Very customer help with SAR and what to do?

Hey everyone, I'm new on the forum and looking advice to reclaiming late payment fee's from very.

 

I had my first statement from very on the 30/06/12 since then I have continued to pay my minimum amount on a bike and a coffee maker that I bought from them.

 

I have all this time up until 3 weeks ago been paying my bills out of my Job Seekers Allowance and recently started a new job. So in the last month or so have been unable to pay anything to them with other bills to take care off and no money coming in after signing off and starting the new job.

 

I had a look through every statement online and realised they have been charging me £12 late payment fee's as of the 20th Oct last year. So two months payments have not been paid since signing off job seekers.

 

So after all that I now have a minimum amount of £83.19 to pay by the 29th of this month which of course I am certainly not going to do as I have to live and pay other bills.

 

I know what I'm going to do in terms of what I will be offering to pay back, and will be phoning them tomorrow to tell them what I can afford to pay and to freeze interest and the late payment fee's until i pay the money I owe.

 

However I have realised from other threads those £12 late payment fee's they have put on my account (6 of them so far) can be reclaimed :)

I did however ask very via email to move my payment date for me as each of those months i was receiving late payment fee's I wasn't receiving my benefit payments until 3 or 4 days after the payment date and this was swept under the carpet in the reply they sent me saying they couldn't help me with this.

 

So do I need a SAR or can I total the amounts myself through the online statements and claim my money back that way?

If you have all the information that you need, you don't need a SAR. Don't forget to claim the interest on the charges too.

attach it

 

set your default scan page size to A4 less than 300DPI [150 will do]

scan the required letters/agreements/sheets - as a picture[jpg] file

don't forget you can use a mobile phone or a digital camera too!!

ENSURE: remove all pers info inc. barcodes etc using paint program

but leave all monetary figures and dates.

put them in a word doc FIRST and convert that to PDF

or use www.pdfmerge.com

convert existing PC files to PDF [office has an installable print to PDF option]

..

 

it would be better to upload a multipage pdf if

you have many images too rather than many single pdfs

or if you have PDF as an installed printer drive use that

or use word and save as pdf

try and logically name your file so people know what it is.

though dont use full bank names or CAG in the title

i'e Default notice dd-mm-yyyy TSB

.

open a new msg box here

hit go advanced below the msg box

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

hit upload files

.

Can you advise what i must do with this spreadsheet.

 

An update on how i''m paying them the £80 odd i owe - I phoned and arranged a £25 perm month payment plan.

 

So just need to know exactly what to do, to get those charges back.

I now understand that the regime of fees which you had applied to my account in relation to late and over limit charges

are unlawful at Common Law & under both Statute and Consumer regulation as they do not represent a genuine pre-estimate of your actual costs, but more a fixed PENALTY.

 

 

 

I would draw your attention to the terms of the contract which you agreed to at the time that this account was opened.

 

 

It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law

and in consideration of fair business practices and good faith.

 

 

 

It is my contention that you have failed to operate my account in a manner conducive to the above and have demonstrated a lack of fiduciary duty.

 

 

 

I calculate that you have taken £240.00 plus £878.70 which you have charged me in interest which totals £1,118.70.

 

 

 

Therefore this letter demands a refund of all PENALTY charges indicated including interest to the date you settled,

 

 

 

As the account concerned is closed, I request that payment is made directly to me, either by cheque or by BACS transfer.

Thanks for that, are those figures of £240.00 plus £878.70 the true figures or just examples. Or should I be using those two totals in the spreadsheet?

 

Any idea which address I should be sending it too? Shop Direct Headquarters?

You say in the letter the account is closed, though it's still an open account is it not while i pay back the £80 odd?

 

Sorry i'm not used to doing this type of thing.
