loan agreement xxxxxx was a refinance of an older loan agreement xxxxxxxx of which the defendant was mis-sold PPI Also. The defendant was told told that his application would be refused if he did not also buy a PPI policy. The defendant failed to obtain details for this agreement by way of Subject access request to HFC Bank Limited as they quote that it is over six years old and no longer held on their systems. The defendant cannot determine a figure for the mis-sold PPI on loan agreement xxxxxxx so would like to ask the court to make decision on how much can be reclaimed.

 

 

Loan agreement xxxxxx was a refinance of loan agreement xxxxxxx but no early settlement rebate was calculated and deducted so the defendant was charged too much for the refinancing.

 

The defendant paid the full sum remaining of loan agreement xxxxx with no PPI rebate also, totalling £XXXXXXX.

 

 

And the defendant/Part 20 Claimant claims;

 

(a) the sum of £XXXXX for unfair charges plus compound interest of 31.80%APR, totalling £XXXX.XX

 

 

(b) PPI reclaim for agreement xxxxxx totalling £XXX.XX.

 

 

© PPI reclaim for agreement xxxxxx, the sum to the Courts Discretion.

 

 

© Interest pursuant to section 69 of the County Courts Act 1984 at the rate of 8% per annum or up until judgement.

 

 

(d) Costs in the Case (Fast Track)

 

 

Statement of Truth
