    • The Royal Leisure Park has free parking for 5 hours as stated on their website (see attached screenshot), so they should not have given me the charge in the first place.   parking rules park royal.pdf
    • Hi everyone, appreciate your help in this. Today (18/04/2024) I received a "Parking charge - Keeper liability notice for Royale Leisure Park - W3" stating that I "parked without clearly displaying a valid PCM UK Ltd permit. The car was parked on the 8th of March 2024 at the car park for Park Royal Leisure Park in London. The letter stated that a notice to keep was sent 28 days ago, but I have not received any charge letter or ticket.  I don't know what permit they are talking about. The leisure park does not have tickets, it has free parking for 5 hours- this is clearly stated on their website. Furthermore, I think the Parking Charge is invalid because, on March 8th, I was a customer at Royale Leisure Park, where I attended to watch a movie at the Odeon Cinema. I can prove my purchase of the ticket. The Royal Leisure Park has free parking for 5 hours as stated on their website (see attached screenshot), so they should not have given me the charge in the first place. Should I contact them to state that I should not have been given a charge? I'm concerned about the charge rising if I don't contact them.  Your advice is greatly appreciated.  Thank you.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi again everyone normally I'm doing the halifax or HSBC.

 

I recently discovered that my wife had a credit card with the lloyds TSB I searched through the statements that went right back to 2003.( I had these because I tried to get the bank charges back some years ago on it....remember those days boys and girls.?)

 

Sure enough there was the PPi all dressed up as CARD HOLDER PROTECTION PLAN.

 

Now at that time when my wife went to them for the card she was dealing with or helping her mother to sort out her accounts with the LLOYDS TSB.

 

She asked for a card for herself and it was agreed (Remember those days of banks dying to get you into debt so that they could rape and pillage your finances.??) she could have a card.

 

We didn't even realise that this PPi was on the account until I looked at the statements last November.......since then we had a letter saying that they were looking into it ,then a letter saying they required a further 8 weeks to sort it out, then a phone call askinig if she had ever had a savings account with them (what the hell that had to do with it I don't know.Then we had another call asking us to confirm that would someone of helped her with the payments and was she working at the time >>>? well DER look at the questiuonaire you foreign numpty that we could hardly understand.

 

As it was, my wife wasn't working at the time and this would of been clear in the application for the card.

 

Now lloyds have written back sayinyg that they can not see anything in the miss selling of the policy to us that that a booklet with the Ts and Cs was handed over etc..........now surely if it had been made clear by there sales person that due to my wife not being employed at the time and she has always been a housewife that the PPI was not suitable because she wouldn't of been able to claim on it, then I'm sure we would n't of said "oh no please put it on so it costs us more but its worthless."

 

Do we now go back and say at the point of sale this sales person new my wife's circumstances and still proceeded with the sale

 

A) we didn't ask for it and nor did we realise that it was on the card

 

B) Why did they put it on the card know it was worthless to my wife as she wouldn't be able to claim on it due to not being employed..........

 

its all well and good the sales person ticking boxes at he point of sale then flashing through it to get the signature but iI believe we were genuinely miss sold this on the card my wife isn't fully ofay with figures anyway she doesn't know the difference between 3000 and 30000 so she wouldn't of known anyway.

 

HAS ANYBODY ELSE HAD A PROBLEM LIKE THIS WITH LLOYDS.....THEY'RE SAYING HE'S INVESTIGATED ALL SIDES AND CAN'T SEE ANY FORM OF MISS-SELLING.(

LTSB are rejecting complaints out of hand and you need to challenge their decision.

 

You should make it quite clear that the PPI would not have been suitable for someone who didnt have a job in the first place.

 

However, I will flag your thread for someone who has more knowledge of this.

Yep I think citizenB is spot on.

 

In my view you should always challenge the lender. If you read their letter you will find that there is a lot of speculation on their part.

 

Reinforce your arguments to them.

 

They have recently been fined for their delaying tactics on making refund payments to people and will almost certainly be having a go at minimising their losses of being the biggest "Mis-Seller" of PPI in the industry.

I've taken the halifax to the ombudsmen already from my other thread with the halifax.

 

how can I get the letter onto the site for you guys to have a look.....I really do believe they are stalling. They make out as if they were actually there at the time.the 2 phone calls were very wierd and even I could hardly understand the caller.They asked my wife rediculous questions and the best part is it was already in the questionaire.Can I attach the letter somehow.?

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

would anyone like me to list my letter I think they are squirming around everyone replies.

 

If my wife wasn't in employment at the time there is no way they would have payed her out surely......my family is a very close one and has helped us out on many occasions is that good enough to reply with as evidence as to why and I think I'll mirror the great letter on the above thread ....

 

oh yes there are a lot of familiar things going on right down to the two phone calls talking crap.

hit manage attachments below that box

hit the add files button on the top right

hit select files, navigate to your file on your pc

Hi I have attached here my letter that I received from the LTSB. I might add that the letter was of poor quality the paper was cheap and the printing was terrible its not my scanner that has made the marks down the page thats how I received It.

 

I would be greatful for any helpful comments as to how I can adapt the great reply letter that was brought to my attention earlier by dx100uk.

 

has anyone else had a similar letter or even exact copy.

It is a typical cut and paste template letter from LTSB, they are obviously NOT taking anything into consideration because someone who was not in employment would have only benefitted from the life cover and I am sure they would have found some pre existing medical issue to deny even that.

 

The policy was not suitable for your wife, end of story.

 

Ask them to revisit their decision.

Hi guys , should I put that point in my letter citizenB or should I just point out that my wife would not have been able to claim on the policy due to not been in employment . the bit about only benefiting from the the life cover assumes they have given me a choice or should I put it in.

If they had explained the policy to your wife and then said.. oh you will only ever benefit from the life cover, would she have taken it.. bliddy expensive life cover IMHO. So the answer has to be no. She would already either have had a life policy or she would have looked for something cheaper.

 

She was unemployed - the policy would not have been of any value to her, therefore it was mis sold.

Hi again everybody,

 

just rang the lloyds TSB ppi claim line and

 

after they received my letter clearly explaining why I thought that they were wrong in their decision ,

 

they firstly said that there had been no decision yet

 

then the very next day they had suddenley got a letter in the post saying that their decision was staying the same.

 

I said that how can that possibly be when my wife wasn't in employment.

 

well she said "can you prove that?". WHAT.?

 

Since when do or how do I prove that .

..Like there is a wage slip for housewives now or then 9 years ago...

 

...I told her that I only have to keep my book work for tax purposes 9 years not proof that my wife was a housewife...

.Just what are these fraudsters on.....

 

...any ideas of my next step has anyone else been in this position after receiving another final letter.

 

My letter was very similar to the one that dx100uk suggested earlier but that lady was paid out after ringing them

 

..any ideas anyone

yes I totally agree, I have now organised my letters and actions taken to the Ombudsman explaining clearly my case and I have pointed out several points that put them in a bad light again ,silly telephone calls asking the same sometimes irrelevant questions etc...

 

They think they can pull the wool over some of the peoples eyes ....well not mine, i have also pointed out the contempt that they show their customers...many people wouldn't carry on with their claim thinking that they were not entitled to receive it with the way that final letter comes at you.....but when the ruling first came out it said that people were almost entitled to it but even with all the points of miss-selling they still won't give in and are making many peoples lives a missery
