I have just received an email from FOS today 18/03/2013 - telling me my PPI claim on a Sainsburys Credit Card (complaint originally made on 15th March 2012) could take up tp a further year/eighteen months.

 

Could someone PLEASE advise me on how to go about taking the case to small claims?

Have flagged your thread for the PPI guys.

 

It was my understanding that the FOS had employed more staff to deal with the PPI, how on earth can they still be taking so long ?

With a PPI claim in court the onus of proof of mis-selling will be on you as the claimant (Civil burden on the balance of probability).

 

What were/are the reasons you gave for the mis-sale?

 

You will also need to quantify your claim amount. Have you done that? If so, what is the value of the claim?

 

Is this for a loan or credit card and do you have all of the information on the account i.e. agreement and statements?

Yes I have all the documentation including results of SAR. I have quantified all the PPI which with them was called 'Credit Care' I also requested repayment of all late payment charges etc and 8% interest.

 

To the other contributor who replied 'why are they STILL taking so long - I think the answer is obvious! Because you are in fact paying for it yourself - aren't you??

Is the value of the claim less than £5,000? If not you might be better to wait a little while since the value of small claims is rising in April I believe.

 

Don't forget that you will also want back any interest they charged on the account as a result of the PPI.

The value of the claim is less than £5,000. The reasons for claiming are two fold really.

Firstly I am self employed Joiner and always have been - Really! was I just going to give em a quick bell between jobs and they would cover all my Credit Card costs?

As far as sickness benefit was concerned there was a 6 week moratorium period at the beginning of the cover in which the cover itself was inactive.

Secondly, perhaps more tenuously, there is an unspoken assumption that signing in the box will increase your chances of credit.

Hint Hint.

The FOS has told me in their opinion my claim is valid - but still HBOS vacillate - I want to sue them for as much as I can get to be Honest
