    • Are you allowed to appeal if you plead guilty?   I know you appeal the sentence, but the criminal record formed from your guilt would surely remain?   I'm not sure if your able to appeal a crimianl record if you plead guilty are you?
    • DX: I did not pursue Link after I got the CCJ amended to monthly payments. Pretty sure the CCJ does not mention reviews, I do have the CCJ somewhere, I will have to look it up in storage. It is as mentioned on the thread you referenced  in your post #28. The Barclays loan was taken out in September 2004 for 60 months! Current Balance remaining approx £2K. On checking back my past correspondence with Barclaycard about this loan, there was a history of them ignoring my letters and offers to pay, and I even had problems in obtaining their bank account details for them to accept my payments! I have received strange correspondence from them too, one referring to insurance which I did not have. They seem very disorganised! Barclaycard told me to pay "Masterloan" a while back and I now receive regular statements and arrears notices from "Personal Loans from Barclaycard" clearly marked Masterloan, they changed the account reference number! I have never requested a CCA on this account. I advised them of my change of address last September, but they are still sending, until today, statements etc. to my old address! I have received 2 letters from Barclaycard Loan today though, not opened them yet!!
    • Yes, a few months ago. They wrote back saying there was no CCA and the debt was unenforcable. I then started gtting bombarded with threatening emails from their 'litigations team' which have been sent to spam. I've now recieved the letter before claim with the PAP form enclosed, but still no CCA or even a letter from them to say the debt is deemed enforcable. Thank you.
    • That's a shame but not unexpected.  I'm not sure about your assumed  questions because I haven't been to court but I'm not sure about not accepting a criminal record. It could be a language thing but it isn't your choice unfortunately.  HB

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Afternoon,

 

I had an uncle buck loan approx 2 years ago which was repaid (i paid througha debt collectionlink3.gif agency).

 

Today a letter has arrived through the post explaining my debt for £65 has been sold to Motormile Finance and they are taking court action against me.

 

I can’t find the original doc's so panicking! any advice please?

Who sent you the letter?

 

When you hear from MMF write back saying that you do not acknowledge any debt,that the original loan was repaid to x by date y. And you expect to receive absolute proof of any alleged debt.

Any opinion I give is from personal experience .

MMF sent it! I'm a little nervous as i can't find any proof of the debt being repaid, but i know i did for certain.

Hi,

Does this sound ok? Is there anyone i can possibly report them to?

I havereceived a letter stating that I owe you £65 for an Uncle Buck loan.

I disputeand do not acknowledge and debt to uncle buck or Motormile Finance UK, as theloan was fully repaid to Uncle Buck on 29th June 2011 & 4thJuly 2011.

I expectto receive absolute proof of any alleged debt.

I've emailed uncle buck with the dates and they have agreed its been paid and are stopping the action!

 

prob just tyring to [problem] some more cash!

Hi lozzy. MMF are a very shady company and have reverted back to their old ways. You can send a letter, but you MUST file a full and formal complaint to MMF and the OFT. Those complaints are vitally important.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Those complaints should be addressed to ROB SANDS COMPLIANCE DIRECTOR MMF.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.

I hate to stand up for MMF but Uncle Buck are the ones who parceled it up and sold it i imagine. Ok so there was no due diligence but i would be complaining about Uncle Buck.

The OFT needs to hear about UB, but the main issue is with MMF,a nd as brig said, the complaint needs to go to the compliance director. Any other person or address, it will go ignored.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

Brigadier why is that statement nonsense.

You know full well i would happily watch motormouth burn in hell.

 

Why is the main issue with MMF?

They bought some debts and sent out a NOA with a we may take legal action on it. No we will or LBA, just we may. UB have failed in their accounting system and potentially commited fraud.
