    • The text on the N1SDT Claim Form 1.The claim is for breaching the terms and conditions set on private land. 2. The defendant's vehicle, NumberPlate, was identified in the Leeds Bradford Airport Roadways on the 28/07/2023 in breach of the advertised terms and conditions; namely Stopping in a zone where stopping is prohibited 3.At all material times the Defendant was the registered keeper and/or driver. 4. The terms and conditions upon  entering private land were clearly displayed at the entrance and in prominent locations 5. The sign was the offer and the act of entering private land was the acceptance of the offer hereby entering into a contract by conduct. 6.The signs specifically detail the terms and conditions and the consequences of failure to comply,  namely a parking charge notice will be issued, and the Defendant has failed to settle the outstanding liability. 7.The claimant seeks the recovery of the parking charge notice, contractual costs and interest.   This is what I am thinking of for the wording of my defence The Defendant contends that the particulars of claim are vague and are generic in nature which fails to comply with CPR 16.4. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 1. Paragraph 1 is denied. It is denied that the Defendant ever entered into a contract to breach any terms and conditions of the stated private land. 2. Paragraph 2 and 4 are denied. As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance. The Claimant was only contracted to provide car park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner. 3. It is admitted that Defendant is the recorded keeper of the vehicle. 4.  Paragraph 6 is denied the claimant has yet to evidence that their contract with the landowner supersedes  Leeds Bradford airport byelaws. Further it is denied that the Claimant’s signage is capable of creating a legally binding contract. 5. Paragraph 7 is denied, there are no contractual costs and interest cannot be accrued on a speculative charge.   I'm not sure whether point 4 is correct as I think this side road is not covered by byelaws? Any other suggestions/corrections would be appreciated.

Initially, the property was in very good condition, but now it needs extensive renovation. This includes redoing the bathroom, replacing the kitchen, removing wallpaper, and redecorating due to significant mould growth. The tenants also left their furniture on the grass, which is owned by the local authority. As a landlord, I've met all legal requirements. It seems the damage was caused by poor ventilation—windows were always closed, and heating wasn't used. There was also a bathroom leak fixed by reapplying silicone. I tried to claim insurance, but it was denied, citing tenant behaviour as the cause by looking at the photos, which isn't covered. The deposit barely covers the repair costs, or else I'll have to pursue money claims, which I've never done before and am unsure about its legal complications or costs. Any thoughts on this?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am applying for work, and one application (for a janitorial cleaning type position) has asked for copies of the following documents to be sent along with the application. It seems to me that these are things which can be requested at the interview stage, but is it legal for the employer to require them at the application stage? It seems sketchy to me, and I'm reluctant to do so for various reasons, including the potential for identity theft if the documents are misplaced or misused. If it is not legal, is there a body or organization I should report them to?

Hmm, I would be a bit concerned with providing that type of documentation - especially today when companies dont have the decency to respond to applications if you are unsuccessful.

Well, quite. I certainly don't intend to, especially for a low-rent job like this. I was just wondering if there is any kind of law against requiring such things at this stage, and who to report them to if there is.

As I said, I am willing to bring copies of these things to an interview to provide such a demonstration. To ask for them at the application stage is a recipe for data protection disaster IMO. Especially since the only thing with my name on it that could pass as a "utility bill" would be a bank statement.

If your worried do it by recorded delivery, for the position your applying for you will also need an enhanced disclousure.

 

Why would I need an enhanced disclosure for a janitorial job?

 

I'm not mad keen on applying for this job anyway, since when I wrote to the given email address requesting more information, all I got was the same autoresponse with the application again -- no job description, no answers to my questions regarding the position. It's not worth it for such a low-rent position.

 

What I still want to know is if it's truly kosher for them to be requiring all these extremely personal documents at the application stage.

This requirement is very common and will usually require an enhanced CRB check as well thousands of applications need this!

It will be because of the type of premises that an applicant may be required to work in.

Enhanced CRB for cleaning toilets and floors on a college campus? Do they really expect people applying for a minimum-wage janitor job to provide their own disclosure? I suppose that's one way to cut down on the number of people applying. In any case, the job description and application don't say anything about that, and they don't seem inclined to answer requests for further information, so I don't know if that will be a requirement in the end. What I'm asking about is the things they definitely are asking for.

 

For the many, many jobs I've applied for over the past couple of years, I have never, ever seen any ask for all these personal documents before reaching the interview stage -- even for those jobs which did require a disclosure in advance. Some places didn't even ask for them then. With hundreds of people applying for every available position, what happens if they lose track of some of these personal documents that are flooding in? Can anyone point me to any legislation or documentation on the subject of what's an acceptable requirement for supporting documents at this stage?

So two of the listed documents are only to be provided if one actually has them, sure, but they still expect all the others regardless, and that sends up warning flags to me. I'm not sending copies of my passport, license and bank statements (the only "utility bills" I have with my name on them) or my immigration document to a company that won't even answer my questions about the proposed job. Nobody else, not even the Ministry of Justice, made such a demand.

when successive governments have flooded the country with unskilled labour to decimate the lower wage line companies know that for every one of you there are a thousand who will stump up without question as you have already indicated.

 

decent employers would ask after interview for these things but goto my first point ;)

 

I'd also consider your attitude to working with minors and the ECRB because you won't get through the door without one

Sorry, I don't see where I've said anything about my attitude to working with minors, or how it applies in this case. Could you explain what you mean by that? I've got no problem in principle with getting an ECRB either, I just don't see why it would be necessary for a janitorial position in a college.

because under safeguarding your classed javing access to minors if you work in a school,college,fe and are just around the students, i wasn't having a go at you just trying to get across the fact your idea of what is needed in an educational establishment is the complete opposite of how any employer would see it.

Okay, but that still doesn't address the question of why all these personal documents are required so early in the application process, especially when other jobs dealing even more directly with minors or sensitive information or whatnot have not asked for them at this stage.

It sounds like they are trying to quicken the process. If you are concerned you could contact them or perhaps send your application with a covering note saying you can provide all these documents if required.

Many public organisation have been heavily criticised for employing illegal immigrants and or those not entitled to work in the UK, even a major orgaisation supply staff to a military establishment was caught out by not making rigourous checks, so all now are making deeper checks and quire rightly so imo.

Steampowered: I did try to contact them, but only got an autoresponse with the application attached. I'm thinking it's not worth the hassle and concern for the kind of job on offer. I'm only trying to find out if there are any rules about what they can and can't require at the application stage. Does anybody here know?

 

Brigadier: As I have repeatedly said, I have no problem whatsoever with them confirming my eligibility to work in the UK. What I have a problem with is them demanding all these very personal documents at the outset. Especially since the application itself asks if one is eligible. If the answer is "yes", then supporting evidence can be requested at the interview stage if one fulfills all the other requirements for the position. This is how every single other employer has done it in my experience thus far.

A prospective employer can require anything they feel is necessary to the slection process, also it cuts out time wasters to turn up at interviews with out the documents required and expect o be interviewed.!!

 

So an organisation does something different to save time and money!!

Agree with the earlier posts. There are no strict rules on precisely WHEN a prospective employer should inspect and retain documents, merely that this should be BEFORE employing somebody. It sounds as though the organisation concerned are trying to avoid a log jam in terms of trying to get these documents after an offer of employment is made, and also trying to avoid the risk of wasting time interviewing candidates only to then find that the paperwork is not available.

Any advice given is done so on the assumption that recipients will also take professional advice where appropriate.
