    • And yes, they state their client is EON and that they can return the debt to EON who can either register a default or take me to court. 
    • Thank you. The npower debt was from 2019/2020 until EON took over the account late 2021.   npower had set a DCA on me even though I owed them nothing. I spoke to a customer service agent, following up by email, who confirmed I was in credit . I made a complaint to head office who sent a barrage of emails, changing the amounts each time. According to them, I owed £279.   The debt grew to what it is now as first npower and then EON subsequently failed to put a payment arrangement and direct debit in place to pay off this supposed sum and my ongoing bills.   I was very ill with Covid, struggling in lockdown with a disabled child and informed them of all this.   EON stopped their legal action when I took them to the ombudsman as this was part of my complaint and requested remedy but I have not received a notice of discontinuance.    I would like to set up my own dd to pay them off but am concerned they could still take legal action. I am on a low income and can’t afford to pay them more than a token amount each month.

This includes providing advice to us, the Health Research Authority (HRA) for research uses. It also provides advice to the Secretary of State for Health for non-research uses.
    • HB - yes I agree it is about their paperwork and advice.  I need to be clear in my head what my complaint is.  And what a result looks like for me? (They should never have placed me with the shark with whom I've had all sorts of issues - but I don't think that's my complaint focus -v-  broker)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have put myself off from writing this because I am already on this site in regards to another situation I am currently going through, and the two people who have been assisting me with that may well see this and think to themselves: “Oh God - not them again”.

 

I left Glasgow in May 2009 with a council tax (ct) debt of, apparently, £1000, covering 3 ct years and 2 addresses. While at these addresses I spent a vast majority of my time unemployed, only being employed for 2 christmas temp jobs from Nov/Dec 07 and Aug/Dec 08. Other than that I was in receipt of JSA.

 

When I left Glasgow I was only due to pay for April and May 09 ct of £45.58. However, due to the nasty people at the letting agency I rented my flat through I am now, what appears to be, being charged a full year of £395.41 and not £45.58. Apparently, my former letting agency are holding me liable until the terms of my lease agreement (I don't know what they are or what they mean), and because they couldn't rent the flat between May and September 2009, rent they are trying to obtain from me but to date have done nothing about, I am being charged full (no 25% single person's deduction) council tax of £108.72. Now it appears to be £395.41.

 

I received a letter in March 11 from STIRLING PARK informing me I owe GCC £907.98. After getting my act together I started to pay SP £5 per month as from March 12, which was all I could afford as I am on ESA due to having mental health problems and difficulties. In February 13 I received a letter from BPO Collections demanding the full amount of £960 19. I was confused about this as I had assumed that SP were dealing with this debt, and after writing to SP was informed that they are no longer dealing with GCC and BPO Collections have taken it over. To date I have paid them £5 (I pay £2.50 per fortnight), and to date I have paid £65 towards this debt as from March 12.

 

In January 12 I received a letter from GCC informing me of a how much I owe in regards to each outstanding (os) year and address, and it was broken down for me to see. The total was £606. 41. I wrote to both GCC and BPO Collections, with enclosures of this letter, requesting GCC to amend their records and to inform BPO Collections of this amount. I have just received a letter from GCC informing me that I owe £950.19, and that since the letter of January 12 the amount has increased. However, I was not sent any paperwork in regards to this increase or any thing else. Basically I am to take their word for it and pay it. Tough on that.

 

How can a debt go from £907.98 to £960.19 to £950.19 and no sign of the £65 I have already paid? As James Stewart says in REAR WINDOW: “Since when do flowers grow shorter”.

 

I have just written a letter to GCC asking them to send me EVERYTHING they have on these os debts and I will get someone to look over the paperwork, but in the meantime any help and advice will, as always, be gratefully appreciated.

Hello All

 

I did write a thread in regards to this matter in March 2013, and although read no-one replied. It may have been the way I wrote it.

I have Attention Deficit Disorder and I do have problems in expressing myself both verbally and in the written form.

 

I lived in Glasgow for 1 month short of 10 years,

 

but from 2007, when my partner and I amicably ended our relationship, until I moved away in May 2009,

I got myself in to a terrible mess with my council tax.

I was on JSA at the time and I just couldn't afford to pay what they were asking.

 

When I moved to my present location 4 years ago I brought that debt with me, and

 

in March 2011 I received a letter from STIRLING PARK DEBT COLLECTION stating I owed over £900.

However, due to my A.D.D., I finally got myself sorted out and started to pay £2.50 per fortnight when I received my ESA payments.

 

In January 2013 I found out the debt had been passed to BPO COLLECTIONS and I continued to pay the debt to them at the same amount.

 

The debt amount kept increasing, and even after paying for one full year, the sum amount of £65 , it was still not getting any lower.

 

I wrote to GCC who gave me a break down statement of account, and they had added extra to it due to the situation regarding my last tenancy.

 

I moved out in May 2009 but the letting agency would not give confimation of this date to GCC and stated to them that I had moved out in Sept 2009

because they couldn't get a tenant in the place in between that time.

 

It didn't matter that I gave them a copy of the front cover of my tenancy agreement to my new abode 500 miles away!

 

my brother very kindly offered to pay this debt off for me because

(a) it was going to take forever, and

(b) I wanted shot of it once and for all and move on.

 

I had previously written to GCC to offer a Full and Final payment of £650, which was declined, although not actually outright.

 

What I received instead was a letter giving me outstanding payment dates and amounts and informing me that I owed £899.07 and that this was still payable.

 

As I had a few days earlier paid BPO COLLECTIONS a payment of £2.50,

I deducted that amount making the outstanding payment £896.57.

