Hi, just hoping somebody could help with something that is causing a bit of a headache. Long story short I've had an awful few months with my incapacity benefit being stopped and being passed around from call centre to call centre trying to sort something out. Well today I had a ESA1 form arrive and I'm just not sure on how to fill it in correctly. The first question on page 1 says 'Do you want to claim income-related employment and support allowance - tick yes if not sure' The issue is it then says fill out the boxes marked 'you' and 'your partner' if you tick yes. But I don't want to claim for my wife, so what do I put? Any help is appreciated.

Hi Mr Hare,

Not long ago i filled in esa3 form and i didn't want to claim for my wife, i filled in all my wifes detail and in part 22 i wrote (please note i do not wish to claim for my wife and gave them the reason) My application was successful.

DWAP put on their system the application do not wish to claim for the partner.

 

If you can give more detail someone on here will help you better. Can i ask why you do not wish to claim for your wife, could be same reason as me.

Thanks for the replies. The reason I don't want to claim for my wife is because she's already on her own benefit for her own problem, so I can't see why I'd need to put her down when this is just for me.

If you're a couple, any income based claims have to be made as a couple, with any income your wife has taken into account.
