    • Dear Sir/Madam, TFL case number: **** I would like to thank TFL for providing me the opportunity to explain my behaviour. I realised the stupidity of what I have done and wish to seek a resolution to this matter. I have no valid excuse for this action and I am extremely sorry and deeply regret my action. I hope you will accept my sincere apologies. Nothing can justify my action. I am aware that TFL are only able to operate if everyone pays their fare correctly and I feel so guilty about attempting to breach public trust. This has caused me sleepness nights and raised my anxieties. I have history of anxiety. This has been a hard lesson learnt. I have never been in trouble with the law in the past and I ensure that I won’t be in the future. I am and will be using my oyster card (PAYG). I would like to humbly appeal to TFL to allow me to settle this matter out of court and avoid going to prosecution given the adverse consequences it can have on me and my family. I am very concerned that prosecution for the first time and I would like to make restitution for my action. Having a criminal offense on my record will have detrimental consequences on me. I have always been a law abiding person and have no previous offences. I would really appreciate if I can be given the opportunity to pay for any unpaid fares plus any charges and/or administrative cost which have been incurred by TFL due to this incident. I am sincerely remorseful and ashamed of myself, and I fully appreciate the severity and stupidity of my transgressions. Again, I would like to offer my sincerest apologies. Yours Faithfully, My Name

    • If i did it through the bank, they seem to have an online form. I wondered if this is the best way or to do a letter, add supporting documents and send them through the post, recorded delivery  ?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I overheard a guy getting berated and belittled for not shaving and wearing casual clothes as opposed to a suit, the he was asked about how much he spends on smoking and then the guy told him he should use that money to top his phone up so he has credit

He was also getting told how it's somehow his fault he's not working due to not tailoring cvs and stuff and that he should do more to look

I have a simple policy - Never, ever discuss finances with anyone. The only exception is a qualified and certified financial advisor or a bank manager. WP minions and JCP advisers have little, if any knowledge of money matters and have no rights to give advice on how you spend your money.

 

Too right! I also never discuss personal stuff like interests, hobbies, etc with them - not even the nicer ones. Keep it business-like at all times; none of us are there for the pleasure of it.

 

Last advisor who asked me smugly what I did with 'all my spare time' I replied 'Oh, I meet up regularly in the evenings with your District Manager, who's an ex-Civil Service colleague and a very good friend of mine. Often your Regional Manager comes along too, another good friend'.

 

Never seen the subject changed so quickly :)

I just don't get this - it would never have occurred to me to ask a claimant what they spent their money on. I suppose I was a processsor, not an FLA, but still.

 

My view was that we're all in this together.

I think it's part of the idea where they pay you yto Jobseek so you must Jobseek 24/7 and you can't have hobbies or a life

It's their way of being tougher in prep for UC

 

I get this impression due to my one and a manager I made a complaint to about her

So as of to today the new scheme called The Help To Work Programme starts at Jobcentre Plus and Will affect anybody claiming Jsa for 2 or more years - it consists of signing on everyday or a 4 week voluntary work placement

Or upto a 6 month placement that includes a training scheme

How long do u hav to be claiming jsa before they send u to wp - it was 12 months for me so it would only effect people who hav completed 12 months at wp if its the same where u are and also people who are already doing voluntary work off their own bat will probably be excluded

I claimed 6 months JSA(CB) then 6 months JSA(IB) and then was told when I went in I was on the work programme - great! Of course they have brilliant so far, what I mean is they have done NOTHING to helpme at all and it is a total waste of time

I will be safe anyway as I won't be doing it as I have my own voluntary roles that I found myself for 3 days a week. I sort of saw this coming which is why I got in early and sorted something I wanted to do for myself rather than doing something useless for no pay.

Yes it will be in every jobcentre as of today and will affect anybody claiming jsa for 2 or more years and not currently under taking any voluntary work or training

My advice to you all is to find yourself something YOU want to do as soon as you can, at least that way you have the upper hand

Thanks. Would online volunteering be accepted? There is one that really interests me about proofreading scanned texts.

Nevermind reading up on it, it seems that it is only places in the community that would be accepted. I also dont think you will be safe if you already do voluntary unless you are working 30 hours.

 

I do have a question though, I am moving to a new area in a few weeks, and am hoping to get a job not long after I move there and I am wondering one thing, if I get a temporary job and say it only lasted 3 months, what would happen if I signed back on? Would I be a new claim? I finsihed the work programme back in November 2013 and have been on the post work programme since then.

Yeh was going to say if u are on the WP then u are fine after your 2years is done u then get put on to the help to work scheme

yes its basicaly the same system except the Help To Work Scheme Replaces Post Work Programme Support

had my appointment today and yes i have 4 weeks to either find my own voluntary work for a charity or if i cnt find any i go on help to work placement under the mandatory work scheme which will be 30 hours per week for 4-6 weeks either in a charity shop/ tescos either bag packing or litter picking in the carpark or at local recycling plant picking objects out of rubbish as it comes down the line but you dnt get to choose which as they just send u on the first available placement

So basically you are going to be treated as a criminal on community service? This is an utter disgrace and I am genuinely angered by this. How low can the people who make these rules get in setting people up to not only fail but to be reduced to nothing more than a piece of sh*t on the road side.

 

What I would be doing now is visiting somewhere in your community that may need help and somewhere YOU want to work at and asking them if you can help out.

 

I am genuinely upset for you and others who will be sunjected to this sort of treatment.

I think I read that you still have to do 10 hours job searches and of course if you get an interview and go to it you will be sanctioned for not attending your slave labour at the dump of JCP choice

 

As for UJM, don't bother, it is not fit for ANY purpose
