    • Must say that's a promising reply from the shopping centre - they didn't just fob you off and say to appeal to the parking company.   Hopefully if you can show them receipts (or screenshots of debit or credit card transactions) that should do the trick.  Good luck!

    • Back in 2012 both myself and my wife were made redundent (we both worked for the same company) and obviously it caused a huge financial crisis. Anyway long story short we got into a mess. Since then we have moved home a couple of times and obviously ran away from certain debts but paid others off. Over the last 3/4 weeks we have started recieving mail from debt collectors such as Lowell and Cabot. Then yesterday we recieved a hand delivered letter from Resolvecall. After checking Credit files the debts they are chasing are 6 years old and maybe close to being SB. Default dates range from 26/12/ 2013 to 30/04/2014.   Question is should i ignore them for now and see if they go past the 6 year mark?
    • Hi  this is my first draft for the defence to be added to the claim this week    The Claim –   1.The Claimant claims the sum of £6605 for an outstanding debt owed. 2.On 30/08/2006 the defendant entered into an agreement with LLoyds TSB BankPLC for a credit card under ref xxxxxxxxxx. 3.On 09/03/2011 the defendant defaulted on the agreement with an outstanding balance of £6864. 4,On 24/06/2014 the debt of £6679.31 was assigned to Aktiv Kapital portfolio AS, Oslo, Zug Branch, who itself assigned the debt to PRA Goup UK LTD on 31/12/2014. 5.Notices of assignment were sent to the defendant in accordance with S136 law of property act 1925. 6.Payments of £61.58 were received up to 07/01/2016 and adjustments have been applied in the sum of £13.18     In respect to paragraph 1, the defendant does not admit the allegation because a. The claimant has failed to respond to a number of CCA information requests in full. b. The claimant has been unable to provide the original creditor default notice c. The claimant has been unable to provide a complete set of original statements detailing exactly how the debt has accrued detailing: All Transactions. From 2006 to 2016   d. A CPR31.14 requesting the Default Notice and Full statement was sent to the claimant on 25/11/2019 and has not been responded to.   In respect to paragraph 2, the defendant admits the allegation.   In respect to paragraph 3, the defendant does not admit the allegations because:   a. The claimant has not provided the original creditor default notice.   In respect to paragraph 4, the defendant admits the allegation.   In respect to paragraph 5, the defendant admits the allegation.   In respect to paragraph 6, the defendant admits the allegation.       Im a little worried about the parts where I admit the allegation - is this the correct type of response? As i see it they have provided the correct information for these elements of the claim 
    • Yes, currently trying to locate receipts in response to an email I just received from the shopping centre,   "Can you please provide your vehicle registration and PCN reference number. I will also need any receipts you have showing you where at One Stop, shopping during the four hours 12 minutes in question so that I can review your case please."   But I will hit up those stores too, as well as see if there's some way they can reprint receipts in case.

Afternoon,

 

I had an uncle buck loan approx 2 years ago which was repaid (i paid througha debt collectionlink3.gif agency).

 

Today a letter has arrived through the post explaining my debt for £65 has been sold to Motormile Finance and they are taking court action against me.

 

I can’t find the original doc's so panicking! any advice please?

Who sent you the letter?

 

When you hear from MMF write back saying that you do not acknowledge any debt,that the original loan was repaid to x by date y. And you expect to receive absolute proof of any alleged debt.

MMF sent it! I'm a little nervous as i can't find any proof of the debt being repaid, but i know i did for certain.

Hi,

Does this sound ok? Is there anyone i can possibly report them to?

I havereceived a letter stating that I owe you £65 for an Uncle Buck loan.

I disputeand do not acknowledge and debt to uncle buck or Motormile Finance UK, as theloan was fully repaid to Uncle Buck on 29th June 2011 & 4thJuly 2011.

I expectto receive absolute proof of any alleged debt.

Does the letter say will or may take court action. I suspect it says may.

Surprise suprise it does!

 

I've emailed uncle buck with the dates and they have agreed its been paid and are stopping the action!

 

prob just tyring to [problem] some more cash!

Hi lozzy. MMF are a very shady company and have reverted back to their old ways. You can send a letter, but you MUST file a full and formal complaint to MMF and the OFT. Those complaints are vitally important.


Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Hi lozzy. MMF are a very shady company and have reverted back to their old ways. You can send a letter, but you MUST file a full and formal complaint to MMF and the OFT. Those complaints are vitally important.

 

Those complaints should be addressed to ROB SANDS COMPLIANCE DIRECTOR MMF.

I hate to stand up for MMF but Uncle Buck are the ones who parceled it up and sold it i imagine. Ok so there was no due diligence but i would be complaining about Uncle Buck.

The OFT needs to hear about UB, but the main issue is with MMF,a nd as brig said, the complaint needs to go to the compliance director. Any other person or address, it will go ignored.

Brigadier why is that statement nonsense.

You know full well i would happily watch motormouth burn in hell.

 

Why is the main issue with MMF?

They bought some debts and sent out a NOA with a we may take legal action on it. No we will or LBA, just we may. UB have failed in their accounting system and potentially commited fraud.
