      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Another letter today .... 'further to my letter blah, blah blah still continuing investigations blah, blah am not in a position to advise you of the resolution to your complaint. I will contact you again within the next fifteen working days & apologise for any inconvenience this may cause'

Rec'd a letter today from Creation Thanking me for my letter (prelim on 16.10.06)

 

In brief they state that so far as fairness of their charges are concerned they are in line with, & in some cases below 'the norm in the market' (!!that's ok then!) They go on to point out I wouldn't have suffered charges if I paid on time & within the T&C of my aggreement with them. (Not the point!)

They state they have seen the OFT statement & whilst they don't neccesarily accept it's contents (??!!??) realise it must have had some impact on the market. They say OFT guidlines state £12 as a reasonable charge (??) Therefore without predujice & not admitting liability, having considered my case & as a gesture of goodwill have credited my account with £25 this being the difference between their charges & OFT guidelines. (not bad as I'm claiming £107+£11.48int+compound contractual interest!!)

Soooo what do I do now?? This letter I rec'd today obviously crossed in the post with my revised replim claiming cont comp interest - do i wait for a reply to that or send notification to accept the £25 as part payment??

 

Advice please :)

"I look forward to recieving your reply but as stated in my previous correspondence, should my request not be settled in full I will proceed with my letter before action on xx/xx/06". Don't let them take control of the time limits.

Yeah, £66 in charges plus £28.61 in interest, got £3 less than that and assumed that they had calculated the interest properly instead of using my dodgy calculations !! Good luck in getting the rest of yours back, I'm sure it won't be long

LBA has expired today & no response from Creation. I'm a little concerned however as I've just checked on Royal Mail for a signature on the letter (sent Recorded) & there is no record of it being delivered yet!! :confused:

 

Not sure wot to do now ..... It may of course have been delivered n just not updated on Royal Mail as I received no response to my letter of 2nd Nov refusing the £25 as settlement .... OH BUGGA!!!

Give Royal Mail a ring on 0845 7740740 & enquire. However, you have proof of posting & that will stand up in court so you have every right to press on with MCOL. The worst you'll get is a response from their legal team saying they didn't recieve the LBA & you just need to respond by sending a copy of the LBA & copy of the postage slip.

Hi Chezt - I finally got here !! Glad to see you had TC for company, and Gazzah. No tears for Gazzah, though - result - bonny lad !!!

 

- And there you are, still. Your little avatar still jumpin' away with enthusiasm !! Brought a tear to me eye, it did. With a bit of luck, you might get somebody useful like Bong along in a while, too. But for the time being, you've got ol' grumpyguts.

 

I have to confess to not bothering with Recorded Delivery until it really is important to get a time of delivery. Usually, these jerks send you a response eventually, saying "Thanx 4 ur piece of used bogroll dated X/X/X - here's ours - enjoy the aroma !!" You've then got a date and a name.

 

So, in your case, where you have paid your quid for same, then it seems you are NOW entitled to your quidsworth !! There are deadlines with Rec. Deliv., I'm sure, and if you haven't got a sig by a certain date, then your quid entitles you to a reason why not, at the very least !!

 

It has either been delivered & signed for, or it hasn't. If it has, then your quid buys you a date, a signature and a printed name. If it hasn't, then your quid buys you a reason why not, and return of the package, I believe. Refusal of a Rec. Deliv. is perfectly legit AFAIK., but you are entitled to be told why at the very least for your quid - and I think it should have been returned to you unopened.

 

I haven't had this problem (YET !!!) so can't speak from experience, but I reckon a quick scan of the Royal Mail online garbage might elicit a clue. At the very least, you MUST be entitled to a "Reason for Non-Delivery" - and you don't appear to have been given one.

 

I can only say - Get one.

 

FWIW, Half the battle here seems to be getting past crap like this. If it's not the Royal Mail, it's the ferkin' court clerks who also think they're bloody "Royal" too !!
