      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just sent my letter by recorded delivery requesting £2025 in charges to be refunded. Will go all the way with this one as I was fleeced when at my most vunerable and the bank refused my requests for help.

Just recieved an offer from halifax for £150. As they owe me £2025 this is a joke. Will write a letter accepting this offer and requesting the outstanding balance. As luck would have it in the same post was a letter informing me that They were charging me for an unpaid direct debit and if this causes me to go into an unathorised overdraft I will be charged an additional £28. However it also states that if my unauthorised overdraft is £30 or less then the unauthorised overdraft fee will not be applied. I DONT have an overdraft facility so what is this all about?

I have just recieved a phone call from my internet provider informing me that they submitted a request for a direct debit payment on the 3rd of may as usual and on the 18th of may it was declined by halifax. The payment always comes out at the beginning of the month and there was plenty of money in my account for it to be taken. I am phoning my bank tomorrow to find out why. Any chance they are playing games with me. The bank has not informed me that it did not pay this direct debit, have they done this with other direct debits on my account this month and does anyone think this has happened because they recieved my LBA at this time. I am not a happy bunny at the moment. Surely they can't do this?

Filled in my N1 form for county court yesterday. The bank are claiming that they have not recieved my LBA which was sent by recorded delivery. The post office have not been able to track my letter. Have e-mailed halifax and attached my LBA. What now? Do I wait the 14 days again?

This is typical of this bank. A couple of years ago I complained to the ombudsman about them, but they denied recieving corresspondence from me and therefore there was nothing the ombudsman could do.

Recorded items often don't get updated online by the Royal Mail, hence I don't use it, but this doesn't mean that it hasn't been delivered.

 

Any 1st class mail is deemed to have been delivered in 2 working days (you will note that your bank don't send anything recorded!) so if 14 days have passed since the date they should have received it, then file your claim.

I e-mailed them yesterday. They firstly said they had not recieved the letter. Then in a second e-mail admitted they had recieved it. And what's more. recieved offer in the post this morning for £446.00. What a coincidence! Will proceed with claim through County Court.

Having problems donating to the site. Pay pal won't accept my details. It is a Halifax visa/electron card, maybe that is the problem. Any other way to donate? Oh by the way, a big thank you to everyone. Forgot to mention it before as was toooo excited. Have been running around like a loon. X

I think I have won. No letter, no phone call, and they have until the 21st of June to reply. Just checked my account and it has been credited with £2,495. Charges,interest and court fees. YIPEEE!
