    • Hello CAG Team, I'm adding the contents of the claim to this thread, but wanted to open the thread with an urgent question: Do I have to supply a WS for a claim with a court date that states " at the hearing the court will consider allocation and, time permitting, give an early neutral evaluation of the case" ? letter is an N24 General Form of Judgement or Order, if so, then I've messed up again. Court date 25 May 2024 The letter from court does not state (like the other claims I have) that I must provide WS within 28 days.. BUT I have recently received a WS from Link for it! making me think I do need to!??
    • Massive issues from Scottish Power I wonder if someone could advise next steps. Tennant moved out I changed the electric into my name I was out the country at the time so I hadn't been to the flat. During sign up process they tried to hijack my gas supply as well which I made it clear I didn't want duel fuel from them but they still went ahead with it. Phoned them up again. a few days later telling them to make sure they stopped it but they said too late ? had to get my current supplier to cancel it. Paid £50 online to ensure there was money covering standing charges etc eventually got to the flat no power. Phoned Scottish Power 40 minutes to get through they state I have a pay as you go meter and that they had set me up on a credit account so they need to send an engineer out which they will pass my details onto. Phone called from engineer asking questions , found out the float is vacant so not an emergency so I have to speak to Scottish Power again. Spoke with the original person from Scottish Power who admitted a mistake (I had told her it was vacant) and now states that it will take 4 weeks to get an appointment but if I want to raise a complaint they will contact me in 48 hours and it will be looked at quicker. Raised a complaint , complaints emailed me within 24 hours to say it will take 7 days till he speaks with me. All I want is power in the property would I be better switching over to EON who supply the gas surely they could sort it out quicker? One thing is for sure I will never bother with Scottish Power ever again.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just preparing my prelim letter for Cap One. By the time i get to moneyclaim stage Lloydstsb should have paid up, so i'l have the pennies to start this one rolling.

 

They owe me almost 4x my credit limit. lol.

 

I really hope they don't close my account tho, nobody else would give me a CC now.

ok, here's a question!

 

i think i'm right in saying that the interest you add at initial stage is that charged for cash advances. The only reference to that i can find is on the back of my statement under charges, and it says 'cash withdrawal charge 3% (min £3)' and on the Interest Charging Information it says 'Cash Withdrawals - Interest is charged from the date of the transaction until that transaction has been repaid'.

 

So, should i add a flat 3% to each charge, or 3% to the total of charges, or try to calculate the 3% from the date of each charge?

 

Any help would be very much appreciated.

hi all

 

Am bumping this coz i'm desperate for an answer now i've totally befuddled myself over interest charges.

 

The interest i refer to is the initial int. you claim in prelim/lba letter. is it -

3% as above post?

1.83% per month as purchase int? and is that individually or as a whole total?

 

i'm in a mucking fuddle and need ONE SOLID ANSA PLEASE

If you are intending to claim contractual interest, then it is the 1.83% you mention above.

iGroup (GE Money) - AoS Filed late, defence late, amended defence also late despite extra time requested and granted.

Vanquis - Claim issued, no AoS or Defence received

The 1.83% above will be a monthly apr. for a true apr you need to times it by 12 so 21.9 and thats the rate you would use for contratual intrest.

 

the 3% fee is a fee for being able to with draw cash from a ATM i am not sure if this is reclaimable. As as far as i was aware only the intrest charged as a direct result of the penatly fee was reclaimable

Hi

 

Apply the 21.5% Apr rate to each charge. You can not claim the 8% added at the court claim stage. It's one or the other but not both.Contractual compounded interest is what you need to claim,especially on the credit card.

thanks for all your help. not been around for a while so here's a quick update.

 

rec'd a reply from Mr Udy on 14th nov, only 10 days after prelim letter, offering to refund the difference between £20 and £12 charge.

 

Am just putting together a 'no thanks, i'll have the lot' letter.

 

i did think about accepting, after all £318 squids is not to be sniffed at this time of year! But then i thought, nah, it's my money and i want it back!!!!!

 

so, here goes.

Hi molton, i'm just about to file my claim with courts but am unsure on something, in regards to the part payment they offered did you just knock the amount off your original spreadsheet and claim for the rest or did you leave the spreadsheet as it was and mentioned in the particulars that you have had £x already refunded.

as i did not accept part settlement, i filed with the original amount claimed.

if you have accepted partial settlement, i think i'm right in saying that this should be mentioned in your claim. You could always pm a site helper, or go into the chat room and ask, just to make sure.

 

The settlement i mentioned in above post was from Lloyds, not Cap One.

Hi Jazzy

 

Stick to your time table and enter the claim for the full amount. They will not pay up until you have signed the acceptance letter they have sent you. If you keep going they will pay out in full.

Hi uk, i never had an acceptance letter to sign and send back they just sent a letter saying they are willing to refund £x which they did and it was swollowed up by my card balance. I am worried if i claim for the full amount it might not look too good.

Hi uk only just got your pm, i better start from the beginning. Sent prelim out for £x amount, got reply before the 14 days were up offering £x amount (not the full amount claimed) then sent lba letter with a paragraph saying that i accept the offer as part payment but want the rest or i will take it to court, got a letter before the 14 days were up again to say sorry no more money, this is final. they have already paid the partial refund in my card account.

Hi jazzyb,

 

When you received the letter offering part settlement (full in their eyes) how long did it take for them to refund the money into your account? Do I understand correctly that they offered it and just put it in before you accepted?

Hi rouge, they just paid it in about a day or two after i had received the letter. If you have any other questions mate my thread is called particulars, i have already done enough hyjacking on this thread:D
