    • Thank you for your reply, DX! I was not under the impression that paying it off would remove it from my file. My file is already trashed so it would make very little difference to any credit score. I am not certain if I can claim compensation for a damaged credit score though. Or for them reporting incorrect information for over 10 years? The original debt has been reported since 2013 as an EE debt even though they had sold it in 2014. It appears to be a breach of the Data Protection Act 1998 Section 13 and this all should have come to a head when I paid the £69 in September 2022, or so I thought. The £69 was in addition to the original outstanding balance and not sent to a DCA. Even if I had paid the full balance demanded by the DCA back in 2014 then the £69 would still have been outstanding with EE. If it turns out I have no claim then so be it. Sometimes there's not always a claim if there's blame. The CRA's will not give any reason for not removing it. They simply say it is not their information and refer me to EE. More to the point EE had my updated details since 2022 yet failed to contact me. I have been present on the electoral roll since 2012 so was traceable and I think EE have been negligent in reporting an account as in payment arrangement when in fact it had been sold to a DCA. In my mind what should have happened was the account should have been defaulted before it was closed and sold to the DCA who would then have made a new entry on my credit file with the correct details. However, a further £69 of charges were applied AFTER it was sent to the DCA and it was left open on EE systems. The account was then being reported twice. Once with EE as open with a payment arrangement for the £69 balance which has continued since 2013 and once with the DCA who reported it as defaulted in 2014 and it subsequently dropped off and was written off by the DCA, LOWELL in 2021. I am quite happy for EE to place a closed account on my credit file, marked as satisfied. However, it is clear to me that them reporting an open account with payment arrangement when the balance is £0 and the original debt has been written off is incorrect? Am I wrong?

I Know! .... someone here with a chance to sue Highview for breach of GDPR with a very good chance of winning, I was excited reading it especially after all the work put in by site members and thinking he could hammer them for £££'s and then, the OP disappeared half way through. Although you never know the reason so all I can say is I hope the OP is alive and well regardless. I'd relish the chance to do them for that if they breached my GDPR.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I had my appeal for ESA turned down and having lived off savings for a few months have decided I need to claim. I cannot go through the whole medical/ appeal process again so will try JSA. Do you have to wait 6 weeks before receiving payment? On the direct gov website all it says is payment is made from 3 days after a claim is made. Is this correct?

There's no reason why you would need to wait 6 weeks - normally it takes 10-14 working days to process a new JSA claim, varying a bit depending on which office handles it. You'd get paid quite soon after that, backdated to the day you made the claim, or three days after that.

 

The three day period (called "waiting days") applies to new claims that don't link to older claims. Whether it would affect you depends on how long it is since your ESA claim ended. If your new claim links to your old one, waiting days don't apply and you'd be due payment from day one.

Hi

 

I was on ESA for about 2 years awaiting the result of a Tribunal Hearing which I lost.

 

I cannot go through the whole medical/appeal process again and so after surviving on savings for 7 months I now need to claim JSA. I have seen it mentioned that this can be backdated in some circumstances but when I have tried to find out what these circumstances might be I cannot find any information.

 

Basically after losing my appeal i was so upset (am suffer from bipolar depression/anxiety) I just shut myself in my flat and went into a downward spiral. I am now feeling a little better and am willing to claim JSA and try to find work.

 

I am wondering if I can claim from earlier than the present day or as I was not able to seek work not. However if some claims can be backdated and presumably you have not been seeking work then what are the criteria? I have been on the directgov job website and applied for several jobs. Maybe they can track this.

Backdating for JSA is in two seperate parts.

Firstlt you need to show on form JSA5 that you have been been actively seeking and available to take up employment. (you will state any vacancies you applied for and other actions like updating CV, registering with agencies etc) this is to show that you have met the labour market element.

If you meet that then the BC will consider the claims and payment regulations to determine if payment can be backdated. The criteria for making payment is set and rigid you either meet it or you don't.

 

You can find that on some occasions clients meet the labour market conditions but not the payment regulations and therefore no payment will be issued for a period prior to te initial date of contact.

If you apply for JSA onine I beleive there is a question about the date you want to claim from and you have the opportunity to give more information then

I applied for JSA 2 weeks ago. I just received a letter asking for 6 months bank accounts. Why do they need these? I am not getting any benefit until they have them, so I sent them in. I need to know what they are looking for and what do they have the right to question me about? Can they query my spending? Also why didbn't they ask for these when I signed on and again the next week when I went in to sign for the first time. I now face another wait and will have run out of money for food before I get any payment, if I get it at all. What grounds could they withhold payment?

No, I have not worked since 2010, I was on ESA until I lost an appeal last October. Is that what they are looking for? Payments going in and not bothered about what I have spent?

 

Yes, they will be looking at how you have been supporting yourself since the ESA ended and checking that you haven't had a job you've not declared (fearing a sanction), or some income you haven't declared.

Can anyone confirm that you are allowed to do up to 16 hours work per week earning less than 90 pounds without affecting JSA? Or has this changed? Many thanks. I could not find any info on the government website.

I'm self-employed (for 15 hours 59, minutes and 59 seconds per week) and am claiming JSA. BUT, if I do have any earnings, only the first £5 is disregarded. Any earnings over £5 pw will affect JSA, HB and CT benefits. I think this figure rises to £20 pw if you're on ESA, etc but someone in the know will no doubt confirm this.

That's not correct, sadly - perhaps you're thinking of ESA Permitted Work? You can work up to 16 hours per week and still maintain basic entitlement to JSA, but after a £5 per week disregard (£10 for a couple, £20 for a lone parent) your earnings will be deducted pound for pound from JSA.

I recently ended a JSA claim but have received a letter stating that they have received information that I have more than 6000 pounds in my bank account. I have sent them statements showing that I do not. Has anyone else receivd a similar letter? Is this just a fishing expedition to see if they can catch people out? I know of no-one who would tell them this even if it were true. I cannot get statement for the whole period of the claim as they are not yet onlne. Any advice anyone?

They're not allowed to go on "fishing expeditions" - they have to have at least some basic reason to suspect there might be a problem before they send out a letter like that. Doesn't mean they're right, of course - I don't think it would be a revelation to anyone here if I pointed out that the DWP makes bad mistakes.

 

Can you get the relevant statements from your bank branch, or in printed form?