This amount was paid in full on 4 June 2013 from my online bank account to BPO COLLECTIONs bank account

(I saved a copy of the online bank receipt as a jpg),

and I wrote to both parties requesting a letter stating that the debt had been paid in full

and that I was to receive no more correspondence from them in regards to the accounts.

 

Today I received a letter from GCC with four statements,

and on the first one it states I have an outstanding balance of £10.00 (TEN POUNDS ONLY).

I was, and still am, furious at this, and am spitting blood chips.

 

I paid what was owed - £896.57 - in full,

so why am I now being hounded for £10.00?

 

There is a breakdown of account of each statement, and I think they have very cheekily (is that a word)

added a Statutory Addition fee of £23.10, and when everything else has been deducted it leaves an outstanding balance of £10.00.

 

No fees were mentioned, no additional monies mentioned, just a letter with the amount I owed, which I paid (minus the £2.50 previously paid).

 

Do I have to pay this?

Should I pay it?

Can they take me to court?

 

I paid what they asked for, so as far as I'm concerned it is all done and dusted.

 

Any help, advice &c. is as always gratefully received.

 

I'm desperate to leave glasgow behind me, but they won't let me go.

 

I'm off for my cup of cyanide.

I wouldn't have thought that they would take you to court for £10.00. However, I will try and find someone who has more knowledge of this than I do.

I've just in touch with my brother and he is astounded. It was a full settlement letter they sent to me and I paid it in full - in the words of, dare I say, Jeffery Archer, 'Not a Penny More, Not a Penny Less'.

 

The nerve of it though. Audacity.

Hi CitizenB

 

I have to be honest, that is the only JA book I've read, and I read it a long, long, long time ago :oops:, but I did enjoy it very much. I remember I found it very difficult to put down. My father was a JA fan and had all of his books. I will have to try and get another copy of it and see if I still like it. Plus some of this others. My father was a HUGE fan of his books. I think he liked CAIN AND ABEL as well.

I am very surprised Glasgow added to the debt

they cant do that

 

are you sort of sayin that all the time you paid the two DCA's, it appears, it was not going off the debt?

 

there is something not sitting right with me here.

 

I know its a pain but can you scan all the letters you have up?

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Thank you for replying; it is much appreciated.

 

In the letter I received today about the £10 outstanding, there is a statment that once everything has been added up and deducted leaves a remainder of £10. All of the other statements are clear and paid to date. I will give a brief run down and up load letters &c. tomorrow.

 

I received the following letters from STIRLING PARK:

Dated: 1 March 2011 - FINAL NOTICE - £907.98

Dated: 9 March 2011 - FINAL NOTICE - £907.98

Dated: 15 Sept 2011 - Breakdown of accounts and amounts owed to each

Dated: 15 Nov 2011 - ARREARS NOTICE - £907.98

Dated: 7 Dec 2011 - BALANCE DUE INC COURT/WARRENT COSTS. This letter also included SP bank details which I set up to pay via my online bank account. They demanded £15 per month - I paid £5 per month. Payments commenced end of March 2012 from my online bank account to theirs. I never missed a payment.

Dated: 13 Feb 2013 - Informing me that SP are no longer collecting the debt and it has been passed to BPO as from Jan 2013. I am assuming that GCC changed DCAs

 

I received the following letters from BPO COLLECTIONS:

31 Jan 2013 - FORMAL NOTICE - £960.19. Note the increase from the SP letter. By the time I commenced paying BPO I had already paid SP £60, which is 2 weeks short of a full years payment of £65.

 

The financial increase is due to the last flat I lived at in Glasgow.

I lived there for the first 2 months of the 2009 council tax year while on JSA, so I should only of had to pay approx. £45.

 

But the letting agency I lived at refused to give the correct date to GCC and they told them I moved out at the end of Sept 09

because they couldn't get anyone to move into the flat after I left.

 

Although I have not received any letters in regards to this,

the letting agency were talking about charging me for the months they couldn't rent the flat out for - June to September.

 

It didn't matter that I had sent GCC a copy of my new tenancy agreement stating when I moved into my new place 500 miles away

- they needed the last word from my Glasgow letting agency.

 

So - what GCC did was cancel my 25% single persons discount from May to Sept and charge me the full amount from those dates,

and I got a £32 deduction on a '2nd home'.

 

This brought the debt up to £605.96 before deductions and £478.88 after deductions.

 

The original amount was £45.58. HUGE DIFFERENCE.

 

No matter what I said they refused to listen to anything I said and went by the side of the letting agency, which is why the amount was increased.

They also like to add Statutory Additions whenever they appear to see fit, which rapidly increases the amount even more.

 

The whole situation was dragging me down so much, which is why my brother very kindly gave me the money to pay it off.

But I think there is a fix going on here.

 

If I was still living there I would still have been on JSA, so they were charging me full persons council tax on a JSA income.

That has to be wrong.

 

When I moved here my JSA account was basically transferred via details, although I am now on ESA.

 

I'm just really annoyed at the £10, considering they sent me statements of the amounts I owed and a letter with the full outstanding amount.

 

Just need some advice, and if there is anything else going I will take that too.

I would send them an sar

 

there is something very wrong

esp the extra months and the 'fees' added

 

there is no remit to add any fees.

 

the LO they got is the only figure they can charge you.

 

sadly many Scottish councils use DCA

 

they seem to think they can add their fees too

they cant.

Thank you for your reply - again much appreciated.

 

You wrote about sending a SAR - I am assuming to GCC and not the letting agency. I can't afford to send to both.

 

I've always smelt something about this situation, with the fact that the GCC cancelled my 25% single person and charged me full amount.

 

If you would still like to upload the letters from GCC (the statements) I can do that. It will take some time because there are 2 sides to each statement, or I can just upload the breakdown side only. This is the part iwth the most informtion.

 

If I requested a SAR and it came back in my favour, would I be entitled to a partial refund?
