My thought about you making the decision on your own to go with another lawyer is that three of you are meant to be beneficiaries of this will trust, aren't you?     • Hi guys, I am about to file my defence via email as cannot log in to the claim anymore.  Can you please advise if I can paste below and if it's good to go for now, or should I add anything else in?  Thanks!  The Defendant contends that the particulars of claim are vague and generic in nature which fails to comply with CPR 16.4.  The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made.  1.  The Defendant is the recorded keeper of vehicle xxxx xxx.  2.  It is denied that the Defendant entered into a contract with the Claimant - Parking Eye LTD.  3.  As held by the Upper Tax Tribunal in Vehicle Control Services Limited v HMRC [2012] UKUT 129 (TCC), any contract requires offer and acceptance.  The Claimant was simply contracted by the landowner to provide car-park management services and is not capable of entering into a contract with the Defendant on its own account, as the car park is owned by and the terms of entry set by the landowner.  Accordingly, it is denied that the Claimant has authority to bring this claim.   4.  In any case it is denied that the Defendant broke the terms of a contract with the Claimant.  5.  The Claimant is attempting double recovery by adding an additional sum not included in the original offer.   6.  The Particulars of Claim is denied in its entirety.  It is denied that the Claimant is entitled to the relief claimed or any relief at all.

Your insurance requirement is unlawful and is contrary to section 57 of the Consumer Rights Act, and also section 72 of the same statute.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I got my court letter for posseion today on our property, the date is march 13th although eviction will probably be a few weeks after so we'll be here through march I think.

 

We have been told we will be put in temp/emergency accomidation, which was expected, we cant afford to move out and as we work we are not entiltled to much housing benefit.

 

I just want to know if anyone else has been through this as I dont know anyone who has before, I already have storage sorted for my furnature, but I really have no idea what to bring with me.

 

Please dont judge me, just because we work we can still not afford to move out, we have been down this road with our local council who also agree.

 

Please advice anyone?

 

And also anyone else going through the same please feel free to chat!

Shreddies, sorry to hear this. No one will judge you. Circumstances beyond control happens and it must be a very scary place you are in at the moment.

 

I am sure others will pop in and advise from either experience or knowledge and hopefully things will soon get better for you.

 

If you want, you can contact Shelter.. they dont simply deal with homeless people and have a wealth of advice on their website and you can also contact them by telephone.

Shreddies, is this a rented property you are being evicted from ?

 

Hi thanks for replies, it is and assured shorthd tendency. I have a new landlord he wants us out for no reason, we don't owe any rent no arrears etc our flat is in better condition as we have decorated it, I don't see his point but he did want to put the rent up to £ 800 this Is for a 1 bed.

 

I have a young son of 7 and was just looking through his school newsletter and think this should be happening (the eviction) in the Easter holidays...I can't bear to put him through this.

We don't have shelter in my area but we do have something similar called housing trust its just the same I have been told and I have a case worker there who is very good and is trying to keep us in our area.

Hi there Shelter's helpline number is 0808 800 4444 they are fantastic with cases such as yours. The lines are usually quite busy so you would have to keep trying, but don't give up, it will be worth your while talking to them.

One thing aswell which is bothering me is that around 6 months ago we got virgin media, will I have to cancel this? I know do silly but I was thinking about it as I am every little thing.

Thanks I will contact them about it, it's so embarrassing for me though, every time I have to share information about this with people I feel like a lose a piece of my sanity...if that makes sence.

Thanks so much again for replying.

 

I am really trying to sort this out in a 'keep your wits' kind of way, but every now and then I panic, it's terrible my heart mate just goes straight up out of no where and I just feel as though I want to really cry or smack my head on something. It's a really tough mood to be in, I work with young children and last thing I want is this affecting my work, I really cannot afford to lose my job, and then with a thought like that I bubble over and panic again.

 

Thanks for all your kind comments and help. Out of everything that's happening its the replies and support I get on here that keeps me going.

On Thursday I've got an appointment with my case worker at the housing trust, I'm hoping he can support me with staying within my area as apparently there is not much temp accommodation to go around, I understand this but Surely there should be something out there for a family with no transport....? I think I might possibly need to take time out aswell to see my doctor though I'm not sure.

Here's an update..

 

I went to the council. They told me there's no forms to fill out my housing options officer makes a referral to the homeless department.

 

I was told by my housing trust that I have to wait until bailiffs evict me but this is not so, wether its changed or just my council I'm not sure but I will be leaving around 12-13 th into temp accomidation.

 

It's all very scary I don't know how I'm keeping it together.

It's up to you how you deal with this of course, but if it were me, I'd think it was worth a call to Shelter to get an alternative view. I believe they can advise on various issues around homelessness.
